SCOPE OF WORK

EXPLANATORY NOTES TO THE SCHEDULE

SCHEDULE A
PART A
ITEM No.1
The price includes operation and troubleshooting of DG Sets in working Power Cars with Train
No. 22415/16 from Visakhapatnam to New Delhi Station and back with two skilled staff in the EOG
rakes. 01 No. of skilled staff shall be deputed in each power car.
i) Appearance in prescribed uniform with badge fixed on it for easy identification by the travelling
public.
ii) Appearance of Two and half hour before the scheduled departure of the train.
iii) Keeping the Power Car properly cleaned at regular interval by personally dusting the same.
iv) Bringing in operation of the engine(s) [As per the advice of the Rake In-charge] for pre-cooling
the coaches at least one hour before commencement of the journey.
v) Taking all readings of Power panel and diesel engine parameters in every hour and recorded in
the logbook.
vi) The faults if any, occurred in Power Cars during running of the train shall be rectified promptly.
vii) Using Fire extinguisher in case of need.
viii) The Power Car accompanied staff working in the trains shall be under the control of Electrical
Supervisor / Sr.Technician on duty and they shall follow the instruction from him. Contractor
shall comply with all safety rules, Industrial and Labor Regulations and Regulations and
Railway will not be responsible for any injury caused to contractors men during performing
duties or in case of their negligence during working. It shall be sole responsibility of the
contractor to get their employees covered under security insurance at their own expenses.
ix) Necessary photo Identity to the contractor staffs shall be issued by the contractor duly signed.
Necessary free travel authority on duty shall be issued by the concerned AC depot in charge to
the staff booked on train.
The contractor’s staff shall declare money accompanied with them to Electrical Supervisor /
Sr.Tech. & a joint signature of both shall be made in the register (A separate register is to be
maintained for the purpose).
x) As soon as the staff performing the job of escorting is aware of any fire incidence in the Power
Cars / coaches, during the train in service, he will take necessary action along with the
intimation to the Electrical Supervisor / Sr.Technician.

JOB LIST FOR ESCORTING STAFF(SKILLED) OF POWER CAR:


For each trip from originating station to destination station & back to originating station, proper
round trip Performa must be filled and maintained. The round trip Performa contains various
readings stated as under: -
a) DA Set-A Running frequency (Hz), Volt, Ampere, Kilo Watt (kW)
b) Ventilation Fan for DA set-A
c) DA Set-B Running frequency (Hz), Volt, Ampere, Kilo Watt (kW)
d) Ventilation Fan for DA set-B
e) Battery – Volt & Ampere
f) Panel Roof Temperature
g) DA Set-A Lube Oil Pressure, Temperature, Water Temperature & RPM
h) DA Set-B Lube Oil Pressure, Temperature, Water Temperature & RPM
i) Feeder Distribution Set-A & Set-B
j) Alternator Set-A Maximum Load, Average Load, Unit (KWH), Total Unit & Power Factor
k) Alternator Set-B Maximum Load, Average Load, Unit (KWH), Total Unit & Power Factor
l) DA Set-A & Set-B: Started at (Running Hrs. & Time), Stopped at (Running Hrs. & Time),
Working Hrs. (Test & Service), Last Running Hours & Total Running Hrs.
m) Diesel Engine – Stock Balance, Last Balance, Refilling, Consumed & Refilling at Out-station
n) Hourly reading must be recorded in the log book for the power car in service from
originating station to destination station & back to originating station.

UNIFORM : The contractor’s staff shall be duly uniformed and shall at all times duly sport a badge
(in Hindi & English) as prescribed by Railway. The uniform shall be duly washed and ironed on
every round trip and the badge be polished. The uniform shall comprise of a shirt and trousers of
colour approved by Railways made up of a blended fabric and leather shoes

QUALIFICATION OF CONTRACTOR’S STAFF:-
• ITI pass / Diploma holder in any discipline, preferably having experience of carried out
similar type of job.
• Age should not be less than 18 years and not be more than 60 years.
• On duty staff should be healthy & normal eyesight (with/without spectacles). He should
neither be with any contagious / infectious disease nor be physically handicapped.
• On duty staff should be able to speak / write in English and Hindi.
• Copy of the Police verification certificate, issued by competent authority within last six
months from the date of reporting of the staff on duty.
• The contractor should submit the medical check-up report every year for the staff engaged
and at the beginning.

