COUNTER–AFFIDAVIT

I, MARIA CLARA CRISOSTOMO, of legal age, Filipino,

married, and a resident of Blk 17 Lot 10 Kohana Grove Brgy. Sabutan
Silang Cavite, Philippines, after having been sworn to in accordance
with law, do hereby depose and state that:

1. On 17 April 2023, I received a copy of the Subpoena with

Attached Complaint-Affidavit from this Honorable Office of the
Provincial Prosecutor of Imus City, Cavite, requiring me to
appear and submit my counter-affidavit and the affidavit of my
witnesses within ten (10) days from receipt thereof;

2. I am being charged by the minor, PEPPA PIG (herein after

referred to as “Peppa” for brevity) for violation of Republic Act
No. 7610 or “Special Protection of Children Against Abuse,
Exploitation and Discrimination Act”, specifically Sections 10(a);

3. There is no truth to all the allegations of the Complaint of

PEPPA PIG indicting me of the instant charges. The truth of
the matter is explained below;

4. That on 23 February 2023 at around 6:00PM, me and my

nieghbor, PETRA DELOS SANTOS, also a resident of Kohana
Grove Brgy. Sabutan Silang, Cavite, was chatting in the
Pavillion Club House of the said subdivision.

5. That while we were happily chatting and minding our own

business, the herein complainant, Peppa passed us by and
called my friend Petra “matandang hukluban” and made face at
us (rolled her eyes and stuck her tongue out).

6. That after hearing such disrespectful behavior, I went up to her

and asked her why she said such disrespectful words and made
the actions but instead of answering, Peppa angrily retorted,
“Bakit ka ba nakikialam? Isa ka pang pangit na hukluban.”

7. That in my attempt to stop the child’s outburst and the incurring

attention we are getting from other occupants of the club
house, I had grabbed unto both of her shoulders, contrary to
her claim that it was her shirt that I had pulled.

8. After grabbing her shoulders, I chastised her for the words that
she used and her unnecessary outburst towards her elders. She

struggled in my hold which consequently caused me to grip her

shoulders tighter and contrary to Peppa’s claims, I had not
boxed her at the back of her shoulders.

9. I admit that I uttered the words, “Walang hiya ka!” but it was
NOT with the intention to humiliate or embarrass her but was
only a spontaneous reaction brought about by her appalling
action towards me and my friend and her misbehavior.

10. That despite my effort to inquire as to the reason for her

anger and to pacify her, she has repeatedly thrashed in my hold
and wailed and called out for her brother.

11. That there were several people who gathered and witnessed
the commotion and to save myself and my friend from
embarrassment we chose to let go of the matter and leave the
club house afterwards.

12. That I have attached a copy of the joint statements (Annex

“1”) made by two witnesses namely, Sisa Mestisa and Basilio
Mestiso who saw and overheard the entire scenario as they
were sitting on a bench near us.

13. I have later learned that this complaint was made only to
pressure me and my friend as I have later learned, the parents
of said child, Mommy Pig and Daddy Pig, has an on-going beef
with my friend, Petra for a previous unpaid debt. The events
which transpired, and the facts of these matters are herein
attested to by Petra in her attached Sworn Statement. (Annex
“2”)

14. That I have confirmed this matter as well with the Barangay
Captain of Brgy. Sabutan who issued the CERTIFICATE TO
FILE ACTION (Annex “3”) in favor of Petra Delos Santos and
against Mommy and Daddy Pig.

15. Prescinding from the above, I most respectfully pray that the
instant charge against me be dismissed for complete absence of
probable cause.

TO THE TRUTH OF THE FOREGOING, I have signed this

Counter-Affidavit on 23 April 2023 at Trece Martires City, Cavite,
Philippines.

at Trece Martires City, Cavite, Philippines, the respondent exhibited
to me competent evidence of identity consisting of SSS ID NO. 123-
4567-8910. I hereby certify that I have personally examined the
respondent and am satisfied that she voluntarily executed and
understood his sworn statement.
