i. Quid Pro Quo –
 Occurs when submission to sexual conduct is implicitly or explicitly made a term or
condition of an employees' initial or continued employment, or is used as the basis
for any employment decision affecting the individual employee.
 Occurs if an employee is denied a promotion or a wage increase, is demoted or loses
an opportunity for advancement, or is laid off or terminated because the employee
refused to submit to sexual advances.
ii. Hostile Environment –
 Where the harassing conduct unreasonably interferes with the employee’s work
performance or creates an intimidating, hostile, or offensive work environment.
 An employee need to prove that the working environment must only be one that a
reasonable person would find hostile or abusive and that the victim subjectively
perceives as abusive.
 Environmental sexual harassment cases usually involve such as sexual suggestions,
sexually derogatory remarks, sexually motivated physical conduct, and other sexually
suggestive remarks or items.
