DRAFT FOR THE GUIDELINES ON SELECTION AND AWARDING OF SOCIALIZED


HOUSING PROJECTS OF THE MINISTRY OF HUMAN SETTLEMENTS AND
DEVELOPMENT

I. BACKGROUND

As the MHSD serves as the

II. COVERAGE

This guideline shall cover all housing development projects of MHSD from the General
Appropriations Act of Bangsamoro (GAAB) , Special Development Fund (SDF), Transitional
Impact Development Fund (TDIF), Kapayapaan sa Pamyanan (KAPYANAN); and other housing
projects given by National Housing Authority (NHA) , Department of Human Settlements and
Urban Development (DHSUD), and other NGOs to the Ministry.

III. OBJECTIVES

This guideline intends to provide standards for the implementation and awarding of housing
projects for the Bangsamoro people.

In particular, the guideline aims to:

1. Define who are qualified to receive a housing project


2. Clarify and evaluate documentary requirements.
3. Define the mechanism on awarding of housing projects and other assistance.
4. Establish a grievance and redress management system for dispute-resolution, transparency
and accountability.
5. Formulate socio-economic programs to alleviate the lives of its beneficiaries.

V. PRIORITY GROUPS

These are the classification of group where a family is considered vulnerable and may need a
housing assistance

1. Conflict-affected. Families who were displaced due to war or conflict and could not return
to their areas.
2. Struck by calamity. Those who were displaced due to typhoon, earthquake, flood or other
similar calamities wherein they permanently cannot return to their areas due to hazards
3. Relocation due to government projects. Those who were displaced because their houses
were demolished due to an implementation of government project or similar instances.
4. MILF, MNLF or other similar surrenderers. Those who were former combatants and does
not have any permanent shelter to live.
5. Poor and Homeless. Those who belong to the poor and homeless as defined by the DENR,
NHA and DHSUD.
6. Squatters. Those who live at the shorelines, riverbanks or are illegally occupying public and
private areas who does not any house to transfer with. Professional squatters shall be
disqualified from the award.

VI. QUALIFICATIONS

1. Must be a Filipino citizen [Section 16 (a), R.A. No. 7279] and residing in the Bangsamoro
Region at least six months;
2. Must not own any real property whether in the urban or rural areas [Section 16 (c), R.A. No.
7279;
3. Must not be a professional squatter or a member of squatting syndicates [Section 16 (d),
R.A. No. 7279;
4. Must not have been a beneficiary of any government housing program except on temporary
leasehold or rental arrangement [LGU’s Guidebook for Local Housing Project/Program
promulgated by the Office of the President, p. 16].
5. Must not have sold, alienated, conveyed, encumbered, or leased his lot, including
improvements or rights thereon, which was previously awarded under the socialized
housing program [Section 14, R.A. No. 7279 ;
6. Must not have availed of any housing loan from the SSS, GSIS, HDMF, or any financing
institution as a principal borrower or co-obligor [LGU’s Guidebook for Local Housing
Project/Program promulgated by the Office of the President.

7. Must not be acting as a dummy or agent or any other person [C.A. No. 108, as amended,
otherwise known as the Anti-Dummy Law].

VII. DOCUMENTARY REQUIREMENTS

1. Accomplished Housing Beneficiary Form (Annex A)


2. DSWD-DAFAC (Disaster Assistance Family Access Card) issued by the DSWD or LGU if
available
3. Barangay Certificate
4. At least one (1) government issued ID
5. Recent family picture (whole body)
6. Birth certificate of every member of the family

VIII. SELECTION MECHANISM AND PROCESS

1. COORDINATION AND INFORMATION DESSIMINATION

A. The MHSD shall establish a Board to spearhead the process.


B. The Board shall coordinate with the concerned agencies such as LGU, BLGU, NGOs and
establish a Memorandum of Agreement.
C. The Board shall conduct information dissemination on the qualifications of beneficiaries,
required documents, prohibitions and disqualifications.
D. The concerned party shall list prospective beneficiaries and collect necessary required
documents needed.

2. SUBMISSION OF DOCUMENTARY REQUIREMENTS

A. The concerned party shall submit the documentary requirements separately every
applicant in a long folder with tabbing to the Board.
B. A certificate of completed documents shall be attached in the folders. Incomplete
documents shall not be entertained.

