AFFIDAVIT OF DESISTANCE

I, _________________, of legal age, Filipino and with office address at l G/F,

Somerset Olympia Bldg, Makati Ave. cor. Sto. Tomas, Urdaneta Village, Makati City
after being duly sworn to in accordance with law hereby deposes and states that:

1. I am the duly authorized representative of Cherub Auto Dealer, Inc., the

private complainant in the complaint for Estafa entitled People of the Philippines vs.
Emmanuel N. Lavarro docketed as Crim. Case No. 62667-18 now pending before the
Metropolitan Trial Court in Cities, Branch 2 of Calamba City.

2. Upon close perusal and evaluation of the facts and circumstances involving
the case it is hereby declared that the instant case now pending before MTCC-2, Calamba
City against accused arose from misappreciation or misapprehension of facts.

3. In view of the foregoing, I respectfully and voluntarily execute this

Affidavit of Desistance in favor of the accused in connection with the complaint now
pending with the MTCC-2, Calamba City entitled entitled People of the Philippines vs.
Emmanuel N. Lavarro docketed as Crim. Case No. 62667-18 and hereby declare that I
have no further claim or cause of action against herein accused, and signifies my lack of
interest to pursue the complaint against the accused:

4. I am fully aware and I understand that this Affidavit of Desistance shall

mean that private complainant can no longer re-file the above-entitled complaint and that
the same is forever barred;

5. Hence, it is most respectfully prayed of this Honorable Court to consider

this Affidavit of Desistance in the instant case and to dismiss this case with prejudice.