The scope includes A check( Trip maintenance), B check and C check of 500kVA power car
Diesel engines as per OEM recommendations as mentioned below and may be suitably change if
the OEM issue any changes. The recommendations of OEM shall be final. The cost includes labour
charges for replacement of all must change items (B check and C check kits) including the items
specified in Annexure I and II as per requirement.

MAINTENANCE SCHEDULES OF DIESEL ENGINES FOR CUMMINS MAKE


Cummins Diesel Engine Maintenance Activities Periodicity is as follows:

A Check (After every TRIP)


i) Check all Engine safeties for their proper functioning. Replace, if found defective
ii) Check condition of coupling nut bolts and their tightness. Attend them, if required
iii) Check vacuum indicator and clean air cleaner element at 4.22 kg/cm2 (60 PSI) air
pressure, Check air restriction and ensure that it does not exceed 635 mm (25”) of water
column.
iv) Check lube oil level and condition of lube oil. See reason of less oil and top up/refill, if
required
v) Check governor oil level. Top up/refill, if required
vi) Check leakage of fuel, lubricating oil and coolant. Attend, if required
vii) Check all hoses, pipes for any leakage. Arrest all leakages immediately to make

viii) Check and ensure proper condition of safety nut bolts of fuel tank.
ix) Check and clean engine & its oil tray to make it free from any oil traces & dust
x) Drain water from fuel water separator through drain valve
xi) Check and ensure proper condition of mounting bolts and various vibration dampers/
anti vibration pads etc.
xii) Check and ensure proper cleaning of floor, wall etc in engine room.

B Check (After every 300 Hrs of running)


Carry out B- Check after 300 running hrs for M/s Cummins make Diesel Engine which shall
include all works mentioned above in A check schedule that must be carried out in addition to
carrying out following additional works during B- check of diesel engine:
a) Air system
i) Check condition of element for chocking/ torn sealing and attend same,
ii) Check and ensure proper condition of Pre-Cleaner,
iii) Check and change Air cleaner element if required,
iv) Check and ensure proper condition of air hose,
v) Check and clean breather and
vi) Inspect exhaust line and rectify leakage, if any.

b) Fuel system
i) Change fuel filter,
ii) Check hose condition: fuel supply & drain line,
iii) Check & clean the tank and Non Return Valve and attend the same, if required
iv) Inspect fuel system and attend same, if required.

iii) Change super by pass filters,
iv) Check Lube Oil Pressure (LOP) Gauge,
v) Check Lube Oil Temperature (LOT) Gauge,
vi) Check the filter for any metal particles due to wear and tear of any part inside engine,
vii) Change Governor oil
d) Cooling System:
i) Check and ensure proper coolant Ph value,
ii) Check and ensure proper coolant concentration,
iii) Check and ensure proper Cleaning of Breather,
iv) Check and ensure proper Water Temp. Gauge and
v) Check and ensure proper Radiator inlet & out let water temperature difference. If found
less, then radiator should be cleaned with OGR & ID-27.

i) Replacement of air filter (inner & outer).
ii) Replacement of tappet cover gasket.
iii) Proper tappet setting.
iv) Check and ensure proper condition of Alternator terminal connection.
v) Clean trench by compressed air without disturbing cable dressing.
vi) Check and ensure proper condition of accessories drive, Turbo charger and crankshaft end
play.
vii) Check and ensure proper Greasing of Alternator.
viii) Take blow by on full load as per manufacturer’s guidelines on conditional basis.
ix) Check and ensure proper setting of injector.
x) Check and ensure proper cleaning of turbo charger’s compressor wheel & diffuser.
xi) Carry out BORESCOPIC (if required) inspection to check condition of cylinder components.

