ELECTION RULES & GUIDELINES


VILLA ROMA PHASE 7 HOMEOWNERS ASSOCIATION

I. TIMELINE OF ELECTION

 January 18, 2022 - Announcement of upcoming election


 January 20-23, 2022 - Filling of Candidacy
 January 23, 2022 (5pm) - Orientation of Candidates
 January 24, 2022 - Validation of Candidates and Posting of Official Candidates
 January 25 - 29, 2022 - Campaign Period
 January 30, 2022 Election Day

II. ELECTION COMMITTEE & CHAIRPERSON

a. The Election Committee shall be responsible for interpreting all the rules of the election.
b. The Election Committee shall be responsible for deciding whether or not a candidate is eligible
to run for office.
c. The Election Committee shall develop and implement a voting system to carry out related
election.
d. The Election Committee Chairpersons shall be responsible for the enforcement of the election
rules, the investigation of election complaints, and the only people to officially post-election
results, and any official statements concerning election.
e. The Election Committee is composed of one (1) Chairperson and four (4) members.

III. ELIGIBILITY OF VOTERS

a. He must be a legal owner of a unit in Villa Roma phase 7 and Official member of the Villa
Roma Phase 7 Homeowners Association.
b. He must be listed on the Official list of voters / list of members of the Villa Roma Phase 7
Homeowners Association.
c. If the spouse or close family member of an official member of Villa Roma Phase 7 is given the
opportunity to vote, he or she is required to present an AUTHORIZATION LETTER and
valid ID of both parties.
d. Tenants are allowed to vote if they can present an authorization letter from unit owner/official
member of association containing that they are authorized to vote in their place and valid IDs
from the unit owner. This case will be reviewed and decided by the Election Committee.

IV. NOTICES

a. The Election Committee shall send or deliver the Notice of election to all members through all
possible means available, such as, but not limited to electronic mail or messaging through SMS,
Facebook Messenger or Viber, at least ten (10) days before the election but not more than
twenty (20) days prior to the date of the election.

i. The notice shall state the Following:


ii. The date and time of the election proper and all other election activities.
iii. The alternative voting system adopted in case of electronic or inline voting;
iv. The manner distribution of ballots and casting of votes.
v. The period which votes will be accepted

vi. The manner method of counting of votes, the designated place where counting of
ballots will be conducted; and
vii. The contact information of the Election Committee who can notified by the member of
his/her intention to participate in the election.

V. OFFICIAL CANDIDATE & ELIGIBILITY FOR BOARD DIRECTORS

a. All qualified candidates must be a unit owner and official member of Villa Roma Phase 7
Homeowners Association.
b. All qualified candidates must secure and submit the following requirements to the Election
Committee.

 Homeowners Association Certification/ Clearance (Good Standing)


 Fully Accomplished Certificate of Candidacy (COC's)

c. The filling of the candidacy will start on January 20, 2022, until January 23, 2022 exactly 5:00
PM. No Extension.
 But when in the given extension of filing of candidacy there are still less than six (6)
wishing to run the Board of Directors. The election cannot proceed. The current HOA
Officers will be extended to be as the BODs of Villa Roma Phase 7 until such time a
new set of candidates are completed.

VI. METHODS OF CAMPAIGNING FOR CANDIDATES / SUPPORTERS

a. Campaign period will begin on January 25, 2022 (Tuesday) at 8:00 AM and end at 9:00 PM on
January 29, 2022 (Saturday).
b. No new campaign material may be posted once the election begins.
c. Campaigns are limited to Villa Roma Phase 7, Lambakin, Marilao, Bulacan.
d. Campaign materials should not exceed 3x2 in size.
e. Campaign materials must be submitted to the election committee before it can be displayed.
f. Non-interactive websites & campaign materials are permitted as part of the campaign. Digital
platforms such as Facebook, Instagram, Twitter and others are permitted. Where possible,
candidates should DISABLED COMMENTS on any social media post, group or event.
g. Posting of any campaign material is prohibited and not permitted on the VR7 Official Page.
h. Facebook Groups and Events are permitted as part of the campaign. However, the wall MUST
BE DISABLED so that people cannot leave comments.
i. No more event invitations can be sent after elections have begun.
j. Facebook and other social media platform are allowed during campaigning week, but
CANNOT be used during the election day.
k. During election, NO NEW campaign materials can be posted online OR inside of the Villa
Roma Phase 7 Subdivision.
l. Candidates and their supporters/ friends CANNOT place Facebook and other social media
platform of their statuses, messages or tweets that ask voters to vote for them on Sunday,
January 30, 2022
m. They can only say “Don’t forget to vote in Villa Roma Phase 7 election day on Sunday, January
30, 2022. If you are in doubt whether something is allowed, ask the elections committee before
you do it.
n. It’s better to be safe than to find yourself disqualified.
o. There will be a common posting area at the entrance gate of the Subdivision (Plywood).
Candidates may post their approved campaign material on the set day and time.
p. Posting any campaign material in an area without the permission of the unit owner will be
considered an election violation and this will be investigated by the Elections Committee.
q. MASS GATHERING and MEETING DE AVANCE to promote a candidate are NOT
permitted both inside and outside of the community.
r. During the campaign period, always consider HEALTH & SAFETY PROTOCOLS

