AFFIDAVIT OF CONSOLIDATION OF TITLE

I, CAROLINE B. MATIAS, of legal age, married, Filipino and with residence

and postal address at BF Homes, Parañaque, City, after being first duly sworn in

accordance with the law depose and say:

1. That I am the Managing Director of GOLDEN LINK LENDING

INVESTOR, INC. a financing corporation duly organized and existing

under the laws of the Philippines with principal office at 2 nd Floor,

Villamante Building, National Road, Alabang, Muntinlupa City;

2. That GOLDEN LINK LENDING INVESTOR, INC. is the

MORTGAGEE of one (1) parcel of land, together with the

improvements thereon covered by TRANSFER CERTIFICATE OF

TITLE No. 61861 of the Registry of Deeds of Quezon City, by virtue

of a REAL ESTATE MORTGAGE duly executed by the

MORTGAGOR, NITA L. CALILAN to secure her loan obligation

with GOLDEN LINK LENDING INVESTOR, INC.; said parcel of

land is particularly described as follows:

TCT No. 61861 Registry of Deeds-Quezon City

 A parcel of land (Lot 4-B of the subd. Plan Psd-13-009591,
being a portion of Lot 4 Blk 6 (LRC) Psd-170715, LRC Rec.
no. 6563), situated in Brgy. Sta. Monica, Novaliches, Dist.,
Quezon City, M. Mla. Bounded on the E., along line 1-2 by
Lot 6 Blk 6; on the S., along line 2-3 by Rd. Lot 3 both of
plan (LRC) Psd-170715; on the W., along 3-4 by Lot 4-A
of the subdn. Plan; and on the N., along line 4-1 by Lot 3
Blk 6 (LRC) Psd-170715. Beginning at a pt. Mark “1” on
plan, being N. 62 deg. 30’E., 726.34 m. from LM 1, Tala
Estate; thence S. 1 deg. 11’ W., 20.00 m. to pt. 2; thence S.
88 deg. 49 W., 6.50 m. to pt. 3; thence N. 1 deg. 11’E.,
20.00 m. to pt. 4; thence N. 88 deg. 49’E., 6.50 m. to pt. of
beginning; containing an area of ONE HUNDRED THIRTY
(130) SQ. METERS. All pts. Referred to are indicated on
the plan and are marked on the ground by PS oyl. Conc.
Mons. Except pts. 1 & 2 by old PS oyl. Conc. Mons.
Bearing true date of original survey, during 1907, that of the
subdn. Survey, April 23, 1989, approved on May 15, 1989.

3. That on January 17, 2002 for failure of NITA L. CALILAN to pay her

loan obligation, GOLDEN LINK LENDING INVESTOR, INC.

foreclosed the aforesaid property mortgaged by said NITA L.

CALILAN covered by the aforesaid TRANSFER CERTIFICATE OF

TITLE No. 61861 of the Registry of Deeds of Quezon City in

accordance with the provisions of Act 3135 as amended by Act 4118;

4. That GOLDEN LINK LENDING INVESTOR, INC. was declared the

highest bidder in the public auction sale of the aforesaid property,

having bidded the amount of TWO HUNDRED EIGHTY-THREE

THOUSAND FOUR HUNDRED SIXTY-TWO (P283,462.00)

PESOS, Philippine Currency, which amount was the actual amount

claimed by GOLDEN LINK LENDING INVESTOR, INC. and the

CERTIFICATE OF SALE was issued to it by the Clerk of Court and

Ex-Officio Sheriff of Regional Trial Court of Quezon City which was

subsequently registered with the Registry of Deeds of Quezon City

under Entry No. 7536 dated January 31, 2002.

 5. That the one-year period to redeem the foreclosed property had elapsed

on January 31, 2003 since the registration of the CERTIFICATE OF

SALE in favor of GOLDEN LINK LENDING INVESTOR, INC. and

NITA L. CALILAN failed to exercise her right to redeem the aforesaid

foreclosed property in accordance with the provisions granted her by

law on the matter; and

6. That this affidavit is being executed to prove the fact of the failure of

NITA L. CALILAN to redeem the said foreclosed property within one

(1) year and in order to enable the Registry of Deeds of Quezon City to

cancel TRANSFER CERTIFICATE OF TITLE No. 61861 and in lieu

thereof to issue new TRANSFER CERTIFICATE OF TITLE in the

name of the aforesaid GOLDEN LINK LENDING INVESTOR, INC.