If any deficiency is noticed it shall be reported to concerned site in charge and in case
the material required for replacement is not covered in the scope of the contract i.e. in
Annexure-I, II & III will be arranged by the Railways after certification of officer in
charge.

RESPONSIBILITIES

Following are the responsibilities of Railways and the Contractor:

RAILWAY
The Railway shall provide the following

The Contractor shall be allowed to use the Railway Telephone (non DOT), free of cost.

The working Staff/Service Engineer of the Contractor should carry necessary I-Cards for their entry
on the Platform and other Railway premises.

On advice of the respective controlling divisional officer or nominated officer for supervision of the
work, the DG Sets of Power Car shall be attended by the contractor at the Platform/Washing
Line/Coaching Maintenance Depot or the place earmarked separately for the above activity.

The Service Engineer(s) of the Contractor shall attend the Coach as and when required on either
written memo or telephonic request is served to him/them for replacement/ repairs of any
equipment/component. They shall, therefore, be permitted to enter in to the Power Cars without
hindrance on production of Identity Card.

The Railway shall maintain the details of the Power Cars (stating the Coach numbers) covered
under the subject Comprehensive Maintenance Contract for the reference of Railway and the
Contractor.

The Railway shall maintain the equipments / components details replaced coach number wise and
equipments / components serial number wise under this contract alone with the date of fitment.
The nominated supervisor shall keep the register / records for the previous bill paid for each Power
Car to avoid duplicity of payment at any time. The entire depot in charge shall work done register
up to date.

The Railway will make the Power Cars available for corrective maintenance work during the period
of the Contract as well as during the extended period of the Contract, if any.

In the event of failure of the Power Cars at Station other than Base Coaching Maintenance Depot
of the Power Car, the intimation from any of the Railway Official concerned will be given to the
Contractor to their nearest Regional Office who shall be able to attend the Breakdown call. The
Certificate of such maintenance shall, however, be issued by the Divisional Railway Officer of the
Railway where the breakdown has occurred under intimation to the base Coaching Maintenance
Depot of the Coach. The normal corrective maintenance of such Power Cars shall, however, be at
the nominated Base Coaching Maintenance Depot as indicated.

CONTRACTOR
The Contractor shall attend the Power Car on arrival of the train after the trip at the Base Coaching
Maintenance Depot. This shall be the responsibility of the Contractor to locate the Power Car at the
Base Coaching Maintenance Depot, on arrival of the train after the trip.

The Contractor shall keep all the necessary Tools, Testing Equipment, Spare Parts, Sub-
assemblies, Consumables and components/equipment in ready stock at the Coaching Maintenance
Depot or at their Office/Godown as per the actual schedule of work enclosed with the tender paper
so that there is no delay in attending the faults.

The Contractor shall conduct final acceptance test, if found necessary, by creating the artificial load
conditions. The Equipment, required for artificial loading, shall be arranged and maintained by the
Contractor in working condition at all times.

All the works including checks shall be carried out on the stable conditions at the Platform/Washing
Line/base Coaching Maintenance Depot.

The repair of the Equipment shall be carried out at the Platform/Washing Line/Base Coaching
Maintenance Depot or within 20 Kms. of the specified Railway Station/ Washing Line/base
Coaching Maintenance Depot.

The nominated Service Engineer or the Staff for Station duty shall observe all safety and security
rules prevailing at the place of the work.

The time for repair/replacement of components/ equipment will start from the time of reporting
the fault/call by Railway.

The contractor shall have to make full infrastructural arrangement (deployment of staff, making
arrangement for tools, testing equipment, spare parts, sub-assemblies, consumables and
components/equipment) for carrying out the maintenance work within 15(Fifteen) days from the
date of receipt of the formal Letter of Acceptance from the Railway.

