This document summarizes India's Plastic Waste Management Rules (PWMR) which were amended several times between 2016-2022. The key points are:
1. PWMR applies to plastic producers, importers, brand owners, and waste processors and covers flexible plastic packaging of single or multiple layers.
2. Producers, importers, brand owners and processors have extended producer responsibility (EPR) targets to collect and manage plastic waste which will increase from 25% in 2021-2022 to 70% in 2022-2023 and 100% in 2023-2024.
3. Starting in April 2023, polymer companies can only supply raw materials to registered processors and import clearances

SUPPLY OF RAW MATERIAL (GRANULES) WILL BE RESTRICTED
AND NOT SUPPLIED BY POLYMER COMPANIES WITHOUT REGISTRATION WITH PWMR AND EPR w.e.f. 01/04/2023
CLEARNCES OF IMPORT OF RAW MATERIAL (GRANULES) WILL
ALSO NOT ALLOWED WITHOUT REGISTRATION WITH PWMR AND EPR. Views : DELEGATION OF AIFTMA MET THE CONCERNED GOVT. AUTHORITIES AND UPRAISED OF THE DIFFICULTIES BEING FACED BY THE INDUSTRY. WE HAVE REQUESTED FOR 1) EXTENSION OF IMPLEMENTATION DATE FROM 01/04/2023 (FOR EPR) 2) THE LIABILITY OF EPR TARGET SHOULD BE OF BRAND OWNERS (BO). THE BO’s SHOULD NOT BE ALLOWED TO BUY THEIR PACAKGING REQUIREMENTS WITHOUT REGISTRAION OF PWMR AND EPR. LIKEWISE ABOVE RESTRICTION ON MANUFACTURER FOR SUPPLY OF RM TO PROCESSORS AND RESCTRICTIONS ON CLERANCES OF IMPORT. WE HAVE ALSO REQUESTED FOR SAME RULE TO BE IMPOSED/FORCED ON BO. THE GOVT. OFFICIALS WERE UPRAISED OF OUR VIEWS AND THEY ASSURED THAT THE NEEDFUL WILL BE LOOKED UPON. Registration of EPR. While completing the online registration for EPR the quantity of supplies made to BO is not accepted in the system where the BO is not registered for EPR under PWMR. Due to above the quantity supplied to above BO is added to applicant liability. On acceptance of above liability EPR registration is completed wherein the liability of the applicant is mentioned in the certificate. Association is trying to sort out the above anomaly and representing GOI to emphasis on BO to get them registered. Processors may wait till such time (say 2nd week of March, 2023 if they do want to take the liability of BO on them. This is an individual call of each and every processor and association have no say in this matter. Copy of draft EPR registration issued is attached for your better understanding.
