The humble appellant, the above named most

respectfully begs to submit as under: -

1. That the present Appeal has been preferred by the

appellants against the impugned Office Order No.

izLFkk@ea=k@inks-@3493&3555 dated 21.03.2023

and Office Order No. izLFkk@ea=k@inks-

@3442&492 dated 21.03.2023, wherein by way of the

impugned Office Order No. izLFkk@ea=k@inks-

@3493&3555 dated 21.03.2023, the names of the


appellants have been eliminated from the DPC year

2014-15 in further of which Order dated 18.03.2016

came to be passed for promotion to the post of Senior

Assistant and also on account of such Order passed

pertaining to not including the name of the appellants

in the DPC year2014-15 for their promotion to the

post of Senior Assistant, even their consideration for

promotion done for the post of Assistant

Administrative Officer by way of Order dated

02.02.2021 for the DPC year 2020-21 has been

eliminated for the reason that once they are not

considered for the DPC year 2014-15 for promotion to

the post of Senior Assistant and rather considered for

promotion to the post of Senior Assistant for the DPC

year 2016-17, wherein, both appellants are not able to

fulfill requisite time of 5 years for their promotion on

the post of Assistant Administrative Officer. Copy of

2. That it would be relevant to mention here that the

humble appellant came to be appointed in the

Department of Information and Public Relations by of

Office Order No. izLFkk@ea=k@inks-@3442&492


dated 21.03.2023 and Office Order No.

izLFkk@ea=k@inks-@3493&3555 dated 21.03.2023


in further of which , the appellants even submitted

their joining before the respondents on .....................

3. That thereafter, the appellants became eligible for

promotion on the post of Senior Assistant (Clerk

Grade-I) from the post of Junior Assistant (Clerk

Grade-II) for the DPC year 2014-15 wherein, upon

their participation before the Departmental promotion

committee, the humble appellants were duly

considered for promotion and their Orders of approval

for their promotion came to be passed by the

Authorities on 29.03.2016 granting them promotion

on the post of Senior Assistant for the DPC year 2014-

15. Copy of the Order dated 29.03.2016 for promotion

on the post of Senior Assistant of the appellants is

annexed and marked as Annexure-4.

4. That it would not be out of place to mention here

that at the time of seniority list that had been issued

for the post of Junior Assistant, no objection was ever

submitted by the private respondents upon the same

in reference of either a provisional or a final seniority

list.

5. That it would not be out of place to mention here

that even the names of private respondent namely

Shri Brijendra Singh Yadav, Arjun Singh and Shri

Krishna Singh Khinchi were in the list of eligible

candidates included in the DPC year 2013-14, 2014-

15 and 2015-16 for DPC however, as a result of their

service record not being available for the years that

were to be considered by Departmental Promotion

Committee, the names of the private respondents were

not even considered by the Departmental Promotion

Committee year and were rather placed in a sealed

envelope as per the procedure.

6. That on account of non-consideration of the

candidature of the private respondent in the DPC year

2013-14, 2014-15 and 2015-16, it was rather

considered in the subsequent years 2016-17 for Shri

Arjun Singh for his promotion to the post of Senior

Assistant by way of issuing Orders of promotion dated

20.06.2018.

7. That thereafter, the name of Shri Brijendra Singh

Yadav was considered for promotion on the post of

Senior Assistant for the DPC year 2017-18 by way of

Order dated 04.02.2019.

8. That even the name of private respondent Shri

Krishna Singh Khinchi was not considered by

Departmental Promotion Committee due to pendency

of Departmental Enquiry under Rule 16 of Rules of

Rajasthan Civil Services (Classification, Control and

Appeal) Rules, 1958 from the year ranging between

2002-03 to 2017-18 however, thereafter his name was

placed in the sealed cover by granting him serial no. 3

in DPC list of the year 2016-17. Copy of the minutes

of the Departmental Promotion Committee dated

20.06.2018 is annexed and marked as Annexure-5.

9. That for ready reference of the Hon'ble Tribunal,

even the seniority list as on 01.04.2017 is being

placed on record reflecting the year of promotion of

the appellants on the post of Senior Assistant as the

DPC year 2014-15, is being placed on record. Copy of

the Seniority List dated 01.04.2017 including the

name of the appellants is annexed and marked as

Annexure-6.

10. That the copy of the Annual Confidential Reports

for candidates included in the DPC year 2016-17 for

consideration for promotion for the post of Clerk

Grade-I, wherein the name of private respondents is

included is annexed and marked as Annexure-7.

11. That the copy of the list of candidates within zone

of consideration for promotion to the post of Senior

Assistant for DPC year 2017-18 is annexed and

marked as Annexure-8.

