Dear Sir,

Appointment in Terms of Regulations promulgated in accordance with the Occupational Health and Safety Act, Act 85 of
1993 and Regulations as amended.

POST DESIGNATION: SITE FOREMAN

In your capacity as Site Foreman, at Nestle Estcourt, you are hereby appointed in terms of the OSH ACT SEC. 8. You
will be responsible to Mr. Balen Naicker to assist him with the management, control, direction and enforcement of the
regulations and general supervision with regard to the activities in the areas as per your appointment.

This appointment is made in accordance with the duties, as defined in Section 8 of the OHS Act, Act 85 of 1993 and as
amended from time to time.

As Site Foreman of construction personnel, you must also ensure that the following duties are complied with:

1. General duties of employers to their employees. Section 8

 Every employer shall provide and maintain, as far as is reasonably practicable, a working environment for his
employees that is safe and without risks to health.

 Without derogating from the generality of an employer's duty under sub-section (a), the matters to which that duty
extends include in particular

 To provide and maintain systems of work, plant and machinery that are, as far as is reasonably practicable, safe and
without risks to health;

 To make arrangements for ensuring, as far as is reasonably practicable, safety and absence of risks to health in
connection with the production, processing, use, handling, storage or transport of articles or substances;

 Provide such information, instruction, training and supervision as is necessary to ensure, as far as is reasonably
practicable, the health and safety at work of his employees;

 To provide and maintain means of access into and egress from the workplace that are safe and without risks to
health;

 To take all necessary measures to ensure that the requirements of this Act are observed by every person in his
employ on premises where plant or machinery is used;

 To enforce such measure as may be necessary in the interests of health and safety;

 To ensure that work is performed and plant and machinery is used under the general supervision of persons who are
trained to understand the hazards associated with it, and who have the experience to ensure that precautionary
measures established by the employer are implemented;

 To cause all employees to be informed regarding the scope of their authority as contemplated in Section 37 (1) (b) of
this Act;

 To establish, as far as is reasonably practicable, what hazards to the health or safety of persons are attached to any
work that is performed, any articles or substance which is produced, processed, used, handled, stored or transported
and any plant or machinery which is used in his business and further, he shall establish as far as is reasonably
practicable, what precautionary measures should be taken with respect to such work, article, substance, plant or
machinery in order to protect the health and safety of persons and he shall provide the necessary means for, and
apply such precautionary measures;

 To take such steps as may be reasonably practicable to eliminate or mitigate any risk or potential risk to the safety or
health of persons, and

 As far as is reasonably practicable, not to permit any employee to do any work or to produce, process, use, handle
store or transport any article or substance or to operate any plant or machinery unless the precautionary measures
established in terms of paragraphs (i) and (j), or any other precautionary measures which may be prescribed, are
complied with.
