In the reference 1st cited, an application was submitted to the Board seeking Consent
for Establishment (CFE) for EXPANSION to produce the following products with
installed capacities as mentioned below, with project cost of Rs.180.0 Lakhs.

** There is no increase in the production capacity under expansion. The industry
proposed to manufacture Alpha Olefin Sulphonate (AOS) and Sodium Lauryl Ether
Sulphate in powder form also as per the customer requirement.

The EE, RO: Nellore, vide reference 2nd cited, submitted a report in this regard.

The EE, RO : Nellore vide reference 4th cited informed that the industry has paid balance
CFE fee of Rs.53,200/-.

The issue was placed before the CFE Committee meeting held on 05.10.2021. The
Committee noted the following:

a) M/s Ultramarine & Pigments Ltd is manufacturing synthetic organic chemicals


product at Plot no 60 &61 ,Block-C, APIIC Industrial Estate, Menakur (V),
Naidupeta(M),SPSR Nellore District in an extent of 7.6Ha (76035 sq m).

b) The industry obtained CFE order dt. 21.06.2018 of capacity 120 tons/day with a
project cost of Rs.80 crores.

c) While issuing above order, the Board has stipulated a condition that: "The Synthetic
Organic Chemical manufacturing units are not permissible in the Industrial Park as
per CFE order dt. 06.09.2017 issued to APIIC by the APPCB. Hence, the proponent
shall as certain from the MoEF&CC, GoI before starting construction whether the
proposed project is permitted in the Industrial Park and submit a copy of the
confirmation obtained from MoEF&CC, GoI to the RO: Nellore”.

d) Accordingly, the industry obtained Environmental Clearance from SEIAA, AP on


24.01.2019 for manufacture of Surfactants - 40,000 MTA (Phase-I). Subsequently,
the SEIAA, AP has issued amendment of EC order on 25.11.2019, for restriction of
land area to 9.95 Ac and for change in boiler fuel from furnace oil to LPG/LNG for
Phase –I at Plot No. 59A, 60 & 61, Block-C, APIIC Industrial Estate, Menakur (V).

e) The industry constructed and erected machinery at Plot No. 60 & 61 to manufacture
Surfactants. The industry has allocated vacant site at Plot No. 60 &61 for future
expansion under phase II.

f) The Board has issued CFO & HW Authorization on 31.12.2020 for manufacture of
Surfactants – ( Linear Alkyl Benzene Sulphonic Acid / Alpha Olefin Sulphonate 100%
/ Sodium Lauryl Ether Sulphate 100% / Sodium Lauryl Sulphate100 %) – 40,000
MTA (or) 120 Tons/day (Phase-I) at Plot No:60 & 61 which is valid upto 30.06.2025.

g) The industry further obtained EC from SEIAA,AP for the phase –II project vide EC
order dt 22.08.2020 for manufacture of Specialty chemicals/ Ingredients -5000
MTPA, In- organic Pigments-12500 MTPA, Coke & Coal or LPG/LNG for process-
6075 MTPA,SKO-20 MTPA at Plot no 59A,60 &61 ,Block-C, APIIC Industrial Estate
,Menakur (V).

h) The representative of the industry has informed that they acquired three plots
from APIIC i.e.59A (10 Ac), 60( 9 Ac) &61 (9.76 Ac) for the establishment of the
proposed industry to manufacture Surfactants and In- organic Pigments in phased
manner. Accordingly obtained EC for Phase I & Phase-II in the name of M/s.
Ultramarine & Pigments Ltd.

i) As per the new Central Government revised industrial MSME policy 2019,the
management has split / bifurcated the industry as M/s. Ultramarine & Pigments Ltd.,
and M/s Ultra Marine Specialty Chemicals Ltd under 100 % subsidiary of M/s
Ultramarine & Pigments Ltd., and the details of the land allocated to the Two
industries are mentioned below.

Thus, the area of land M/s. Ultramarine and Pigments Ltd, Plot No.60 & 61 is 6.8 acres +
7.36 acres = 14.16 acres and the area of land of M/s. Ultramarine Speciality Chemicals is
14.59 acres. But, it is not clear about allocation of remaining area of 10 acres in Plot no.59A.

j) M/s. Ultramarine & Pigments Ltd has applied for CFE (expansion ) for installation of
spray drier of 600 Kgs/Hr with Hot air generator of 8.0 Lakh K.Cal /hr in the existing
industry premises of M/s. Ultramarine & Pigments Ltd located at Plot o:60 (P)&
61(P), Block-C, APIIC Industrial Estate, Menakur (V), Naidupeta (M), SPSR Nellore
Dist.

k) M/s Ultra Marine specialty chemicals Ltd also applied for CFE to manufacture In-
organic Pigments (Complex inorganic colored pigments-2500 MTA & Inorganic
pigments -10,000 MTA) at Plot No:59A,60 (P)& 61(P), Block-C, APIIC Industrial
Estate, Menakur (V), Naidupeta (M), SPSR Nellore District, separately.

l) M/s. Ultramarine & Pigments Ltd proposes to manufacture Alpha Olefin Sulphonate
(AOS) and Sodium Lauryl Ether Sulphate in powder form for which the Board has
already issued CFE &CFO.

m) The AOS & Sodium Lauryl Ether Sulphate converted into powder form by sending
through a spray direr. The industry is proposed to install a Hot air generator of 8.0
Lakh K.Cal /Hr for hot air. There is no additional water usage for the conversion. The
industry proposes to use LPG/LNG as fuel for the hot air generator hence there is no
solid waste generation.

n) The RO: Nellore recommended the following:

 During inspection, the industry submitted that they have proposed drier in EIA, while
obtaining the Environmental Clearance (EC) from MoEF&CC, but not included in the
CFE application. Hence, the industry applied for CFE ( expansion) to establish drier
of 600 kg/hr capacity.

 The industry need to obtain EC amendment for change of area of industry from 9.95
acres to 14.16 acres.

 The industry proposes to use LPG/LNG as fuel for the hot air generator attached to
the drier. However, the industry is required to provide scrubber to the event of the
spray dryer to control process emissions if any.
 The CFE (expansion) for installation of spray drier may be considered with the
following additional conditions.

 The industry shall provide scrubber to the spray drier to control process
emissions.

 The industry shall obtain EC amendment for change of area from 9.95 acres to
14.16 acres.

 The industry shall clarify how the remaining area of 10 acres in Plot no.59A,
will be used / or what purpose it would be allocated.

 As per the EC order dt.24.01.2019, the industry is to be located in Plot nos.60


& 61. Whereas in the CFE application the Plot nos. were mentioned as 60(P)
and 61(P). This required clarification (or) EC order may be amended.

 The industry is required to submit a site layout plant indicating the units i.e.,
M/s.Ultramarine and Pigments Ltd., M/s Ultra Marine Specialty Chemicals Ltd.,
and vacant land of 10 acres.

The representatives of the proponent attended the meeting through video conference.

After detailed discussions, the Committee recommended to issue CFE (Exp) for
installation of Spray Drier after receipt of clarification / commitment from the industry
on the points raised in the agenda.

This was communicated to you vide reference 5th cited. But, no reply is received so far.

In view of the above, it is once again requested to submit the above clarification /
commitment on the points raised in the agenda to issue CFE (exp) for installation of
spray drier.

It is also to inform that construction of the project without obtaining CFE / manufacturing un-
consented products would be violation of Sections 25/26 of the Water (Prevention and
Control of Pollution) Act, 1981 and Amendments thereof, which attracts action under various
provisions of the said Acts.