s. Flyers and other campaign materials may be posted on approved bulletin boards (PLYWOOD).
Thumbtacks ONLY must be used in posting materials on bulletin boards. Candidates may not
use staples when posting fliers on the bulletin boards.
t. Flyers and other campaign materials may be posted on unit owner doors if permitted to do so.
u. Flyers and other campaign materials may not be posted on the Innova Offices, wall inside the
subdivisions, all vacant unit & lamp posts.
v. Campaign material that is deemed obscene, libelous, racist, sexist, in poor taste, or offensive to
the diverse community will not be permitted.
w. Any infraction of the posting rules by a candidate or a party connected thereto may result in the
disqualification of that candidate. All candidates found in violation of these rules will be subject
to loss of future posting privileges, charges for any damage that may occur as a result of such
postings, and charges may be filed in Election Committee.

VII. METHODS FOR REMOVING CAMPAIGN MATERIALS

a. Candidates/supporters may not attempt to solicit votes or hold campaigning events after the
election has begun.
b. Candidates/supporters can’t stand outside the polling place and ask people to vote for you or
even that your supporters hand out flyers, and other campaign material. Please recall the above
rules regarding Facebook, Twitter, posters, and flyers, as well.
c. Facebook Groups and Events MUST have a DISABLED wall so people cannot leave
comments.
d. During elections, NO NEW campaign materials can be posted online OR inside the community
(i.e., posters).
e. Candidates and their supporters CANNOT place Facebook statuses or tweets that ask others to
vote for them. All infractions of these rules could cause your disqualification.
f. Campaign materials are encouraged to be removed by the candidate/supporters a day before the
start of the election.

VIII. VOTING DAY RULES

The Election is regulated by the Election Committee of Villa Roma Phase 7. Some key rules to follow
on voting day:

a. On election day, there should be a representative from INNOVA CORPORATION and the
Barangay official. They are required to observe the election process until the winning candidate
is declared.
b. The official register of voters should be ready and it is kept by the Election Committee.
c. Voting is by a secret ballot. Displaying your ballot or discussing your vote to another person's
votes is prohibited.
d. Only fifteen (15) person is permitted in a polling place at a time. Following the Health and
safety Protocols
e. Campaigning is prohibited during the Election Day.
f. Signs, buttons, flyers, and any attempt to influence voters is a violation of the rules and grounds
for disqualification.
g. Only eligible electors are permitted in the voting place and they must leave immediately after
voting.
h. Vote buying and intimidation are prohibited.
i. Signing a false statement on an official ballot is an offense and grounds for voiding the right to
vote.
j. The Election Day will be on January 30, 2022 (Sunday) and will be open 9:00 AM until 2:00
PM.
k. Voter is required to present his / her VALID ID as one of those who will prove his or her
identity

l. The ballot secrecy folder / writing pad clip board will contain a list of the complete names of the
qualified candidates. Voters cannot pick it up and take it home from the polling place.
m. Health and safety protocols will always be considered on election day. Before voting, a voter is
required to check by the BHW (Barangay Health Worker). In case that the voter develops any
symptoms of COVID -19, he will not be given the opportunity to vote.
n. If the voter is already in the vicinity of the polling place at a distance of 5 meters, he will be
allowed to vote on election day.

IX. COMPLAINTS

a. When a candidate believes that campaign procedures may have been violated, a written
complaint along with all necessary evidence must be mailed to the Elections Committee
Chairpersons BEFORE the polls close.
b. A complaint(s) must be signed by the candidate and a witness. The Elections Committee will
not consider any complaints unless the person(s) appears before the Elections Committee.
c. A complaint will be considered after the polls close only if reasonable cause can be shown for
the late submission.
d. The Elections Committee shall then review the complaint to see if it is valid and determine what
action should be taken.
e. The election committee shall resolve any dispute within five (5) days after the filling of formal
complaint.