All supply items, on demand (based on the actual anticipated consumption) by the nominated
officer for the supervision of the work, will be supplied by the contractor to the concerned depot in-
charge after duly inspected by authorized representative, as nominated by the nominated officer
for supervision of the work/controlling divisional officer, as per the extant procedure with proper
challan.

In case the base Coaching Maintenance Depot of the Power Cars is shifted to some other location
or any additional Coaching Maintenance Depot has come in operation after the award of the
Contract, other than those specified earlier, the Contractor shall be bound to maintain those Power
Cars also which were being maintained previously at the previous/old base Coaching Maintenance
Depot. However, Railway will advise the Contractor of such change of base Coaching Maintenance
Depot of the Power Cars, in writing.

RECOVERY CLAUSE:

The cost of the damage pilferage, if any caused by contractor’s staff to the Railway
property shall be recovered from the contractor’s bills. In case the staff desert the coach or
absconds the duty before conclusion of the round trip, the entire amount for the no. of staff so
deserting for the entire round trip at double the rate shall be recovered from the contractor’s bills.

PENALTY CLAUSE:-
a) Damages on account of delay in attention
The following time schedule for the said maintenance has been provided:

i) Breakdown Attention
Any delay in turning up of competent Contractor staff for attending failures of Engines will
affect the running of the Train and cause loss of revenue to the Railway. Therefore, the
Railway shall recover from the Contractor as agreed damages and not by way of penalty but a
token sum of Rs. 500 per Hour for every delay beyond 1 (One) hour or part thereof in
attending the Break down calls. If the failure of the respective engine could not be rectified by
the Contractor staff before departure of the train, the same staff has to move with the train as
per the need.

b) Damages on Account of failure of component of DG Sets during running of the Train.


i) Due to failure of any supply part of the firm within 6 months from the date of supply, a
penalty @10% of the cost of the part supplied will be deducted from the firm’s bill.
ii) Due to failure of any repaired material of the firm within 6 months from the date of fitment
of the repaired item, full repaired cost of the part repaired will be deducted from the firm’s
bill.
iii) If an incidence of total failure of an engine occurs enroute and the same could not be
rectified to put the engine in service again enroute, a lump sum penalty of ` 25,000/- will
be deducted after carrying out joint inspection by Railway representative & firm’s
representative.
Train running time is the major Parameter in the above failure. In the event of each
such incidence, which is solely attributed to the failure / malfunctioning of any components of
the DG set of the Power Car (which shall be decided by the joint inspection conducted by the
representative of the Railway and Contractor), the Railway shall recover from the Contractor
as agreed damages and not by way of penalty, a sum of ` 5,000 (Rupees five thousand) for
each such incidence.

c) The decision of the Sr. Divisional Electrical Engineer of the Railway will be final and binding
regarding the fact that whether failure of engine is solely due to failure of equipment of the DG
sets of Power Car and no other reason what so ever or not.
Failures due to external circumstances such as fire, accident, explosion, flood, thefts and other
acts of God are not covered under this Contract.

d) (i) In case contractor’s staff does not turn up to escorting duty, an amount at double the rate
per trip per power car shall be recovered from the contractor’s bills as a token penalty for
the default so committed.
(ii) In case Contractor’s staff does not turn up on duty two and half hour before, a token
penalty shall be recovered from the contractor’s bills @ ` 500/-per head per half an hour
upto one hour before schedule departure. Reporting before one hour of schedule
departure will be treated as non-turning up on duty.
(iii) In case Contractor’s staff does not turn up on periodic maintenance duties an amount of
`1500/- per skilled staff and ` 1100/- per un-skilled staff, a token penalty shall be
recovered from the contractor’s bills.
(iv) Further if the Contractor’s staff is found without uniform and/or badges a token penalty of
` 500/-per head per trip shall be recovered from the contractor’s bills.