3. PRE-QUALIFICATION ASSESSMENTS

A. The Board shall asses the applicants according to priority groups, qualifications, and
documents submitted.
B. The Board shall pass a resolution on the names of applicants, the approval of their
applications and notice of disqualification.
C. The Board shall endorse the approved applicants to the Ministry and shall coordinate to
the concerned agency for the release of approved list.

4. AWARDING OF HOUSING

A. The Board shall pass a resolution on awarding the houses to qualified applicants. If the
number of socialized housings is less than the number of the beneficiaries, the Board
shall conduct a raffle to be participated by the qualified applicants.
B. The Board shall give each awardee a certificate of Award as proof and requirement for
the Turnover of unit.

5. INSPECTION OF SITE

A. The Board shall conduct inspection prior to turnover of units together with the
concerned agencies and contractors.
B. The Board shall assist the beneficiaries to apply for water and power connection.

6. TURNOVER AND ACCEPTANCE OF SOCIALIZED HOUSING

A. The Board together with the concerned agencies, shall hold a ceremony for the turnover
of keys to the beneficiaries.

7. RECORDS AND FILING

A. The Board shall maintain a record of all awardees and their site location in a logbook
and database.
B. The Board shall also keep for its records; beneficiary profiles, documentary
requirements, notices, resolutions, endorsements and other documents which are
deemed relevant to the Board.

IX. MONITORING AND EVALUATION

1. The Board shall annually monitor the housing sites to recommend coordinate with other
agencies for further improvement and/or repairs of public places and establishments such
as roads, drainages, establishments of recreational facilities, and other similar buildings.
2. The Board shall coordinate with the awardees for them to establish a Home Owner’s
Association, and assist them with necessary requirements.
3. The Board shall conduct further study for livelihood proponents and skills trainings to the
beneficiaries.

X. PROHIBITIONS AND DISQUALIFICATIONS

1. No land for socialized housing, including improvements or rights thereon shall be sold,
alienated, conveyed, encumbered, or leases by any beneficiaries without the consent and
resolution from the Board.
2. Should the beneficiary unlawfully sell, transfer, or he/she dispose his/her lot or any right
thereon, the transaction shall be null and void. He/she shall also lose his/her right to the
land, forfeit the award and shall be barred from any benefits under the law for a period of
ten (10) years from the date of violation [Section 14, R.A. No. 7279].
3. No part of land or establishment in the site except for what is allotted to the awardee shall
be occupied by any beneficiary, member, or relative of the beneficiary without consent and
resolution from the Board.
4. The awardee shall always abide to the rules and regulations of the HOA and the Board of
this Ministry.
5. Any payments, fees, liabilities, except for HOA fees shall only be paid to the Regional Office
of the Ministry. No payments or fees shall be collected by any beneficiaries except for what
is passed in a resolution by the HOA or Board.
6. In case of death, ownership of the unit shall be transferred to his/her heirs in a resolution
passed by the Board.
7. Criminal offenses conducted by the awardee shall be a ground for withdrawal of award and
eviction from the unit.

XI. GRIEVANCES AND DISPUTE RESOLUTION

1. In case of dispute the parties shall be addresses by the HOA if possible. Otherwise, they are
directed to Land Dispute Resolution Board for amicable resolutions or proper courts.
2. No beneficiary shall be evicted or withdrawn from its unit without the passing a resolution
from the Board.

XII. MHSD HOUSING BOARD

A. Composition

B. Duties and Responsibilities

1. Supervise all matters relative to the implementation of the selection and awarding
procedures.
2. Handle the assessment of all prospective applicants.
3. Keep all records of all documents and profiles of all beneficiaries.
4. Prepare and formulate plans for the implementation and monitoring of the program.
5. Prepare contracts, certificates and other documents pertinent to the program.
6. Conduct socio-economic surveys and other related researches and studies for the
purpose of the Board’s objectives.

XIV. SEPARABILITY CLAUSE

if any provisions of the Guideline are declared invalid or unconstitutional, the other provisions
not affected thereby shall remain valid and subsisting.

XV. REPEALING CLAUSE

All other existing issuances which are inconsistent with this Guideline are hereby rescinded or
modify accordingly.

XVI. EFFECTIVITY

This Guideline shall take effect fifteen (15) days from filing thereof with the Office of National
Administrative Register (ONAR) in with Section 3 and 4, Chapter II, Book VII of Executive Order
No. 292 otherwise known as the “Administrative Code 1987”.
