Respected Sir,

Subject: Grievance Regarding Illicit Constructions and Obstruction of Public Roads by the Management of Gulshan-e-Maymar, Karachi.
I am composing this grievance to draw your consideration towards an issue that has been troubling the occupants of Gulshan-e-Maymar and surrounding
communities in Karachi for a considerable period. The administration of Gulshan-e-Maymar has erected multiple portals, barricades, and obstructed public
passages by excavating substantial cavities at the ingress or egress of the society. These measures have resulted in hindering the primary public roads designated by
the government for the general populace, and from the revenue amassed from the general population as tax, the government is expected to provide fundamental
rights.
These blocked Public roads constructed by the Government for General Public include:
1. Maymar Ave Ext, which connects multiple main roads, especially Super High Way from Chakar Hotel and Taiser Town Road Northern Bypass-Super Hwy Link
Road, has been blocked from two sides, one by barriers at GPS Location: 25.012165, 67.123508 and second by digging the both tracks of the road completely at
Northern Bypass-Super Hwy Link Road at GPS Location:
25.017551, 67.116084.
2. Quad Avenue, which connects I.B Soomro Road, Gulshan Maymar Road, Sher Shah Suri Road, Northern By Pass, Super High Way & Northern Bypass-Super
Hwy Link Road by constructing a gate and barrier near Jamal Masjid at GPS Location: 25.013259, 67.133513, and by digging both tracks of roads at Northern
Bypass-Super Hwy Link Road at GPS location: 25.023092, 67.121495.
3. Bolan Ave, which connects Gulshan-e-Maymar Ave Ext and Quad Azam Ave by constructing a gate and barrier near Al Manzar Town at GPS Location:
25.010168, 67.127090.
4. Nishtar Road, which connects Gulshan-e-Maymar Ave Ext and Quad Azam Ave by constructing a gate and barrier at GPS Location: 25.012100, 67.124581.
5. Quaid Avenue, which connects I.B Soomro Road, Gulshan Maymar Road, Sher Shah Suri Road, Northern By Pass, Super High Way & Northern Bypass-Super
Hwy Link Road by constructing gates and barriers near S Bashir Patti at GPS Location: 25.018306, 67.139181 and gates and barriers near Naz Hospital Abdullah
Gabol Goth at GPS Location: 25.028457, 67.126621.
6. Ghalib Avenue, which connects I.B Soomro Road, Gulshan Maymar Road, Sher Shah Suri Road, Northern By Pass, Super High Way & Northern Bypass-Super
Hwy Link Road by constructing gates and barriers near S Bashir Patti at GPS Location: 25.018306, 67.139181 and gates and barriers near Naz Hospital Abdullah
Gabol Goth at GPS Location: 25.028457, 67.126621.
7. Momin Avenue, which connects multiple main roads, especially Sher Suri Avenue, and Taiser Town Road Northern Bypass-Super Hwy Link Road at GPS
Location: 25.028569, 67.133094.
Furthermore, they have installed barriers on all small roads and all streets of all sectors of Gulshan-e-Maymar.
These measures of the administration of Gulshan-e-Maymar are breaching the fundamental rights of the general public, as established in the Constitution of
Pakistan. As the saying goes, "Justice delayed is justice denied." Article 11: Freedom of movement and right to hold and dispose off property Subject to any
reasonable restrictions imposed by law in the public interest, every citizen shall have the right - (a) to move freely throughout Pakistan and to reside and settle in
any part thereof, (b) to acquire, hold and dispose of property, Article 14: Non-discrimination in respect of access to public places (1) In respect of access to places
of public entertainment or resort, not intended for religious purposes only, there shall be no discrimination against any citizen on the ground only of race, religion,
caste, sex or place of birth. 49 (2) Nothing in this Article shall prevent the making of any special provision for, Article 17: Safeguards against discrimination in
services (1) No citizen otherwise qualified for appointment in the service of Pakistan shall be discriminated against in respect of any such appointment on the
ground only of race, religion, caste, sex, residence or place of birth: Provided that for a period of fifteen years from the Constitution Day, posts may 50 be reserved
for persons belonging to any class or area to secure their adequate representation in the service of Pakistan. Provided further that in the interest of the said service,
specified posts or services may be reserved for members of either sex. (2) Nothing in clause (1) shall prevent any Provincial Government or any local or other
authority from prescribing, in relation to any class of service under that Government or authority, conditions as to residence in the Province prior to appointment
under that Government or authority, Article 25 (1) of the Constitution of Pakistan states that all citizens are equivalent before the law and are entitled to fair and
equal protection of the law, Article 26: Non-discrimination in respect of access to public places 1. In respect of access to places of public entertainment or resort
not intended for religious purposes only, there shall be no discrimination against any citizen on the ground only of race, religion, caste, sex, residence or place of
birth. By impeding the government's primary roads and causing discomfort to the general public, the management of Gulshan-e-Maymar is contravening these
constitutional provisions.
