This Extrajudicial Settlement and Partition with Waiver of Rights made and
entered into by and between;
ERNESTO R. HALILI, Filipino citizen, of legal age, married to MILDRED S.
HALILI, and a resident of Magsaysay, Aborlan, Palawan;
HEIRS OF ALFREDO R. HALILI, who died on March 18, 2020 in Tarlac City.
A. MARINA GUTIERREZ-HALILI widower,
B. JENNIFER G. HALILI - BALANAG, married to Clarence G. Balanag, as
represented by MARINA GUTIERREZ-HALILI (mother);
C. ALFRED GUTIERREZ HALILI, married Charity T. Halili, as represented
by MARINA GUTIERREZ-HALILI (mother);
D. MARLON GUTIERREZ HALILI, married to Jackielou L. Halili, as
represented by MARINA GUTIERREZ-HALILI (mother);
E. MICHELLE G. HALILI, separated-in-fact, as represented by MARINA

All of legal age and residents of Brgy. Suizo, Tarlac City;
HEIRS OF EDUARDO R. HALILI, who died on January 18, 2018 at Quezon City.

ELEA R. HALILI, Filipino citizen, of legal age, single, and a resident of Brgy.
Suizo, Tarlac;
AMELIA R. HALILI - NACPIL, Filipino citizen, of legal age, married to EDDIE C.
NACPIL, and a resident of Brgy. Suizo, Tarlac City;
FERNANDO R. HALILI, Filipino citizen, of legal age, married to MA. NORA B.
HALILI, and a resident of Sitio Landing, San Rafael, Tarlac City;
DOLORES R. HALILI- DIAZ, Filipino citizen, of legal age, married to
EDILBERTO C. DIAZ, JR., and a resident of Sitio Estrella, San Rafael, Tarlac City;
RENATO R. HALILI, Filipino citizen, of legal age, separated-in-fact, and a
resident of Sitio Estrella, San Rafael, Tarlac City; all herein referred to as “HEIRS”.

WITNESSETH:
That the above-named HEIRS are the surviving and lawful heirs of the late
CIRILO C. HALILI who died on January 31, 2004 in Brgy. Suizo Tarlac City and
MARTINA R. HALILI who died on August 19, 2000 in Brgy. Suizo Tarlac City;
That the deceased CIRILO C. HALILI and MARTINA R. HALILI left two (2)
undivided parcels of land situated in Brgy. Sizo, Tarlac City, more particularly described
as follows:

a portion of Lot 1771-B-4 (LRC) Psd-229399 LRC Rec No._) situated in the Barrio of
Binauganan, Municipality of Tarlac, Province of Tarlac. Bounded on the SW., along line
1-2 by lot 47; on the NW and NE., along lines 2-3-4 by Lot 82, (Irrigation Ditch-4); and
on the SE., along line 4-1 by Lot 88, (Irrigation Ditch -8); all of the subdivision plan. Xxx
Containing an area of Thirty-Three Thousand One Hundred Thirty-Four (33,134),
square meters.”

TRANSFER CERTIFICATE OF TITLE NO. 16801

“A PARCEL OF LAND (Lot 50 of the subdivision plan Psd-03029328 (OLT),
being a portion of lot 1771-B-4,(LRC) Psd- 229399 L.R.C Rec. No. _____________),
situated in the Barrio of Binauganan, Municipality of Tarlac, Province of Tarlac.
Bounded on the NW., along line 1-2 by lot 1771-B-3, (LRC) Psd-229399; on the NE.,
and SE., along lines 2 to 6 by lot 82, (Irrigation Ditch-4), of the subdivision plan; and on
SW., along line6-1 by lot 1771-B-3, (LRC) PSD- 229399. Xxx containing an area of
Three Thousand One Hundred Fifty-Two (3,152), square meters.”
That both deceased died intestate without any wills or testament as to the
disposition of their estates;
That there are no known debts or obligations due against the deceased; and
That it is to the very best interest of the legal heirs hereto to adjudicate unto
themselves the above-described property in the form and manner hereinafter set forth.

NOW THEREFORE, for and in consideration of the foregoing premises and

invoking the provision of Sec. 1 Rule 74 of the Rules of Court, the said HEIRS above
named have agreed to settle the above-described properties extrajudicially and to this
effect do hereby partition and adjudicate the same unto themselves equally, subject
however to the liabilities imposed by Sec. 4, Rule 74 of the Rules of Court for a period
of two years in favor of any other possible heirs, creditors or any other person deprived
of the lawful participation over the said property of the deceased and encumbrances;

WAIVER OF RIGHTS
a. Transfer Certificate of Title No. 16800 - containing Thirty Three Thousand One
Hundred Thirty Four (33, 134), square meters.

That I, AMELIA R. HALILI-NACPIL, hereby waive, transfer, convey, and

renounce all her rights, interest and participation to my co-heirs;

FERMIN-HALILI), ANGELO CARLO FERMIN HALILI (as represented by MA.
CORAZON FERMIN-HALILI), ELEA R. HALILI, FERNANDO R. HALILI,
DOLORES HALILI- DIAZ, and RENATO R. HALILI do hereby waive, transfer,
convey, and renounce all our rights, interest, and participation to our sister/sister-
in-law/auntie AMELIA HALILI- NACPIL in Transfer Certificate of Title No.
16801.
That we are executing this waiver and transfer with full knowledge of its import
and for legal intents and purposes it may duly serve.