12. That even the seniority list as on 01.04.2018

reflects that the appellants have been considered for

promotion for the DPC year 2014-15 whereas, the

private respondent Arjun Singh and Krishna Singh

Khinchi have been considered for DPC year 2016-17.

Copy of the Seniority List as on 01.04.2018 is

annexed and marked as Annexure-9.

13. That copy of the list of candidates within zone of

consideration for Senior Assistant for DPC year 2018-

19 reflecting name of private respondents is annexed

and marked as Annexure-10.

14. That thereafter, the names of the present

appellants were even reflected in the seniority list

determined on 01.04.2021 for promotion on the post

of Assistant Administrative Officer wherein, name of

the appellants was at serial nos. 15 & 16 respectively.

Copy of the list of eligible candidates determined as on

01.04.2021 for the post of Assistant Administrative

Officer is annexed and marked as Annexure-11.

15. That even as per the list of candidates determined

on 01.04.2021 for the post of Senior Assistant, the

name of Arjun Singh is at serial no. 10 wherein it is

clearly reiterated that he was promoted on the post of

Senior Assistant on 01.04.2016. Copy of the list of

candidates determined on 01.04.2021 for Senior

Assistant is annexed and marked as Annexure-12.

16. That despite being not granted promotion prior to

the present appellants upon the post of Senior

Assistant, the respondents then undertook a Review

of the DPC wherein it has been reiterated that the

name of Brijendra Singh Yadav, Arjun Singh and

Krishna Singh Khinchi was not considered on account

of their ACRs not being available for the DPC years

2013-14, 2014-15 and 2015-16, therefore, through

the Self Contained Review Note, it came to be

proposed to conduct review for the post of Senior

Assistant for the DPC year 2013-14, 2014-15, 2015-

16, 2016-17 and 2017-18. Copy of the Self Contained

Review Note dated 06.10.2022 is annexed and marked

as Annexure-13.

17. That even as per the Office Order dated

04.02.2019, the Review DPC undertaken on

30.01.2019 resulted in promotion of Shri Brijendra

Singh Yadav upon the post of Senior Assistant for

DPC year 2017-18. Copy of the Office Order dated

04.02.2019 is annexed and marked as Annexure-14.

18. That copy of the review meeting under

departmental promotional committee dated

20.02.2023 is annexed and marked as Annexure-15.

19. That subsequently, the respondents even issued a

provisional seniority list of Assistant Administrative

Officer on 01.04.2023 dated 05.04.2023 including the

name of appellants at serial no. 12 and 13 is annexed

and marked as Annexure-16.

20. That the copy of the Final Seniority List of Assistant

Administrative Officer as on 01.04.2023 dated

23.05.2023 including the names of the appellants is

annexed and marked as Annexure-17.

21. That against the impugned Order passed by the

respondents dated 21.03.2023 as Office Order No.

izLFkk@ea=k@inks-@3493&3555 dated 21.03.2023

and Office Order No. izLFkk@ea=k@inks-

@3442&492 dated 21.03.2023, the humble

appellants submitted a Representations before the

respondents dated 27.03.2023, 28.03.2023,

10.04.2023, 29.05.2023, 30.05.2023 and 09.06.2023.

Copies of the Representations dated 27.03.2023,

28.03.2023, 10.04.2023, 29.05.2023, 30.05.2023 and

09.06.2023 are annexed and marked as Annexure-18

collectively.

22. That despite submitting so many Representations

at length before the respondents for taking

appropriate actions against the impugned Orders and

protect the candidature of the appellants, no heed has

been paid by the respondents in the matter therefore,

the need arose to approach the Hon'ble Tribunal at

this juncture challenging the impugned Orders passed

by the respondents.

23. That the respondents did not pay any heed to the

grievances of the humble appellant raised through the

Notice for Demand of Justice and therefore, having no

other alternative, efficacious and speedy remedy, the

humble appellant has preferred the present Appeal on

the following amongst other grounds: -

GROUNDS

a) Because, even as per the Circular of the Department

of Personnel dated 04.02.2008, it has been clearly

Copy of the Circular dated 04.02.2008 is annexed and

marked as Annexure-19.

b) Because, even as per the Circular dated 05.10.2018

issued by the Department of Personnel in reference of

implication of punishment imposed under Rajasthan

Civil Services (Classification, Control and Appeal)

Rules, 1958, it has been clearly reiterated that upon

being found guilty and punished with the punishment

of censure, cumulative/non-cumulative withholding of

annual increment, stoppage from promotion recovery

upon financial loss or demotion to a lower service

grade therein despite recommendation of the

Departmental Promotion Committee wherein the

process of promotion has already undertaken therein

even no review shall be allow. Copy of the Circular

dated 05.10.2018 is annexed and marked as

Annexure-20.

