Greetings of the day!

We are pleased to submit herewith the offer for Silver coverage (“Service Package”) of Cummins India
Limited for your ESN: 84931015. This Service Package is applicable only for engines (of DG Sets) of
Cummins India Limited (Herein after referred to as “Cummins”) and covers engine, alternator and engine
panel of DG Sets only. (Herein after referred to as “DG Set” / “Engine”). This Service Package in applicable
in India only.

This offered Service Package consists following:

1. Scope of Work

 Two Health checkup visits per year

 Limited to Engine, Alternator & Engine Panel of DG Set
 Include labour expenses / jobs for defined tenure and limited to scope of work
 Includes all minor & major repairs – Parts & Labour
 Transportation charges required to carry parts at site

2. Out Of Scope

 Consumables (Oil, Filters & Coolant) required for B/C Check as per running of engine
 Battery beyond 2 years of original warranty of DG & Fuel
 Any failure due to accidents, theft, natural calamities, misuse, improper use of shut down
 Charges towards mobile crane, heavy tools
 Acoustics, exhaust pipe cladding, Electrical panel, out battery limit of DG. Silencer, exhaust
chimney & its support.

3. Tenure

 3 years post expiration of 2 years original warranty orOR total 5000 hrs from the date of
commissioning whichever is earlier.

 4. Pre-Requisite

 Preventive maintenance of DG set & replacement of filters, filling of recommended lubricant,

coolant and other maintenance spares shall avail from Cummins Authorized dealer/s only in the
respective location.
 DG Installation & Commissioning as per Cummins Guidelines.

5. Pricing Per Engine

 Basic Price: Rs: 42,434/+ GST extra as applicable

6. Payment Terms

 100% Advance on the signing of the offer document.

 The Payment made against the Ashwasan Package will not be refundable under any
circumstances.

General Terms and Conditions (Applicable for Extended coverage)
The DG Set covered under this Service Package is covered to be free from any defects in workmanship and
material under normal use & preventive maintenance service. Cummins obligation under this Service
Package is being limited to replacement or repairing at Cummins Authorized locations. Cummins neither
assume nor authorized any person to assume for any other liability in connection with this Service Package.
This Service Package does not include DG Set removal and reinstallation expenses. The Service
contemplated herein does not mean/include services related to making changes in the DG Set design or
introduce any improvement or add any part on the DG Set to make the DG Set as per new models introduced
by Cummins from time to time. Service Package covers replacement of failed parts and not applicable for
replacement of whole DG Set.

The Service Package will not applicable / valid if :-

1. In case of non-receipt of payment from Customer

2. DG Set over speeding, misuse, negligence, theft or accident
3. Any damage resulting from improper use or shutdown.
4. DG Set repaired or alter outside of Cummins Factory/ Plant or by anyone who is not authorized by
Cummins in such way that, in Cummins sole judgement, its performance and reliability are
adversely affected.
5. DG Set or any part, component or accessory of the DG Set improperly applied or installed/
commissioned.
6. Failure in any way resulting from use of part, component or accessories not recommended or
approved by Cummins.
7. Any damage due to idle storage of the DG Set beyond period of Six (6) months without treatment
for long storage.
8. Any damage due to use of lubricants, fuel and coolant of quality and grade not recommended by
Cummins.
9. Any damage to DG Set causes due to any other part/ component which is under excluded under
this Service Package shall not be covered.
10. DG Set purchased without performance related parts and accessories.
11. Failure of DG Set due to improper ventilation or deficiency in design of accessories used other
than those recommended by Cummins.
12. DG Set repairing /servicing during term by anyone other than Cummins Authorized Service
person
13. In case of any sort of fire incidences under any circumstances.

All claims against the Service Package express or implied be automatically become void by or due
to any improper installation/ commission or application or any substitution of parts, component
or accessories not manufactured or approved by Cummins. Cummins make no coverage under this
Service Package as to normal wear and tear, nor do Cummins agree to be liable for loss of time to
the user while the engine or other equipment is out of commission, nor for any labour or other
expense, liquidated or unliquidated damages, consequential losses or loss occasioned, or claimed
to be occasioned by such defective parts, components or accessories.

Any claim or obligation in connection with the Service Package shall be subject to the jurisdiction
of the courts in Pune only.

 Conditions Precedent to Service Package: -

Cummins recommends to every customer, who opts this Service Package, to familiarize
himself/herself with this Service Package document. The Service Package applicability is explicitly
subject to certain conditions precedent, being met by the Customer to the satisfaction of Cummins,
without which the claims, if any, would involve inordinate delays for settlement and sometimes
even rejection. Some of these are summarized here for the benefit of the Customer.

The Service Package is subject to fulfilment inter alia of the following obligations by the Customer

i) Proper installation of the DG Set & finishing safe & free access to DG Set. This is sole
responsibility of the Customer/ end user.
ii) Normal use and preventive maintenance as recommended as per engine owner’s
operation & maintenance manual supplied along with each DG Set.
iii) In case of any defects are noticed, it would be a worthwhile effort on the Customer’s part
to satisfy himself / herself in the first instance that the defect could be reasonably
deemed to be of workmanship or material and that the DG Set was never subjected to
condition in respect of which the warranty has been expressly negated.
iv) Any part claimed to be defective should be returned to the Cummins’s factory/ Plant at
Pune / Cummins authorized distributor or dealer.
v) Any attempt to tamper with or interchange any parts between DG Set shall lead to
Service Package applicability void. Most of the precision parts such as the injector, fuel
pumps are specially calibrated to suit Customer’s requirements and the Cummins has a
record of each DG Set and parts utilised thereon duly coded.
vi) No reimbursement is made in respect of normal wear and tear, loss of time to the
Customer/ end user while the DG Set or other equipment is out of the commission nor for
any labour or other expenses, damage or loss occasioned by any such defective parts. Any
improper installation / commission or application or any substitution of part not
manufactured or approved by the Cummins shall render all warranties, express or implied
on the Cummins’s part void.
vii) Exclusions:
A) Canopy, acoustics, exhaust pipe cladding, Electrical panel, out battery limit of DG Set
& canopy. Silencer, exhaust chimney & its support. This will be not covered under this
Service Package.
B) Any fault or damage to DG Set by using improper fuel, use of any additive in
fuel/oil/coolant
C) Any Consequential or special/indirect damages in all circumstances including but not
limited to fuel or any out of scope item.
