PETITION Under Section 13 (B) of the H.M.A.

1955, for dissolution of marriage by a decree

of Divorce by mutual consent.

RESPECTFULLY SHOWETH:–

1. That the marriage of the Petitioner and the respondent was

solemnized on 05-07-2022 at Hotel Cove, Sector-5, Panchkula,

Haryana in accordance with Hindu Rights and rituals.

2. That the status of the petitioner and respondent before the marriage

and at the time of filing the petition are as follows :-

3. That after the marriage, petitioners lastly resident together as husband

and wife in Dhakoli, Punjab. The marriage was consummated in

between the parties in Dhakoli, Punjab and no child was borne out of

the wedlock of the petitioners.

4. That due to non–adjustability of the petitioners, differences arose

between the petitioners and they could not live together as husband

and wife happily and started living separately since 02-08-2022,

thereafter there is no possibility of their reconciliation to live together.

The matter has been amicably settled with the best efforts of near and

dear of the petitioners in Chandigarh. In the compromise, it is mutually

settled that the petitioners have mutually agreed that their marriage be

dissolved by a Decree of Divorce by mutual consent, hence the

present petition is being filed today.

5. That Petitioner No.2 has settled all her claims present, past and future

and undertakes not to claim in future any amount from petitioner No.1

towards the maintenance, alimony etc.

6. That it is agreed between both the parties shall not involve each other

and their relatives in any sort of future litigation with regard to their

marriage.

7. That there has not been any unnecessary or improper delay in filing

the present joint petition.

8. That there is no other legal impediment in the way of grant of relief

prayed for.

9. That the consent of either of the parties has not been obtained either

by coercion, fraud, undue influence or duress, whatsoever.

10. That the marriage of the Petitioner No.1 is resident of Chandigarh so

this Hon'ble Court has the jurisdiction to entertain and decide the

present petition.

It is, therefore, respectfully prayed that the marriage between the petitioners

may be dissolved by a Decree of Divorce by mutual consent.
