AGREEMENT OF LEASE

This Agreement is executed at Varanasi on 1st Day of September, 2013 between Mr. Anand Dubey S/O of Late Shri Govind kumar Dubey (Owner of B-20/1H Bhelupura Varanasi) Hereinafter called the LESSOR which expression shall include their heirs, successors and legal representative and permitted assignees both the First Part. AND Mr. Ritesh Jaiswal S/O Mr Satish Kumar R/O B 36/20 A-27 Bharamanand ext.1 Durgakund Varanasi hereinafter called the LESSEE which term shall their heirs, successors and legal representative and permitted assignees of the other part. WHEREAS the landlord is the owner of property being (B-20/1H Bhelupura Varanasi) and 4 Rooms, 1 store Room, kitchen and 1 Bath room on the first floor of the property only is in the possession of the lessee on a monthly rent of Rs. 12000/- per month as per agreement to lease dated 1st Day of September , 2013.

WHEREAS the said lessee has approached the landlord to take the above said premises on rent for a period of 11 months. The landlord has agreed to let out the said premises to the lessee on the following terms and conditions: 1 That the lessee has been agreed to for a fixed period of 11 months commencing from 1st day of September, 2013. That the lessee shall pay to the landlord for the premises on rent of Rs. 12000 (Rupees Twelve thousand only) per month including maintenance charges payable in advance on or before that 7th day of each calendar month. That the lessee shall pay extra for consumption of electricity and water charges as levied by concerned authorities. That the lessee shall under no circumstances sublet, assigned, transfer on otherwise part with possession of part or whole of the premises hereby dismissed. That the lessee at the time of occupation shall see that the furnitures, electrical and other fittings and fixtures are in perfect working order and nothing is broken or missing and is in accordance with the list of articles attached as annexure. The lessee shall be responsible to maintain them in proper condition thru maintenance/ repair/ replacement etc. These will be restored to the landlord by the lessee in the same condition on termination of the lease period.

That the lessee shall pay the electricity and water bill to the concerned authority as and when it is payable and will hand over the original payment receipts to the lessor or the person assigned by the lessor. That the lessee shall be responsible to pay for any breakage/damages caused to the sanitary, electrical and other fittings and fixtures during the tenancy period. That the lessee shall comply with all the rules and regulations of the local authorities whatsoever with relation to the demised premises. That the lessee shall not carry out any structural addition or alterations to the building, layout, fittings or fixtures, without the written consent of the landlord. That the lessee shall permit the landlord, his agents etc to enter upon the demised premises for inspection and carryout the repairs etc. at respectable times, as and when necessary. That the landlord shall pay the house tax, ground rent, maintenance charges and other statutory levies as are or may hereinafter be assessed on the demised premises by the authorities concerned. That the demised premises is duly distempered and painted and polished by the landlord. The landlord shall not be liable to affect any minor repairs e.g. white washing, distempering, painting, and polishing during the tenancy period. That the day repairs of fittings and fixtures on the said kothi such as those related to sanitary, electrical, carpentry items etc. have to be done by the lessee at his own cost. However, major repairs such as leakage in electricity, bursting of sanitary pipes and damage to the building will be done by the landlord at his own cost. That the lessee/landlord shall have the option to terminate the lease by giving one months notice or rent in lieu thereof. That on expiry of the lease the lessee shall hand over vacant peaceful possession of the premises to the landlord. Before leaving the premises, he should settle all dues in respect of rent, water, electricity, cost of breakage, and damage, if any due from the lessee. That for any default on the part of lessee for violation of any of the conditions listed above, the landlord will have the right to terminate the tenancy of the lease and the lessee shall be bound to hand over the vacant and peaceful possession of the demised premises to the landlord.

Any notice required to be served upon the lessee shall be sufficiently served upon, if it is delivered to the occupant of the premises by registered post and acknowledgement obtained and shall be sufficiently served upon the landlord if delivered to him by registered post and acknowledgement obtained. The lessee shall not store and merchandise, contraband or explosives items in the leased premises. That the lessee rent will increase reasonably by 10% on completion of every 11 months. However rent increases on renewal of lease for any further period will be done by mutual consent of the lessor and lessee. That the lessee shall use the premises for operating business and shall live peacefully and shall not do or cause to be done anything which may be of any nuisance value or cause any hindrance or embarrassment or disturbance to the lessor and/or the neighbors. That in case of LESSEE fails in payment of the monthly rent, the lessor shall be at liberty to forfeit the deposit money and require the lessee to vacate the premises forthwith. That in the event of the breach of the terms and conditions of the lease agreement by the lessee, he shall be at liberty and shall have all rights to cancel the lease by giving one months notice in writing, thereafter the Lessee shall have to vacate the premises within that period. The lessee shall give peaceful possession of the said premises on the termination of this deed to lessor or its authorized agent only or the lessors heirs, legal representative executor and assignee and not anybody else and in good condition as was taken over by the lessee. That the lessee will ensure that no hindrance is caused not any obstruction made in the staircase or common passage. The lessee has paid security amount of Rs.24000 (Rupees Twenty Four Thousand Only) equivalent to 2 months rent to the Lessor which shall be refundable after expiry of the tenancy period without interest. That the premises shall be used for operating Boutique and Share Trading Business only and shall not be used for any other purpose. That incase of any damage to the property the lessor shall have the right to deduct the amount on account of damages done to the property from the security made by the lessee.
