AFFIDAVIT OF DESISTANCE

I, RICKY BARAQUIEL, of legal age, a resident of

_____________________________________________ after having been
duly sworn to in accordance with law hereby depose and say:

1. That I am the complainant(s) against CLEARSKIES

TRANSPORT INC. for the injuries and/or damages sustained
as a result of the accident, which occurred on or about
January 16 2023 at Sta. Rosa, Laguna;

2. That after a careful deliberation of the facts and circumstances

leading to the filing of said case, I found that the injuries
and/or damages sustained were purely accidental and I am no
longer interested in pursuing criminally and/or civilly the said
case, including any other administrative cases related in this
case against the aforementioned person;

3. That in view thereof I have no more interest in further

prosecuting the cases against the aforementioned
company and will no longer pursue or testify against it;

4. That should there be any complaint/charges that I filed

against the aforementioned company I am expressly
repudiating the material points alleged in the said complaint;

5. That I am executing this Affidavit and I am not offered any

consideration in whatever form and no threat, intimidation or
force was exerted upon me;

6. That this affidavit is being executed by me in my own free will

and volition for the purpose of requesting the dismissal and/or
signifying my/our intention to refrain from further proceedings
against the aforementioned company and hereby waive all
rights and claims available to me pertaining to said accident,
now and hereafter;

7. That the foregoing statement have been fully read to me and

translated to me in the language or dialect known to me, to
which I understand and that the same are true and correct to
the best of my knowledge and belief;

 8. I signed this affidavit by affixing my thumbmark without any
threat, force, undue influence, intimidation coming from
anyone, and hereby sign as my own voluntary act and deed.

9. That I attest to the veracity and truthfulness of the foregoing

facts.
