AFFIDAVIT OF EXPLANATION OF VARIANCE

IN BIRTH DATE OF DECEASED IN TWO DOCUMENTS

I, YALIANG CHEN, 53 years old, Chinese citizen, with address at P-5

Poblacion Monkayo, Compostela Valley, Philippines; being sworn under oath,
hereby depose and state:

1. That I am the wife of SUNBO XU, a Chinese citizen and resident of

Compostela Valley, Philippines, who died last December 5, 2012 at Compostela
Valley Provincial Hospital, Montevista, Compostela Valley due to cardiac arrest
secondary to gunshot wound; a copy of his Death Certificate is attached as
ANNEX “A”;

2. That my husband was born in Fujian Province, People’s Republic of

China on November 24, 1959, a copy of his Passport No.G36015967 issued by
the PROC Embassy in Manila on Jan. 21, 2010 is attached as ANNEX “B”;

3. That in his Death Certificate, the birth date of my husband was written as
“December 7, 1959”; that this is a clerical error as the real birth date of my
husband was November 24, 1959;

4. It must be pointed out that “December 7, 2012” is actually the date when
the Civil Registrar of Montevista signed this Certificate of Death as shown at the
bottom of the document; that, apparently, the clerk must have erroneously
copied this date “December 7” as the birth month and day of the deceased;

5. Moreover, between the Death Certificate issued by Philippine authorities

and the Passport issued by the government of PROC, the latter document should
be controlling as: a) it is an official document issued by his government; and b) it
is based on authentic documents filed with the PROC government. The Death
Certificate, on the other hand, contained information supplied to the clerk at
Montevista, Compostela Valley by survivors of the deceased while they were
very distraught and emotional;

6. Accordingly, I respectfully submit that the difference as to the date of birth

of my husband in his death certificate and in his PROC Passport was due to error
by the clerk of Montevista due to excusable error or to wrong information
supplied him by survivors of the deceased;

7. I hereby attest that the “SUNBO XU” referred to in the Certificate of Death
issued by the Office of the Civil Registrar General dated December 7, 2012 and
who died last December 5, 2012 at Compostela Valley Provincial Hospital,
Montevista, Compostela Valley and erroneously indicated to have been born
Dec. 7, 1959; and the “SUNBO XU” who was issued Passport No.G36015967 by
the PROC Embassy in Manila on Jan. 21, 2010 and who is indicated to have
been born on November 24, 1959 refers to ONE AND THE SAME PERSON,
namely, my husband SUNBO XU;

8. The statements made herein are true to the best of my personal

knowledge and based on authentic documents.
