We have heard Mr. Siddharth Luthra, learned Senior Counsel for

the appellant and Mr. S.V. Raju, learned Additional Solicitor

General for the respondent.

ECIR was registered on 31.01.2011. The prosecution complaint

was registered on 29.06.2018. The appellant was not named therein.

But in the supplementary complaint filed on 23.12.2022, the

appellant was named.

During this entire period of eleven years, the appellant was

not arrested.

Therefore, the appeal is allowed.

The interim protection granted to the appellant on 24.03.2023

is made absolute. It is made clear that this protection is for his

individual capacity and in the capacity of the appellant as an

individual capacity and in the capacity of the
appellant as an Authorized Representative of the
Faith Cricket Club.
However, the appellant shall appear before
the trial court.”
