EXTRAJUDICIAL SETTLEMENT OF ESTATE AND PARTITION

WITH DEED OF ABSOLUTE SALE

KNOW ALL MEN BY THESE PRESENTS:

This EXTRAJUDICIAL SETTLEMENT OF ESTATE AND PARTITION, made and entered

into by and among:

1. DAILINDA D. FEIR, of legal age, widow, Filipino, with residence and postal
address at Zone 5, Surallah, South Cotabato, hereinafter referred to as Heir-
Vendor;

2. LORRAINE FEIR ACOSTA, of legal age, married, Filipino, with residence and
postal address at Zone 5, Surallah, South Cotabato, hereinafter referred to as
Heir-Vendor;

3. SANDRA FEIR MARCELINO, of legal age, married, Filipino, with residence and
postal address at Zone 5, Surallah, South Cotabato, hereinafter referred to as
Heir-Vendor;

4. DAIBEN FEIR ASUNCION, of legal age, married, Filipino, with residence and
postal address at Zone 5, Surallah, South Cotabato, hereinafter referred to as
Heir-Vendor;

5. CHARLEMAGNE DAYOT FEIR, of legal age, widow, Filipino, with residence

and postal address at Zone 5, Surallah, South Cotabato, hereinafter referred to
as Heir-Vendee;

WHEREAS, ON THE 14TH day of December 1984,BENJAMIN FEIR died intestate in

Zone 5, Surallah, South Cotabato, leaving their respective shares in a certain real property
described and bounded as follows:

“A parcel of land known as lot 844, Ts-1019 situated in Poblacion,

Surallah, South Cotabato. Bounded on the NE., along line 1-2 by Lot 837, Ts-
1019; on the SE., along line 2-3 by Lot 843, Ts-1019; on the SW., along line 3-
4 by Road; and on the NW., along line 4-1 by Lot 845, Ts-1019. Containing an
area of SIX HUNDRED THREE (603) square meters, more or less.”

evidenced by ORIGINAL CERTIFICATE OF TITLE NO. P-27925 issued in the name of

DAILINDA DAYOT by the Register of Deeds of South Cotabato.

WHEREAS, DAILINDA D. FEIR, LORRAINE FEIR ACOSTA, SANDRA FEIR MARCELINO,

DAIBEN FEIR ASUNCION, and CHARLEMAGNE DAYOT FEIR are the legitimate surviving
spouse and issues of the decedent;

WHEREAS, no personal properties are involved in this extra-judicial settlement and

partition with deed of sale;

WHEREAS, there are no known debts or obligations due against the estate of said
decedent;

NOW THEREFORE, for and in consideration of the premises and invoking the
provisions of Rule 74 Section 1 of the Rules of Court the parties hereto do by these presents
agree to divide and partition the entire estate above-described adjudicating, setting, ceding
and waiving whatever rights they have to effect this partition as they do hereby adjudicate
the same and among themselves in pro-indiviso equal share for each Heir as we hereby
partition and adjudicate the same and among ourselves in pro-indiviso equal share for each
Heir, as follows:

 “A parcel of land known as lot 844, Ts-1019 situated in Poblacion,
Surallah, South Cotabato. Bounded on the NE., along line 1-2 by Lot 837, Ts-
1019; on the SE., along line 2-3 by Lot 843, Ts-1019; on the SW., along line 3-
4 by Road; and on the NW., along line 4-1 by Lot 845, Ts-1019. Containing an
area of SIX HUNDRED THREE (603) square meters, more or less.”

THAT, WE, DAILINDA D. FEIR, LORRAINE FEIR ACOSTA, SANDRA FEIR

MARCELINO, DAIBEN FEIR ASUNCION, for and in consideration of the sum of THREE
HUNDRED THOUSAND PESOS (Php 300,000.00) Philippine Currency, to us in hand paid
by CHARLEMAGNE DAYOT FEIR, receipt of the full sum is acknowledged to our entire
and complete satisfaction, do by these presents hereby CEDE, SELL, CONVEY and
TRANSFER absolutely unto the said CHARLEMAGNE DAYOT FEIR, his heirs, successors
and assigns, all our rights to, interest in and ownership of the aforementioned parcel of
land and all the improvements thereon consisting of an old house valued at P
300,000.00.

IN WITNESS WHEREOF, the parties have hereunto set their hands this