ADDRESS AND PHONE NO. OF THE CONTRACTOR:- Contractor shall furnish present address
with phone no. and a cell phone no. and involved in case of any change immediately.

PAYMENT TERMS: Payment for the work shall be made quarterly. A Measurement book shall be
maintained by the concerned Railway Depot in charge for certifying the bill of the contractors. A
Register covering details of hours of the train and no. of attendants provided by the contractor and
Railway authority.

STAY AT DESTINATION STATION/OUT-STATION/ORIGINATING STATION:- The


arrangement for the stay of contractor’s staff shall be made by the contractor at his own cost &
means at the destination/out/originating stations. No space, electricity or water shall be provided
to the contractor’s staff during their stay as such.

SPECIAL CONDITIONS OF CONTRACT

1. All safety precautions shall be taken to prevent accident while executing the work either to his
workmen or the public. No compensation towards any accident / death will be paid by the
Railways.

2. While executing the works, any damages made to existing Railway structures etc. should be
made good by the contractor at his own cost.

3. The contractor should bring their own tools and other equipment required for execution of the
work.

4. The contractor shall make his own security arrangements till the work is handed over to the
Railways of his own cost. Only storage space can be offered as per the convenience of
Railways.

5. The work shall be executed strictly as per the direction of the Sr.DEE/G/WAT or his authorized
representative as per instructions received from HQ/Railway Board/RDSO/CAMTECH/OEMs
Divisional level etc. during the currency of contract.

6. After completion of the work it shall be certified by the authorized representative of the
Sr.DEE/G/WAT and it should be full satisfaction of the Sr.DEE/G/WAT or his authorized
representative.

7. The contractor shall contact the Sr.DEE/G/WAT or his authorized representative for any
clarification/ disputes. However, the decision of Railways is final.

8. The names of the workmen with proper identification cards shall be produced to Sr.DEE/G/WAT
or his authorized representative when demanded besides the list is produced before
commencement of the work.

9. Contractor has to submit license of the Contract Labour (Regulation & Abolition) Act, 1970 as
and when Railway demanded as applicable.

10. General condition of contract and its amendments time to time will be applicable in the
contract.

SPECIAL TERMS AND CONDITIONS

1. Conditions of Contract:
Since the work coming within the purview of the contract shall be governed by the terms &
conditions included in the tender papers as modified or amended by the letter of acceptance
of tender & IR’s standard condition of contract, 2001 (Vol-II) regulations & instructions for
Tenders and standard forms of contract (latest) as corrected upto date.

2. WAGES TO LABOUR:
(i) The contractor shall be responsible to ensure the compliance with the provision of the
Minimum wages Act-1948 to the staff engaged by him
The contractor should comply all the statutory requirements like EPF and ESIC to the staff
engaged.
(ii) The contractor shall comply with all the legal provisions pertaining to industrial labour
and hours of employment regulations in force. The wages to be paid to the contractor’s
staff shall necessarily be in accordance with the provisions of the Minimum Wages Act as
amended from time to time. The risk to the life in limb of the contractor staff shall be
covered by the contractor by way of insurance policy. Compensation to the contractor’s
staff in case of accidents or otherwise shall be made by the contractor only. Further, it is
the responsibility of the contractor to ensure that the provisions of the contract labour
(Regulation & abolition) Act / rule are not violated. The contractor should also follow all
rules & regulations of Child labour act / law and same are not violated.

