1. Do you accept the conditions of the Brookfield Multiplex Standard Subcontract Agreement?
2. Do you acknowledge that this site will be National Code of Practice for the Construction Industry, Code
compliant and that the tenderer is required to be Code compliant?
3. Do you acknowledge receipt of all subcontract tender documents including trade specific items, drawings,
general preliminaries, specifications, programme, scaffold plan and temporary services plans?
4. Is your tender in full compliance with Tender Conditions, Specification and Drawings (attach list and
initial)?
5. Have you inspected the site in preparing your tender?
6. Do you accept that bills of quantities do not form part of your contract?
7. Do you accept that any rates provided are for the purpose of evaluating of progress claims and
variations?

PRELIMINARIES AND MATERIALS HANDLING
17. The tenderer is aware of Brookfield Multiplex’ plant that will be provided on this site and acknowledges
that the plant is suitable for his purposes and will be shared with other trades as allocated by Brookfield
Multiplex.
18. The tenderer has allowed for all horizontal handling?
19. Engineers Certification of temporary support or plant as required is allowed
20. Change room, lunchroom and storage sheds as required have been allowed in the tender?

22. Have you allowed for your own setting out from grids and datums supplied by Brookfield Multiplex?
23. Do you understand that the supply of electricity other than 240V is the subcontractor’s responsibility?
24. Only access lighting (indicated on the attached drawings) will be provided by Brookfield Multiplex.
Lighting required to carry out the work is the responsibility of the tenderer.
25. Have you allowed for protection of adjacent finishes, work in progress and completed work?
26. All scaffolding irrespective of height will be supplied and erected by the tenderer (apart from scaffolds
identified on the scaffold drawings)?
FINANCIAL
27. Insurances, will you have:-
(i) Contract Works Insurance to $2 million cover or the value of the Subcontract, which ever is the
lesser (Supply & Install Subcontracts only)
(ii) Public & Products Liability Insurance of at least $5 million
(iii) Workers Compensation Insurance in accordance with Statutory Requirements and insurance for
vehicles entering the site.
(iv) Professional Indemnity Insurance of at least $5 million (if required)
Do you acknowledge that Brookfield Multiplex and the Principal will be listed as named insurers on the
policies listed in items (i) and (ii) above prior to signing the subcontract agreement?
28. Cash retention will be 10% of each progress claim, up to 5% of the adjusted Contract Sum, or
alternatively 2 No. Bank Guarantees can be provided, each being 2 ½% of the Contract Sum
Note: If Bank Guarantees are provided as a form of retention, the wording must be in a form acceptable
to Brookfield Multiplex, they must be unconditional (with no expiry date), and be issued from a bank
located within Australia
29. In addition to retention, a Performance Bond or Bank Guarantee in the amount of ($ ) is
allowed and will be lodged by the tenderer before any payment claim can be made.
30. Do you acknowledge your requirements to comply with the applicable legislation concerning security of
payment?
CONTRACTUAL REQUIREMENTS
31. Both parties wish to avoid day labour totally, however, if circumstances prevail that prevent any other
arrangement, day labour will be charged at the rate of $ /hour.
32. Who is your Project Manager or Site Manager?
33. What experience and qualifications do they hold?
34. Do you accept that we will contra-charge you for costs incurred if you fail to carry out our instructions or
damage other trades work?
35. Do you understand that liquidated damages (LDs) will be charged at the same rate as Brookfield
Multiplex’s LDs under the Head Contract?
36. Do you understand for payments for offsite materials all Head Contract obligations regarding security,
insurance and deed of ownership must be fulfilled?
37. The tenderer will submit Progress Claims in lieu of tax invoices
38. Progress claims will be made monthly on the 25th day of each month including for work done or to be
done to the last day of the month. Payment will be made in accordance with the subcontract conditions.

39. Do you acknowledge that payments will be held if the information in Clause 42.1A of the Subcontract
agreement is not provided with your payment claim?

