We offer Major Overhaul contract of Cummins Diesel Engine Having Engine Serial No.21750503,
we would like to express our gratitude for utilizing the product represented by Orient Energy

We assure you for our best Engine / Generator overhaul services and close cooperation to keep
your generator in an excellent condition by virtue of timely, your overhaul by our specifically
trained Engineers & Technicians.

This Comprehensive Major Overhaul Contract hereinafter referred to as (MOH) is made on this
the December 01, 2013 between Orient Energy and Zafa Pharmaceutical Laboratory (Pvt.)
Ltd.

 START-UP AND LOAD TEST.

 THE SERVICE CLEANING, INSPECTION TEST, RE-VARNISHING AND ASSEMBLING WILL BE DONE IN OES WORKSHOP.
 IF AT ANY STAGE RE-WINDING OF MAIN ALTERNATOR ROTOR/STARTER OR COMPONENTS REQUIRED WILL BE
QUOTED SEPARATELY, DUE TO CLEANING & REHEATING; IF IT IS REQUIRED REWINDING IT WILL BE INTIMATED TO
CUSTOMER & QUOTED SEPARATELY.

First service / oil change will be due after 50 running hours.
3. Liabilities of the Contractor:
(a) The OES promises that the Goods/Services will:

(i) Conform with the specifications and description set out in this agreement;
(ii) comply with all relevant standards or laws applicable to the Goods/Services; and
(iii) be free of defect.

(b) The OES promises that the supply of the Goods/Services by it under this agreement will not constitute
an infringement of any patent, design, trade mark or copyright.

(c) The OES promises that delivery will be made:

(i) in a timely and professional manner;

(ii) with proper care, skill and diligence.

(d) If requested by Customer Representative, the OES will ensure that the OES’s Personnel attend
induction training provided before the Personnel start duties on site premises.

4. Liabilities of the Customer :

(a) Rigging / Transportation / Transit insurance from customer site to OES workshop is customer
responsibility

(b) Rigging / Transportation / Transit insurance from OES workshop to on site is customer responsibility

(c) GenSet / Engine / Main Alternator repair history to be provided by customer.

5. Warranty of Work Repair:

(a) OES will provide warranty 180 Days for parts invoiced

(b) OES will provide 90 days for service after load test in OES workshop.

 6. General Terms & Condition.
All terms and conditions between both parties should be understood and signed. Any objection or comments
shall be entertained before the approval of the proposed contract with scope of work..

1. The job to be completed in about 08 Weeks from after firm of parts & service.

2. Limitations :
OES expressly excludes liability for any claims relating to loss or damage of any type arising out of failure of the
Cummins engine under contract to operate for any period of time or other economical or moral loss, or
direct/indirect contract or consequential losses.
3. Force majeure :
OES shall not be responsible to client for non-performance or delay in performance hereunder on account of
any event of force majeure, including without limitation acts of God, cyclones, Landslides, earthquakes,
floods and washouts, strikes or other industrial disturbances, governmental or semi-governmental laws
regulations orders.
decrees restrictions, restraints prohibition intervention or expropriation, or the failure of any governmental or
semi-governmental entity to act, explosion, collision, radiation, act of public enemy, act of war, blockade, riot,
civil commotion or disturbance, sabotage, insurrection or national emergency and any unavoidable accidents.

4. Quotation is valid for 30 days only from the time submission of the quotations.
5. Terms of Parts:
100% Advance payment to be received along with signed contract and Part
Purchase order or approved quotation.
6. Terms of Service
a. 75% Advance with Work Order.
b. 25% remaining payment after satisfaction and completion of Jobs within 15 Days.
7. All kind of taxes by any authority will be borne by the client.
8. Any damages to the Genset due to misuse will be charged for extra.
9. Charges for additional/emergency visits After Major overhaul per day/per visit inclusive of travel, boarding &
meal expenses to be borne by customer based on existing OES Service Charges.
10. The quoted part (s) prices may change after quotation validity expires.

11. Any part number(s) may change (Supersede) as per Cummins global standard.

12. Parts will be ordered after your firm P.O.

13. The parts availability status is as on the quotation date and subjected to first ordered, first delivery basis.

14. Average lead time of non-available parts is 6 to 8 weeks for normal orders from the date of firm P.O.

15. For emergency orders, lead time is 3 to 4 weeks with additional charges of 10% and is subjected to the part
availability at Cummins Central warehouse.

16. Any change in Govt. Taxes rate or implementation of additional levy will be charged at actual.

 17. For major overhauling / top end cases, the parts list is subjected to change after disassembly.
