Greetings!!!

I have the honor to petition for the Cancellation of COC of KHAYZYNETH BANDAGOSA BANDAY
– aspirant for Sangguniang Kabataan Member of Barangay San Jose, Lupi, Camarines Sur in the October
30, 2023 Barangay and Sangguniang Kabataan Elections 2023 on the ground that A material
representation in her Certificate of Candidacy as required by law is false.

The undersigned petitioner is a registered voter both for Sangguniang Barangay and Sangguniang
Kabataan in precinct no. 0054C of Barangay San Jose, Lupi, Camarines Sur. My resident and postal
address is at Zone 3, San Jose, Lupi, Camarines Sur.

The respondent stated in item number 10 of her very COC a false statement. The respondent is in fact
with second degree blood relationship with Jesus C. Bandagoza, Jr. – incumbent Municipal Kagawad of
Lupi, Camarines Sur. The same respondent is the daughter of Sherna Bandagoza – Collantes, first-born
child of the aforementioned Jesus C. Bandagoza, Jr.

Section 2 of Republic 117681 as an amendment to Section 10 of Republic 10742 otherwise known as the
SK Reform Law of 2015 prohibits second degree kin of an incumbent-elected official of the locality to
seek SK position. Hence, the respondent should have not filed such Certificate of Candidacy since she is
disqualified to election in such office. In reference, the undersigned petitioner secured a Certification
from the Office of the Barangay Secretary of San Jose, Lupi, Camarines Sur stating the consanguineal
relationship between the respondent and the Mr. Jesus C. Bandagoza, Jr.

In view of the foregoing premises, the undersigned petitioner respectfully prayed for the cancellation of
the Certificate of Candidacy of the respondent.