ANTI-CORRUPTION AND CONFLICT
43. The Subcontractor acknowledges it shall notify Brookfield Multiplex as soon as practicable of any breach
of any of the undertakings relating to anti-corruption.
44. The Subcontractor acknowledges it must not provide any services or works to a member of Brookfield
Multiplex's Workforce for the personal purposes of that member or their family members.
PROGRAMMING
45. Allowance is made for all shiftwork and overtime required to maintain the contract programme. Working
hours are determined by the approving authority and the tender has allowed to comply in all respects?
46. The tender amount includes allowance (time and cost) for delays due to weather and industrial matters.
47. The tenderer has allowed for loading of materials, plant and equipment and the like, during an after hours
shift if necessary
48. The tenderer is aware that the sequence of work may change and that temporary openings, critical areas
and the like would be performed out of sequence and all associated costs have been allowed in the
tender
EMPLOYEE RELATIONS
49. What is your employer registration number with the long service leave corporation?
50. Do you acknowledge the prohibition on strike pay in accordance with applicable legislation?
51. Do you acknowledge that you must not sub let contracts without written permission from Brookfield
Multiplex?
52. Do you acknowledge that you must immediately report to Brookfield Multiplex any threatened or actual
disputes or disagreements about workplace relations which can impact on the construction programme,
project costs or other site contracts?
Compliance with 6.1 of the Implementation Guidelines – legal obligations relating to employment
53. Name the instrument that regulates the employment of your employees. It may be an instrument such as
an award or an agreement certified, registered or otherwise approved under applicable legislation or a

54. Other than contracts of employment, do you have any unregistered written agreements that apply to one
or more employees? Unregistered written agreements which are not common law agreements with
individual employees are inconsistent with the Codes and Implementation Guidelines.

that ‘sham’ contracting arrangements are inconsistent with the Code and Implementation Guidelines.
56. Do you acknowledge your obligation to comply with all applicable workplace legislation including the
National Employment Standards?

maintained under the FW Act to Brookfield Multiplex for review upon request?

58. Do you acknowledge your obligation to comply with all relevant OH&S Acts, Regulations, Codes of
Practice established Standards, Compliance Codes & Industry Standards?
59. Have you developed a safety plan for this project with respect to Part O of the Subcontract Agreement?
60. Do you have Safe Work Method Statement (SWMS) and Risk Assessments for the work you are to carry
out for Brookfield Multiplex?
61. Have you inducted your workers into their relevant SWMS/Risk Assessments?
62. Do you have checklists that regularly check major safety controls involved in SWMPs?
63. Do you acknowledge that all workers s are to be inducted into site procedures prior to commencement of
work on site?
64. Are you able to verify that your workers hold all relevant licences and qualifications? Brookfield Multiplex
may require you to produced copies of such documents for inspection.
65. Have you ensured that all workers will be provided with all relevant personal protective equipment? The
minimum PPE requirements on a Brookfield Multiplex construction site is hard hat, steel capped boots,
high visibility vest, safety glasses, long sleeves and long pants. Additional PPE is to be provided as per
the task. All PPE is to be Australian Standards compliant
66. Do you acknowledge that Brookfield Multiplex will from time to time audit your safety performance?
67. The tenderer has allowed to pay all fees for, and attendance by all workers to an approved Safety
Induction Course
68. The tenderer has allowed for any worker to serve on the Safety Committee, and pay all costs involved
Supervision
69. Do you agree to provide an appropriately trained supervisor for your workers on site at all times? Does
your site supervisor and project manager have Cert IV in OHS Training
70. Do you acknowledge that the supervisor must be responsible for administering your OH&S Management
System and must at all times meet the requirements of the OH&S Act, associated legislation / standards /
codes of practice and the requirements of the Brookfield Multiplex OH&S Management System? This
responsibility includes obligations to:
 Ensure that all your workers and any sub-contractors (and their workers) engaged by you hold
and maintain appropriate qualifications/licences and participate in site-specific training;
 Actively monitor the performance of your workers and any sub-contractors (and their workers)
engaged by you on site to ensure that they follow instructions, act in accordance with their
training and otherwise perform their work, so far as is reasonably practicable, in way that is
safe and without risks to health;
 Ensure that all your workers and any sub-contractors (and their workers) engaged by you
have the necessary equipment and safety wear as per items 63;
 Provide reports to Brookfield Multiplex upon request concerning your compliance with safety
requirements.

71. Do you have a QA System established? If yes, to which standard?
72. Will you submit a Quality Management Plan and associated documentation incorporating inspection and
test plans in relation to the Project prior to commencing work on site?

74. Do you acknowledge that Brookfield Multiplex will periodically audit your QA Compliance?

these ratings in order to achieve the Green Star points allocated in the matrix identified for the project
