Charles Darwin University (CDU) ABN 54 093 513 649 a body corporate established pursuant to the Charles
Darwin University Act 2003 (NT) of Ellengowan Drive, Casuarina NT 0810,

AND

Company/Business Name (Agency) ABN/Charity/Organisation Located in (Business street address, suburb, state)

This Agreement is made in the following context:

A. Students of CDU (at the College of Health and Human Sciences) require the use of Facilities and
associated services and resources provided by the Agency for an observational placement experience
as an essential part of the course work of those Students in undertaking an academic course or degree
of the College of Health and Human Sciences of CDU.
B. The parties have agreed that the Agency will provide an observation-only placement experience in its
Facilities, and associated services and resources, to approved CDU Students.

Conditions of the Agreement:

1. This Agreement will commence when the last party to sign this Agreement does so and will continue
in force as outlined in clause 9 (start and end date of placement).
2. An approved Student on Observational Placement will be covered by CDU's professional and public
liability insurance. Students on Placement are not covered under workers' compensation law.
3. The Agency will ensure the Students undertaking an observational placement:
a. will adhere to duty of care, skill, and diligence, in a proper and professional manner and to a
standard recognised as a high professional standard by the tertiary education industry;
b. provide emergency care for Students undertaking an observational placement in case of
accident or illness will be provided by the Agency under the usual conditions relating to any
visiting personnel to the Agency;
c. adopt relevant best practice;
d. comply with all applicable laws, all applicable Australian standards and tertiary education
industry standards and guidelines and any CDU policies, codes of conduct, standards or
guidelines as may be advised by CDU.
4. Whilst at a Practice Facility, Students undertaking a Placement will be under the direction and
guidance of Agency Personnel, and will be required to comply with appropriate directions, by-laws,
policies, manuals and rules of the Agency.
5. Matters of the discipline of any Student undertaking Placement will be promptly referred by the
Agency to the CDU Representative in writing. CDU will deal with the matter according to its policy and
procedures.
6. In its absolute discretion, exercised reasonably, the Agency may exclude a Student from a Placement
where it considers the Student's is grossly inappropriate. The Agency will notify CDU as soon as
possible.
7. Each party will comply with its obligations under applicable Privacy Law regarding the collection,
use, disclosure and storage of Personal Information relating to Students undertaking a Placement.
The parties will secure Personal Information relating to Students undertaking a Placement against
loss and unauthorised access, use, modification or disclosure.
8. Students undertaking a Placement will wear a CDU student identification card while on the Placement
and, if required by the Agency, identification as provided by the Agency.

9. The Agency offers to provide Observational Placements to Students at the Facilities during the
Term as requested by CDU. The details of the Placement and contact details for a CDU Student
are outlined below.
