DERIVATION OF TITLE

On perusal of the Sale deed No. 1744/2005 of Thrikkakara SRO it can be seen that 2.34 Ares of land
in old survey 325/1-4 and R.Survey 236 in Block No.8 of Thrikkakara South now Kakkanad village
was given as plot no. 236 of Pattupurakal Town planning scheme to Mr. M. A. Abdul Rasheed s/o
Abu, Fathima Manzil, Kakkanad kara & village for constructing residential building for a total sale
consideration of Rs. 8/16/249/- and executed the above said Sale Deed No. 1744/2005 Thrikkakara
SRO on 26/03/2005.

The above said Mr. M. A. Abdul Rasheed sold the above said property to Mr. V. M. Abraham
as per Sale Deed No. 2742/2005 of Thrikkakara SRO. The said Sale Deed was not produced for
scrutiny.

The said V. M. Abraham sold the above mentioned property to one Mr. Dipu Viswanathan as
per Sale Deed No. 2134/2010 of Thrikkakara SRO for a total sale consideration of Rs. 25,00,000/-
lakhs on 27/09/2010.

On 11/11/2013 the above said Mr. Dipu Viswanathan sold the above said property having an
extent of 2.34 Ares of land for Rs. 48,00,000/- to Mr. Shinto Sebastian and Mrs. Sangeetha Jose,
Kallidikal House, Kizhakambalam and they were paid land tax for the period 2022-2023.

Going through the plan it is noted that the construction of basement floor, ground floor, first
floor and second floor of the building having total plinth area having 558.40m^2 have been
regularised by the Thrikkakara Municipality and completion plan has been approved.
On verification of the Encumbrance Certificate from 01/01/2000 to 18/05/2022 no liability
has been created by executing any registered document except the leased deed (Patta charthu) created
on 09/08/2016 as Deed no. 2491/2016.

ADVICE

1. Please verify the Encumbrance Certificate for the period from 18/05/2022 to till date.
2. Please see the original title deeds for verifying whether any equitable mortgage was created
by deposit of title deeds and the amount of total liability.
3. Please collect approved plan and regularisation details.
4. Please obtain land tax receipt for the period 2023-24.
5. Please obtain copy of all lease deeds.
6. Please obtain all prior deeds in original before execution of Sale Deed.
7. Please obtain copy of allotment order and application from GCDA.