c) Because, as per the Order dated 10.03.2013, there are

a total 48 sanctioned post for the post of Clerk Grade-

I and 72 posts for Clerk Grade-II for the department of

information and public relation and thereafter, upon

Re-Organized Structure of Cadre Strength dated

19.06.2017, the sanction strength for Junior

Assistant and Senior Assistant is 70 and 47

respectively. Thereafter, again upon restructuring vide

Order dated 17.08.2022, there are 38 sanctioned

posts for Senior Assistant within the Department.

d) Because, even as per the rules pertaining to

promotion in respect of making the seniority list and

its circulation, it has been clearly mentioned therein

Therefore, the impugned action of the

respondents in now eliminating the names of the

present appellants from the DPC list of the year 2014-

15 for the post of Senior Assistant and

consequentially jeopardizing their promotion while

including their name in the DPC year 2020-21 has

effected the seniority of the appellants gravely and

even though the name of the private respondents

ought not to have been included in the Review DPC

list for the post of Senior Assistant in the light of

above quoted para, therefore, the indulgence of the

Hon'ble Tribunal is sought in the matter. Copy of the

relevant part of the rules pertaining to preparation

and circulation of seniority list is annexed and

marked as Annexure-21.

e) Because the humble appellant craves leave to submit

other and further grounds at the time of arguments.

PRAYER

It is, therefore humbly prayed that Your Lordship may

graciously be pleased to accept and allow this Appeal and

by an appropriate order or direction: -

1. The impugned action on the part of the respondents

in not promoting the humble appellant to the post of

Platoon Commander (M.T.) in RAC may be held to be

arbitrary and illegal and inaction and omission on the

part of the respondents in not considering the

candidature of the humble appellant for the post of

Platoon Commander (M.T.) by not considering the

candidate of SC category against Unreserved category

post may be held to be arbitrary and illegal and the

same be ordered to be set right by directing the

respondents to consider the candidature of the

humble appellant for the post of Platoon Commander

(M.T.) with all consequential benefits, in the interest of

justice.

2. Any other appropriate order, which may be found just

and proper in the facts and circumstances of tithe

case, be passed in favor of the appellant.

NOW ALL MEN by these present that I, Aashri Ramchandani
S/o Shri Handuram, aged about 55 years, R/o Village &
Post Bhanakpura, Tehsil Todabhim, District Karauli, the
undersigned in the above case do hereby make, constitute and appoint
Tanveer Ahamad, Salim Khan - Advocates
my/ our true and lawful attorneys, for me/us in my/our name, and on my/our behalf to appear
plead and act in the said case, and more particularly to draw, make, present, withdraw,
amend, represent and verify petition, plaints or written statements and to make, present
applications or petitions in the court, to present withdraw and receive documents and any
money from the Court or from the opposite party either in execution of the decree or
otherwise, and on receipt of payment thereof to sign and deliver for me/us proper receipts and
discharges for the same, to compromise or to refer the case to arbitration, to seek execution
of the decree or any orders in the case, to draw, make present, withdraw, amend and
represent any memorandum of appeal or cross objections in any appeal arising or to seek
reviews or revision of any Judgment, decree or order in the case, to appear, conduct and
plead in all such writ / appeals / revisions and reviews, and to do all other lawful acts and
things as effectually as I/we could do the same whether being personally present or
otherwise, My/ our said counsel is/are also hereby authorised and empowered to instruct,
engage or appoint any other counsel or counsels to appear, plead and act with or for
him/them in his/their absence or otherwise as my/our said counsel may think proper to do so,
all acts of such counsel or counsels shall be equally and similarly binding on me/us as if done
be my/our said counsel and as if done by me/us personally.
I/We hereby agree that if any part of the said counsel's fee remains unpaid before the
first hearing of the case, or if any hearing of the case be fixed on tour or at any other place
except the usual court premises, then my/our said counsel will not be bound to appear before
the court. The counsel's fee now settled and agreed to is in respect of this Court and for the
pending proceedings only. Any fresh action hereafter taken will entitle the counsel to fresh
fees. I/We also agree that if the case be dismissed in default or if it be proceeded ex-parte
under any circumstances whatsoever the said counsel shall not be held responsible for the
same and all whatsoever my/our said counsel shall do in connection with the said case, I/We
do hereby agree to ratify and confirm. Any costs awarded in the case at any time in my/our
favour shall form part of the counsel's claim and shall be payable to him /them in addition to
his/their fees in the case.