3. Minimum Wages Act, Labour Laws.


3.1 In connection with payment of wages, PF and ESI to the manpower engaged to be followed
the provisions made in the Minimum Wages Act 1923, Contract Labour (Regulation &
Abolition) Act 1971, ESI Act 1948 & EPF Act 1952 with the latest amendments.
3.2 The Contractor shall comply with the provisions of the Contract Labour (Regulation &
Abolition) Act, 1970 and the Contract Labour (Regulation & Abolition) Central Rules, 1971
as modified from time to time, wherever applicable and shall also indemnify the Railway
from the against any claims under the aforesaid Act and the Rules.
3.3 The wages to be paid to the contractor staff shall necessarily be in accordance with the
provisions of the MINIMUM WAGES ACT as amended from time to time. The risk to the life
and limb of the staff shall be covered by the contract or by way of an insurance policy.
Compensation to the staff in case of accidents or otherwise shall be made by the contractor.
Contractor shall comply with all safety rules, industrial and labour regulations and Railway
will not be responsible for any injury caused to contractors’ men during performing duties or
in case of their negligence during working. It shall be the sole responsibility of contractor to
get their employees covered under State Insurance at their own expenses.
3.4 Contractor shall keep a register for payment of wages once in a month and such payment
shall be made through bank account of the employee duly furnishing the details of bank
account, name of the bank & branch to which the wages have been credited shall be
furnished to the SSE/ELG concerned for record.
3.5 The contractor shall obtain a valid labour License under the aforesaid act as modified from
time to time before the commencement of the work and continue to have a valid License
until the completion of the work. The valid License, issued concerned state Government,
shall be submitted by the successful tenderer before signing of the agreement. Any failure
to fulfil this requirement shall attract the panel provisions of the contract arising out of the
resultant non-execution of the work.
3.6 The minimum wages to be given to the contractor staff shall be as per the provisions of the
Minimum Wages Act of the Government of India.

3.7 The contractor shall comply:
a) All the laws including Railway Act, regulations and existing rules by laws made by
local/central Govt. authorities regarding compliance to minimum wages Act child labour
protection Act etc.
b) If contractor/agent/labour/staff meets with any injury or loss or death due to any
reason during the course of their work mentioned in the contract, the Railway will not
be liable for the same.
d) The staff engaged by the contractor for performing the duties shall be staff of the
contractor only and they may in no way what so ever claim to be employees of the
Railways. If the Railway is liable to pay claim to the labour on any ground the
contractor will indemnify the Railway Administration for the same.
e) Contractor will indemnify the Railway administration for loss and damages suffered in
the violation of any provision of the contract labour (Regulation and abolition) Act.
f) Staff engaged by the contractor for the purpose of performing pump
escorting/maintenance duties shall be staff of the contractor only and Railway
administration shall not at all be concerned with the employment or other service
related issues of these labours.
g) The contractor shall abide rules and regulations of the Railways and in case of any
irregularities he shall be liable to pay the fines imposed by the Railway administration.
h) Contractor will ensure periodical payment to the staff.
i) Contractor should have all the staff insured. Deduction of PF, ESI, etc. from the salary
of staff and submission of certificates to the appropriate authority will be contractor’s
responsibility.
j) In case of train accidents to staff will not have any claims what so ever on the Railway.

3.8 The Tenderer shall adhere to the laid down provisions under:
i) Payment of wages act 1936 (amended version)
ii) Minimum wages act 1948 (amended version) & notification of Ministry of Labour dt.16th
March ‘2012 (as and when revised).
iii) EPF and misc. Provisions Act. 1952.
iv) ESI Act, 1948 (applicable to establishment / factories).
v) Contract labour (Regulation and abolition) Act 1970 & Contract labour (Regulation &
Abolition) Central rules ‘1971.

3.9 The tenderer should comply all the statutory requirements like EPF and ESIC to the staff
engaged.
3.10 Payment to labours by the contractor must be made directly through their Bank Accounts
and not by cash.
3.11 While placing the bill for payment, the contractor has to submit photocopy of the bank
statement showing that payments to labours have been made directly to bank accounts.
3.12 In all work contracts, for payment of wages the wage period is to be not less than a week
and normally taken as one month and the contractor shall be duty bound to pay the wages
before 7th of subsequent month.

