Sandoval Ave., Pinagbuhatan City of Pasig Metro Manila, on oath, state:

1. That I am the Respondent herein this case to wit: MARXS ALLEN

DJIRO SALDIVAR ESCONDO vs. VXI PH’, CARISSE BACANI AND
JOHN BENJAMIN RAYOS with NLRC NCR Case No. 04-00534-23.
2. As such, I caused the preparation and filing of the foregoing Position
Paper. I have read the contents thereof and understood the same.
3. That I have not commenced any action or proceeding involving the same
issue and specifically the same complaint in any Court, tribunal or quasi-
judicial agency and to the best of my knowledge, no such action or claim
is pending therein.
4. If I should learn thereafter that a similar action or proceeding has been
filed or is pending before these courts or tribunal or agency, I undertake to
report that fact to the Court within five (5) days therefrom
