MAINTENANCE

3.1. CLEANING. If the display needs to be

battery voltage drops below the 5.6V minimum
operating voltage, the display will read

A.3. DK100/DK120 WARRANTY

The Dukane Corporation warrants that the electronics and case of the Model DK100 or DK120 Under-
water Acoustic Beacon (hereafter referred to as the "unit") will be free from defects in materials and
workmanship for six years from the date of shipment from Dukane Corporation. Dukane Corporation
warrants that the battery in the DK100 or DK120 Underwater Acoustic Beacon (hereafter referred to as
the "battery") will be free of defects in materials and workmanship for four years from the date of ship-
ment from Dukane Corporation. Dukane Corporation will remanufacture or replace any unit or battery
found not to be in conformity with this warranty.

The customer shall be responsible for periodic testing of units in service, removing and shipping to Du-
kane Corporation any inoperative unit, and installing a replacement unit, all in accordance with the
Technical Manual published by Dukane Corporation. If a unit or battery is found by Dukane Corporation
to be defective, Dukane Corporation shall reimburse the Customer for all costs of shipping the unit to
Dukane Corporation, and pay for return shipment to the Customer. If the unit or battery is found not to
be defective, Customer shall pay all shipping costs to and from Dukane Corporation.

This warranty does not cover: (i) defects caused by the Customer’s failure to use, test or maintain any
unit in accordance with Dukane Corporation's Technical Manual; (ii) product failures caused by abuse,
misuse or neglect; or (iii) any product where the Customer has opened the unit, attempted any mainte-
nance, repair or service of the internal components, or replaced the battery.

Dukane Corporation's liability under this warranty is limited to remanufacture or replacement of a unit or
battery that is defective.

DUKANE CORPORATION SHALL NOT BE LIABLE FOR ANY INCIDENTAL, SPECIAL


CONSEQUENTIAL OR EXEMPLARY DAMAGES ARISING OUT OF THE INSTALLATION,
USE, TESTING, SERVICING OR MAINTENANCE OF ANY UNIT.

THIS WARRANTY IS GIVEN IN LIEU OF ALL OTHER WARRANTIES, EXPRESS OR


IMPLIED, INCLUDING THE WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A
PARTICULAR PURPOSE.