4. CONSIGNEE: Sr.Section Engineer/ELG/AC/VSKP.

5. PAYMENT TERMS:
100 % payment will be made on quarterly basis after completion of work as per schedules
duly accepted by the consignee. Bills in quadruplicate complete in all respects together with
other relevant documents shall be submitted to the Sr.Divisional Electrical Engineer(G).
Bills, after being passed by Sr.DEE(G) will be forwarded to Sr.DFM for payment to the
contractor.
1. Payment for operation & trouble shooting of Diesel Generators in two Power Cars during
train service is to be made as per log book maintained for each Power Car.
2. Payment for maintenance is to be made as per maintenance registers maintained by the
depot in-charge viz. Trip attention(D1-check), B-check, C-check, D2-check & D3-check
individually.

3. Whenever a foreign Power Car enters the fleet of WAT Division these Power Cars should be
provided with periodical attention and payment will be made on Pro rata Basis after due
verification of no contractual payment for maintenance against these Power Cars at the
foreign Rly/Division/Depot during that period .
4. If any Power Car will be in service for a part of a month, the payment for trip attention
shall be made on Pro Rata basis for that month.
5. The bill shall clearly indicate the Power Car number escorted/maintained under this
contract and also details of various spares etc., which have been repaired / replaced
should be mentioned in the bill.
6. Concerned depot In-charge shall certify the claim of the Contractor for the work done.
These bills duly counter signed by DEE(G)/ADEE(G) shall be submitted to the Sr.DEE(G)
who shall in turn will scrutinize the same and submit to the paying authority viz.
Sr.DFM/WAT.

The certificates on the bill shall be.


a) Certified that the 20% check conducted against the work undertaken by me and found
satisfactory (this should be done by concerned DEE/ADEE)
b) Certified that the activities done during the contract period as per schedule & scope of
work.
c) Certified that the no items have been bypassed by the Contractor during the
trip/Regular attentions.
d) Certified that the Maintenance activity is done as per OEM schedule & ALL THE MUST
CHANGE ITEMS if any have been replaced by the Contractor during the periodical
attentions.
e) Certified that the materials have been correctly received in good condition and found
satisfactorily and accounted vide DMTR No.______ dt.______.
f) Certified that the released materials during the execution of the work by the contractor
labour have been accounted for vide DMTR No.__________ dt. ________ (for items in
Sch-A & B).
g) Certified that the recoveries / no recoveries as per the Penalty Clause in the Chapter
Scope of Work.
h) Certified that all the material used for repair / replacement is as per RDSO/OEM
approved make.
i) Certified that contractor has submitted proof of Delivery Challan and Invoice for repair /
purchase of material used during maintenance.
j) The items provided in Sch-A & B are to be executed after a joint survey is conducted
by Railway representative and firm and approval of ADEE(G)/DEE(G) and duly
countersigned by the Controlling Officer.
Note:
i) The Depot In-charge shall keep the register / record for the previous bills paid for each
Power Car to avoid duplicity of the payment at any time.
ii) The cost of penalty if any shall be recovered from the contractor’s on hand bill.
iii) Any additional taxes, surcharges on taxes, duties, levies etc. imposed by Central
Government, State Government and/or local bodies or any deduction like work Contract
tax etc., during the currency of the Contract shall be borne by the contractor.

6. OFFER:
6.1 The rates to be quoted shall be inclusive of all charges such as wages, EPF, ESI, etc., safety
equipments, tools & tackles etc., and all taxes any other incidental charges leviable by
State Government / Central Government and other local bodies.

7. Staff Matters:
7.1 The contractor shall employ qualified staff to carry out the operation and maintenance of
Power Cars.
7.2 The tenderer will furnish the list of staff deputed by them for the work and the list will be
updated as and when changes of staff will take place. It will be the responsibility of the
tenderer to engage staff with good antecedents and clear Police record. The list of all staff
engaged by the contractor should be available by the contractor, at Sr.DEE/G/VSKP’s office
and Incharge of respective units.

