LEASE DEED

This deed is made at Delhi on this 1 st December 2022 between Mrs. Lethi Vijay Aged 65 Years D/o
Late Sh. Baskaran PK, residing at 643/502 Khalasi Line Kydganj Allahabad, Uttar Pradesh - 211003,
hereinafter referred to as the “Lessor” (which expression shall, wherever the context so permits be
deemed to the First Part.

AND

Mr. Giju Varghese aged 55 years (DOB- 01-12-1956) S/o Sh. Kochukunju Varghese, permanent
residence at 44-D, DDA New Janta Flats, Chilla, Mayur Vihar Phase - 1 East Delhi 110091, hereinafter
referred to as the “Lessee” (which expression shall wherever the context so permits mean and
include their assigns and successors.) of the other part.

The Lessor and the Lessee are hereinafter referred to in common, individually as “Party” and
collectively as “Parties”.

AND WHEREAS the Lessor is the absolute owner of premises situated at and more
particularly described in Schedule A hereto (hereinafter called the Demised Premises).

AND WHEREAS the Lessor represents that the demised premises is a legal construction and
is, therefore, sanctioned by the appropriate Municipal Authority.

AND WHEREAS the Lessor, represents and warrants that the Demised Premises can be used
for the residential purpose of the Lessee.

AND WHEREAS the Lessor, at the request of the Lessee, hereby leases the Demised premises to
the Lessee on terms and conditions stated herein below: -

NOW THIS DEED WITNESSETH AS FOLLOWS:-

1. In consideration of the rent hereafter reserved and all the covenants and conditions hereinafter
contained and on the part of the Lessee to be observed and performed, the Lessor hereby
demises by way of lease unto the Lessee the premises located at Flat No 42-D, 1st Floor, DDA
Flats, Chilla, Mayur Vihar Phase – 1, East Delhi 110091.

2. The Lessee shall pay rent at the monthly rate of Rs.8,000/- (Rupees Eight thousand only) in
advance on or before the 5th day the of English calendar month. If the lessee fails to pay, the
lease money for over one month, the lease shall stand terminated and the Lessee shall forthwith
hand handover physical vacant possession of the premises to the Lessor, attracting other clauses
as hereinafter mentioned/contained. The above rent excludes the monthly Residence Welfare
Association charges, electricity, water, and gas charges for the above flat. The same shall be
paid for, regularly by the lessee.

3. That the lease agreement is for a fixed period of 11 months starting from the 1st of December,
2022 to the 1st of November, 2023.

4. That the lessee has agreed to deposit Rs.16,000/-- (Rupees Sixteen thousand only) as a security
deposit which shall be held as an interest-free deposit and the same shall be refunded only after
the expiry/termination of the lease, subject to the terms and conditions.

5. The Lessor shall bear the house tax, the ground rent, water charges, electricity charges,
society/Association membership and other charges, maintenance charges, and all municipal fees
and other levies in force from time to time.

6. The lessee shall maintain the aforesaid premises in fully inhabitable condition subject to normal
wear and tear and shall ensure that proper maintenance is regularly carried out for all
fittings/fixtures etc.

7. The Lessor shall, however, carry out any major repairs if any.

8. The lessee shall riot make any addition or alteration to the premises without the written consent
of the Lessor.

9. The Lessor has whitewashed/painted the premises including the painting/polishing doors.
Similar whitewash/painting shall be carried out by the Lesser after every three years.

10. The Lessee has satisfied himself with the condition and habitability of the premises.

11. Either may terminate this lease upon giving a notice of one month in writing on the expiry of the
notice period, the lease shall be deemed to have terminated and the lessee will deliver vacant
possession of the premises to the Lessor in good condition.

12. The Lessee Covenants With the lessor as follows: -

a) The Lessee has taken on lease the said premises for the specific residential purpose of the
Lessee and his family. The lessee shall not induct any other person on the said premises.
If any other person is so inducted, it shall amount to sub-letting, assigning, and/or parting
possession of the premises which will entitle the Lessor to evict the Lessee from the
premises.

b) The Lessee shall pay for all the electric (light and power), water and gas charges during the
period of their tenancy directly to the BSES, Delhi Jal Board, IGL Ltd., or other authorities,
etc. The Lessor shall not be responsible for disconnection/claims on account of non-payment
of bills and all such defaults/penalties/actions etc. Shall be at the cost of the lessee.

c) The Lessee shall pay for all breakages and/or damages caused to the sanitary/electric goods
and all other fixtures and fittings during their tenancy period subject to natural wear and
tear.

d) The Lessee shall not make or carry out any alteration/ addition or any structural changes in
the said premises without obtaining the prior written consent of the Lessor.

e) The Lessee shall not sublet, assign, authorize, or part with the possession of the whole or
part of the said premises.

f) At the time of occupation, the Lessee has seen that all the sanitary, electrical, and all other
fixtures and fittings are in order and the Lessee shall be responsible to restore them in the
same condition as they have been taken over, subject to normal wear and tear.

g) The Lessee shall permit the Lessor or any of his representatives to enter into the said
premises at reasonable notice and at any reasonable time for inspection or to get the repairs
done to the premises, fixtures/fittings, etc.

h) That the Lessee shall comply with all the rules and regulations of the local authorities with
relation to the said premises and would be responsible to pay any fines or any penalties
imposed by the local authorities for any misuse of the premises or for neglect of any type
and nature. The Lessee also hereby agrees to indemnify the Lessor with regard to any such
actions by the local authorities.

i) The Lessee hereby categorically undertakes that it shall be his sole duty and responsibly to
ensure that the premises which are hereby being leased shall be handed over with full
vacant possession as and when the lease expires or the lease Stand terminated.

j) The Lessee has to vacate the premises after the expiry of 11 months from the date of
execution of this Lease Deed without any hesitation. If both parties are interested to
renew the Lease Agreement for a further period of 11 months, then the Lessee is liable to
pay an additional increase of rent 10% from the prevailing rate i.e. Rs.8,000/- plus an extra
10% in each and every renewal.

13. In case of breach of the terms and conditions of the lease agreement, by the Lessee or the
Lessor, either party can terminate the lease by giving 30 days notice in writing (which shall be
considered as duly served in case sent by registered post at the residence address of the
Lessee/Lessor) and thereupon this lease shall stand terminated and the Lessee shall hand over
physical vacant possession of the premises to the Lessor.

14. That on termination of the lease, the Lessee shall deliver vacant possession of the Demised
Premises unto the Lessor in the condition in which the Demised Premises were let out, subject
to normal wear and tear, In the event of Lessee's failure to do so or otherwise, the Lessor will
have the right to undertake all necessary activity for internal repair and maintenance and deduct
the cost thereof from the Deposit in respect of the premises or otherwise recover the same from
the Lessee.

15. That if the Lessee does not vacate the premises within time, then he/she would be liable to pay
Rs.500/- (Rupees Five Hundred) per day as damages or penalty.

16. The Lessor shall not be responsible for disconnection, claims on account of non-payment of bills
all such defaults/penalties/actions etc. shall be at the cost of the Lessee. The Lessor will be
within his rights to take necessary action to make good any arrears/penal charges on account of
non payment of electricity, water and gas bills. The same shall be recoverable from the security
deposit.

17. All disputes arising under this agreement shall be subject to Delhi jurisdiction only.

IN WITNESS THEREOF THE PARTIES HAVE SIGNED THE LEASE ON THE DATE AND MONTH FIRST,
ABOVE MENTIONED.
