Recommended Motion: To approve an Ordinance of the City of Kirksville, Missouri, granting an
additional 90-day extension to a Special Use Permit to allow mini-warehouse and self-storage facilities
(interior access) at 2104 and 2206 South Baltimore Street, as previously authorized by Ordinance
12493 and extended by Ordinance 12513.
Background: The Planning and Zoning Commission (P&Z) held a public hearing on December 8,
2021, to consider the approval of a special use permit to allow mini warehouse and self-storage
facilities at 2104 and 2206 S. Baltimore St. City Council approved the original request for a special
use permit on December 27, 2021.

The buyer was not able to move the project forward as quickly as they had hoped, and the buyer did
not believe they could complete the necessary renovations by the original deadline and was approved
for a 12-month extension. Sec. 44-459 (e) (4) of the Municipal Code states: If a permitted special use
ceases for a period of six months or more, it shall be automatically void. Use regulations pertaining to
the tract shall be the same as if the special use permit had never been granted. The special use has
still not begun and the SUP “shall be automatically void” without the approval of an additional
extension.

At the July 12, 2023, P&Z Meeting, one person spoke in favor of the extension and no one spoke in
opposition. The Commission voted six in favor, with no abstentions and three absent, to recommend
an additional ninety-day extension of the special use permit to September 27, 2023.

Citizen Impact: Approval of this Special Use Permit extension would allow for the shopping center to
address vacancies and facilitate the further commercial development of the property.

Fiscal Impact: The City would incur no expense from the approval or denial of this special use permit.