7.3 The contractor shall arrange Identity cards for each staff. The Identity card issued by the
contractor having details such as Name, Address, Contact No., Photo, Blood groop etc. The
contractors name, Address and contact Number shall also be printed on the back side of the
Identity card. The cost of providing Identity cards with photo will be borne by the
contractor. Thereafter any change of staff shall have to be notified to the department
immediately. But it is to be ensured that the replaced staff shall also posses same
qualification as that of outgoing staff.
7.4 The staff employed by the contractor shall be got familiarized with the working of Power Car
equipment.
7.5 The employed staff shall have good working knowledge of various D.G.Sets with associated
equipment, safe working practices and conversant with IE rules etc.
7.6 The Railway is no way responsible for any loss / damage caused by accident etc., to the
staff / labour engaged by the contractor during the period of execution of the contract.
7.7 All claims arising out of accident etc., during the operation/maintenance period either by
the public or by the staff employed by the contractor are to be settled by the contractor
promptly. The progress of work should not be hampered at any stage for whatsoever may
be the reason.
7.8 The progress of work should be strictly in accordance with the direction given by the
executive in-charge of the work and covers observance of all safety pre-cautions.
7.9 Proper record of Breakdowns and their rectification along with the spares consumed is to be
maintained each day. The register shall have to be signed by contractor and Railway
representative every trip.
7.10 The attendance particulars of the staff deployed shall be maintained by the contractor in a
register and shall be ready to produce whenever required.
7.11 The staff deployed shall make their own arrangement for their transport etc.
7.12 Contractor shall make arrangements for personal insurance of the staff employed by him
for the purpose of contract and submit the proof of having insured shall be submitted to the
Railway authority.
7.13 The tenderer must comply with the provisions Contract Labour (Regulation and
Abolition)Act 1970, Contract Labour Central Rules 1971 and should have valid license under
the aforesaid act. No child labour will be employed by the tenderer at any cost.
7.14 It is responsibility of the tenderer(s) to abide by all the statutory provisions and laws of
Central and state Government including Hours of Employment Regulation.
7.15 The contractor here in specified in this contract shall include the meaning of himself, of his
representatives, of his workmen / labour who is directly engaged on duty at the work spot.
7.16 The contractor i.e. the workmen on duty shall report to the on duty SSE of Coaching Depot
to ensure his attendance for duty. It is the responsibility of the contractor to ensure his
workmen at all times to attend the duties with Identity card during the contract period and
should be good in behavior. Any misbehavior/misconduct by contractor staff is highly
undesirable and such incidents if reported, will be penalized as per penalty clause.
7.17 The contractor staff should attend the work in time without any excuses.
7.18 Stoppage of Contractual work for any agitation etc due to any injury or casualty to
contractor staff, will be the responsibility of contractor.
7.19 Any misuse of Railway property will be viewed seriously and the actual cost with penalty
will be recovered from the contractor’s bill.
7.20 If any point of time if the administration feels the contractual services are not being
maintained as per the standards, administration has got full liberty to cancel the contract
by giving one week notice.
7.21 The staff deployed should have adequate number of mobiles so as to have the
communication among the staff as well as the Railways.
7.22 Railway reserves the right to terminate the contract at any point of time during the period
of execution without assigning any reason.

8. Change of Address:
Any change in the address of the contractor shall be forthwith intimated in writing to the
Railways. The Railway will not be responsible for any loss of inconvenience suffered by the
contractor on account of his failure to comply with this.

9. Dissolution of contractor’s firm:
If the contractors firm is dissolved due to death or retirement of any partner or for any
reason what so ever before fully completing the whole work or any part of it undertaken by
the principal agreement, the partners shall remain jointly, severally and personally liable to
complete the whole work to the satisfaction of the Railway and to pay compensation for loss
sustained if any by the Railways due to such dissolution. The General Manager of the
Railway shall decide the amount of such compensation and his decision in the matter shall
be final and binding on the contractor(s).

10. First Aid Facilities:


There shall be provided and maintained by the contractor so as to be readily accessible
during all working hours first aid box equipped with the prescribed contents at every place
where contractor labour is employed by him.
