Importance of Land Use Planning


❑ It is a tool to guide the use and re-use of land, prevent the
abuse and non-use of land and correct the misuse of land.
❑ It is needed to optimize the use of both public and private land
and to assist in resolving possible conflicts that may arise from
competition for a share of the LGU’s limited land resource
arising from the continuous increase in population and
development requirements.
❑ Appropriate or rational land use planning that adheres to the
principles of sustainable development cause positive effects on
the social, political, economic, physical and environmental
forces.

1987 PHILIPPINE CONSTITUTION


Article XII: National Economy and Patrimony
Section 6. The use of property bears a social function, and all economic
agents shall contribute to the common good. Individuals and private groups,
including corporations, cooperatives, and similar collective organizations, shall
have the right to own, establish, and operate economic enterprises, subject to
the duty of the State to promote distributive justice and to intervene when the
common good so demands.
Article XIII: Social Justice and Human Rights
Section 1. The Congress shall give highest priority to the enactment of
measures that protect and enhance the right of all the people to human
dignity, reduce social, economic, and political inequalities, and remove cultural
inequities by equitably diffusing wealth and political power for the common
good. To this end, the State shall regulate the acquisition, ownership, use, and
disposition of property and its increments.

(c) The local government units shall, in conformity with existing laws,
continue to prepare their respective comprehensive land use plans enacted
through zoning ordinances which shall be the primary and dominant bases
for the future use of land resources;

Adopt a comprehensive land use plan for the municipality: Provided, That
the formulation, adoption, or modification of said plan shall be in
coordination with the approved provincial comprehensive land use plan;

SECTION 1. PLAN FORMULATION


(a) Cities and municipalities shall continue to formulate or update their
respective comprehensive land use plans, in conformity with the land use
planning and zoning standards and guidelines prescribed by HLURB.

SECTION 2. PLAN REVIEW AND APPROVAL


(a) Pursuant to Section 468 (a-2-vii) of LGC, the powers of the HLRB (now
DHSUD) to review and approve the comprehensive land use plans of
component cities and municipalities are hereby devolved to the province.

SECTION 3. PLAN IMPLEMENTATION
(a) The authority of the HLRB to issue locational clearances for locally significant
projects is hereby devolved to cities and municipalities with comprehensive land
use plans reviewed & approved in accordance with this Order.
Based on established national standards and priorities, HLURB shall continue
to issue locational clearances for projects considered to be of vital and national
or regional economic or environmental significance. Unless otherwise declared
by the NEDA Board, all projects shall be presumed locally-significant.

THE GUIDELINES GOVERNING SECTION 20 OF RA 7160 PRESCRIBING
OTHERWISE KNOWN AS THE LOCAL GOVERNMENT CODE OF 1991
AUTHORIZING CITIES AND MUNICIPALITIES TO RECLASSIFY AGRICULTURAL
LANDS INTO NON-AGRICULTURAL USES
(b) Agricultural lands may be reclassified in the following cases:
1. When land ceases to be economically feasible and sound for agricultural purposes as
determined by the Department of Agriculture (DA), in accordance with the standards
and guidelines prescribed for the purpose;
2. Where the land shall have substantially greater economic value for residential,
commercial, or industrial purposes as determined by the sanggunian concerned.
(c) Such reclassification shall be limited to a maximum of the percentage of total
zoned agricultural land:
15% for HUCs/ICCs
10% for Component Cities and 1st to 3rd class municipalities
5% for 4th to 6th class municipalities

Things to consider in formulating a goal:

STEP 6: ESTABLISH DEVELOPMENT THRUST AND SPATIAL STRATEGIES

Prepare the Structure Plan based on the Spatial Strategies.


The Structure Plan provides the overall framework for the preparation of the
City/Municipal Land Use Plan in Step 7.

The Structure Plan shall contain the following:


❑areas for conservation/protection such as forest areas, critical watersheds, historical/cultural sites;
❑development areas for agriculture, tourism, industry, and agro-forestry;
❑buffers surrounding or bordering areas under protection/production and development areas;
❑areas for climate resiliency adaptation measures or projects;
❑proposed major infrastructure projects;
❑overall direction of urban expansion;
❑circulation system that shows the linkage among the identified development areas within the
municipality/city, linkage of the municipality/city with the other municipalities/cities, province and
region; and
❑Targeted growth areas/nodes for production purposes or with specific development role.

If the supply is inadequate (less than the demand):
✓ Increase in use density (densification/ intensification) e.g., infilling of vacant
lots, vertical(high-rise) development, redevelopment
✓ Reclamation subject to environmental and other laws and regulations
✓ Possible conversion of developmentally constrained areas with the least
perceived negative impact and subject to appropriate mitigating measures.
If the demand is lower than the supply
✓ Reversion of lands zoned as urban uses to agricultural uses to ensure and enhance
food security

DEFINITION OF TERMS
Zoning
Zoning is the division of a city/municipality into zones or sub-zones (e.g.
commercial, residential, industrial, institutional, agricultural, forest, etc.)
according to present and potential uses of land to maximize, regulate and
direct their use and development in accordance with the CLUP.

It takes the form of a locally enacted ordinance