X. DISQUALIFICATIONS

a. A violation of any of the election rules by any candidate connected thereto may reason enough
for disqualification.
b. The disqualification of a candidate will be determined by the elections committee.
c. In the event that a candidate is removed from the election process, the candidate with the next
highest vote total will:
i. assumes the disqualified candidate’s position or
ii. moves up one position in the final vote candidates.

XI. CANVASSING

a. The counting of votes will begin at exactly 3:00 PM on January 30, 2022.
b. All official candidates on election day must not be seen in the canvassing area at a distance of
20 meters. Any candidate who violates this part will be considered disqualified.
c. The Elections committee will check the official valid ballots after the polls close. At least (1)
one watcher per candidate will be present during this process for compliance purposes.
d. The Election Chairman will inform all election committee and Poll watchers of the exact
number of ballots to be read and counted.
e. When counting the votes for the ballot, the election chairman should arrange the ballots to be
read into 25's.
f. The Election committee shall prepare one (1) tally sheet and one (1) tally board for the
counting of votes.
g. The correct and declared popular name of the candidate must be written on the tally board and
tally sheet.
h. The poll watchers of each candidate should be at the back of the election Chairman to ensure
that the name is read correctly from the ballot.
i. The poll watchers of each candidate should also be on the back of the election member to
ensure that the number on the tally sheet is the same as the number on the tally board.
j. When everything that is needed for the counting of votes is ready, the Election Chairman will
say and give a signal that the counting of votes will begin.
k. Once the vote count has begun, any protest will no longer be given a chance to be discussed
by the Election Committee.

l. When the Election Chairman has read the final ballot. The Election member will re -read the
Final number of votes of each candidate to have similarity on the tally board and tally sheet.
m. Election Committee will be given the opportunity and time to prepare the documents they
need to sign and prepare for the declaration of winners.
n. The Election Committee is also required to prepare Minutes of the Election containing sudden
experiences contrary to the Election Rule and their decision in those instances.

XII. RESULTS

a. The top seven (7) candidate with the highest number of votes shall be deemed the winner.
b. In the event of a tie on the number of votes for the seventh position. The decision will be made
immediately by TOSS COIN to be initiated by the Election Committee.
c. The seven (7) candidates declared winners must head to the Canvasing area to be formally
declared by the election committee.
d. After the Election Committee declares the seven (7) election winners. It should be determined
immediately at the end of the canvassing which of the seven (7) winning candidates will be the
President, Vice President (internal), Vice President (external), Secretary, Assistant Secretary,
Treasurer and Auditor.
e. It is necessary to immediately sign and put the name of the newly elected BOARD OF
DIRECTORS on a document that must be submitted to the DEPARTMENT OF HUMAN
SETTLEMENTS AND URBAN DEVELOPMENT (DHSUD)
b. The result and declared winners in the election will be posted on all social media Platforms of
Villa Roma Phase 7 and at the main gate of the Subdivision.

XIII. WATCHERS

a. Official poll watcher's name must submit during the Orientation of Candidates on January 23,
2022.
b. Official poll watcher must observe the health and safety protocols at all times.
c. Each candidate may appoint one (1) official poll watcher per early voting site or polling place
during the hours the polls are open.
d. The Poll watcher must be a voter or unit owner of Villa Roma Phase 7. He must show his poll
watcher ID prepared by the candidate he is running for.
e. Poll Watchers are not permitted to be closer to the Elections Officials' table or the voting
booths than is reasonably necessary to perform their duty.
f. Poll Watchers may not obstruct the orderly conduct of the election. So at the time of the
election the poll watchers are supposed to stay in the seat designated by the Election
Committee.
g. Poll Watchers may watch and observe the conduct of the electors and officials, but they may
not walk freely throughout the polling location.
h. Poll Watchers are not permitted to be closer to the Elections Officials' table or the voting
booths than is reasonably necessary to perform their duty.
i. Poll Watchers are not permitted to wear any item supporting or advertising for any political
party, candidate, or issue.
j. Cameras, radios, televisions, or newspapers are NOT PERMITTED in the polling room or
early voting site.
k. Poll Watchers may not interact directly with a voter. Questions regarding procedures must be
directed to the Precinct Clerk for resolution.
l. Poll Watchers should inform the Election Committee if they see or hear anything that does not
comply with election law.