Furthermore, in addition to the Constitution of Pakistan, numerous laws have been enacted to protect public property and guarantee the provision of basic rights to
citizens. The Sindh Building Control Ordinance, 1979, prohibits unauthorized erections of structures and buildings on public property. Similarly, the Sindh Local
Government Act, 2013, empowers local government authorities to ensure basic services provision to citizens, including maintaining public passages. The Sindh
Highways Act, 1955, further authorizes the government to declare any road as a highway and take suitable steps for its maintenance and upkeep.
The Maymar administration and security personnel in Gulshan-e-Maymar, Sindh, are allegedly impeding public thoroughfares by unlawfully erecting barriers and
establishing unauthorized checkpoints on these roads. Furthermore, they are reportedly engaging in the unauthorized inspection of citizens' CNICs (Computerized
National Identity Cards) as they attempt to traverse the public roads. It should be noted that these roads are under the jurisdiction of the Government of Sindh.
Instances of misconduct by the Maymar security personnel have been reported, including physical assault on members of the general public, hindering their
movement, and displaying discourteous behavior. If an individual questions the actions of Maymar security personnel, they are met with resistance. Conversely, if
the general public attempts to lodge a First Information Report (FIR) against Maymar and its security personnel under Section 341 of the Pakistan Penal Code,
Maymar police station fails to cooperate and instead supports the Maymar security personnel.
Despite the constitutional provisions and Other relevant laws, the accountable authorities have failed to undertake appropriate action to address the issue. The
Sindh High Court (SHC) directed on Thursday in 2015, the Rangers and police to continue the operation for the removal of the barriers and barricades illegally
installed in streets and roads in various parts of the metropolis in 2015 but, the accountable authorities, including, Secretary Local Governments, Police, KMC Anti
Encroachment Department, Commissioner Karachi, Deputy Commissioner West Karachi, Assistant Commissioner Manghpir, Director General Malir Development
Authority (MDA), Director General, Sindh Building Control Authority (SBCA), Karachi, Director-General Malir Development Authority (MDA), Director-
General, Managing Director, Sindh Cooperative Housing Authority, Director-General Malir Development Authority (MDA), Director-General, Assistant
Commissioner, Gadap Karachi,.
We implore you to take immediate measures and guarantee that the responsible authorities undertake proper actions to raze all illicit erections and eliminate the
gates, barricades, and obstructed passages. This will help to reinstate the basic rights of the occupants of Gulshan-e-Maymar and ensure that the government's
primary passages are accessible to the general public as intended. As the old proverb goes, "Actions speak louder than words."
We urge prominent international human rights organizations, such as the United Nations Human Rights Council, Amnesty International, and others, to address the
issue at hand. Additionally, we kindly request the Presidents of the United States of America and the People's Republic of China to intervene and appeal to the
esteemed Government of Pakistan to take immediate and decisive actions against the relevant departments responsible for the dismantling of these unauthorized
barricades, barriers, gates, and checkpoints. We further implore the government to implement effective measures to eradicate these illicit structures and
checkpoints, thereby restoring the free flow of traffic and ensuring the unhindered movement of the general public.
