(a). EMD EXEMPTION: The bidder seeking EMD exemption, must submit the valid supporting document for the relevant
category as per GeM GTC with the bid. Under MSE category, only manufacturers for goods and Service Providers for
Services are eligible for exemption from EMD. Traders are excluded from the purview of this Policy./जेम क शत के अनुसार

1. The minimum average annual financial turnover of the bidder during the last three years, ending on 31st March of the
previous financial year, should be as indicated above in the bid document. Documentary evidence in the form of certified
Audited Balance Sheets of relevant periods or a certificate from the Chartered Accountant / Cost Accountant indicating the
turnover details for the relevant period shall be uploaded with the bid. In case the date of constitution / incorporation of
the bidder is less than 3-year-old, the average turnover in respect of the completed financial years after the date of
constitution shall be taken into account for this criteria.
2. Years of Past Experience required: The bidder must have experience for number of years as indicated above in bid
document (ending month of March prior to the bid opening) of providing similar type of services to any Central / State
Govt Organization / PSU / Public Listed Company. Copies of relevant contracts / orders to be uploaded along with bid in
support of having provided services during each of the Financial year.
3. Purchase preference to Micro and Small Enterprises (MSEs): Purchase preference will be given to MSEs as defined in
Public Procurement Policy for Micro and Small Enterprises (MSEs) Order, 2012 dated 23.03.2012 issued by Ministry of
Micro, Small and Medium Enterprises and its subsequent Orders/Notifications issued by concerned Ministry. If the bidder
wants to avail the Purchase preference for services, the bidder must be the Service provider of the offered Service.
Relevant documentary evidence in this regard shall be uploaded along with the bid in respect of the offered service. If L-1
is not an MSE and MSE Service Provider (s) has/have quoted price within L-1+ 15% of margin of purchase preference
/price band defined in relevant policy, then 100% order quantity will be awarded to such MSE bidder subject to
acceptance of L1 bid price. OM_No.1_4_2021_PPD_dated_18.05.2023 for compliance of Concurrent application of Public
Procurement Policy for Micro and Small Enterprises Order, 2012 and Public Procurement (Preference to Make in India)
Order, 2017.
4. Estimated Bid Value indicated above is being declared solely for the purpose of guidance on EMD amount and for
determining the Eligibility Criteria related to Turn Over, Past Performance and Project / Past Experience etc. This has no
relevance or bearing on the price to be quoted by the bidders and is also not going to have any impact on bid
participation. Also this is not going to be used as a criteria in determining reasonableness of quoted prices which would be
determined by the buyer based on its own assessment of reasonableness and based on competitive prices received in Bid
/ RA process.
5. Past Experience of Similar Services: The bidder must have successfully executed/completed similar Services over the
last three years i.e. the current financial year and the last three financial years(ending month of March prior to the bid
opening): -
1. Three similar completed services costing not less than the amount equal to 40% (forty percent) of the estimated cost;
or
2. Two similar completed services costing not less than the amount equal to 50% (fifty percent) of the estimated cost; or
3. One similar completed service costing not less than the amount equal to 80% (eighty percent) of the estimated cost.

1 The service provider/contractor must undertake to execute Agreement for the job before commenceme
nt of the work in the Bank's prescribed / standard format. The service provider shall bear all the costs an
d expenses in respect of all charges, stamp duties etc. of the agreement.

3 The service provider/contractor shall work in close coordination with the authorized official of the Bank o
f various establishments of SBI Kolkata Circle related to which the work has been awarded and the Bank
may modify working schedule if required as per convenience.

4 The Bank shall provide site for storage of machines, material and chemicals, in each ward, with minimu
m required infrastructure like Electricity, water supply etc., for which no rentals for space will be recover
able. However, no extra payment shall be admissible for carriage/ shifting etc.

5 No tools & plants including special Tool & Plants etc. shall be supplied by Bank. The service provider
ntractor must make his own arrangements at his own expense for all machines & equipment etc. which
must be in good working order and condition. No rental for use of below mentioned machines for cleanin
g of premises shall be paid by the Bank.

The service provider shall provide the following machines to its employee for proper cleaning of the
premises at its own cost.: -

i) Floor Scrubbing machine


ii) Shampooing machine

iii) Dry-wet Vacuum Cleaner

iv) Jet Pressure Cleaning Machine


v) Tiles Scrubbing machine
vi) Automatic Squeezer
vii) Road Sweeper machine

Over and above this equipment, the other equipment which are required for Housekeeping & Mainte
nance Services must also be provided.

6 T h e service provider /contractor shall dispose of garbage, malba, rubbish & other unserviceable
materials and waste (duly verified by the authorized officials of the Bank) at their own cost to the munic
ipal dumping area outside the Banks premises and under no circumstances these shall be stacked/ dum
ped even temporarily within the building or the surrounding premises. If, however, during the time of
posing the garbage to Municipal dumping ground, any penalty is imposed by statutory authorities like P
olice or Municipality Corporation etc. due to violation of statutory rules, the Bank shall not have any liabil
ities and the penalties so imposed must be borne/ settled by the service provider /contractor.

7 Materials and chemicals required will be supplied by the Bank as per indents submitted by the service p
rovider /contractor. The service provider /contractor should place the indent before the authorized offici
al of the Bank at least 15 days in advance. It may be noted that the material and chemicals required sha
ll be kept in the safe custody at the place given by Bank. The service provider should maintain a registe
r in this regard duly authenticated by the Bank.

8 The standard of sanitation/ cleanliness shall always be to the satisfaction of the authorized officials of th
e Bank whose decision in this regard shall be final and binding on the service provider /contractor.

9 There will be unskilled category of housekeeping and maintenance personnel in Branches, Regional Offi
ces and Administrative Offices. The service provider /contractor must provide one local representative a
t its own cost for every one hundred personnel allotted for better supervision and monitoring of houseke
eping and maintenance of RBOs/Zonal Offices/other establishments. The local representative shall be th
e first contact point between the service provider /contractor and the Bank. The local representative is r
equired to visit RBOs/Zonal Offices/ Branches at periodic interval or as and when required for supervisio
n of housekeeping and maintenance at RBOs/Zonal Offices/Branches. The local representatives shall me
et the authorized officials of the RBOs/Zonal Offices/Branches at periodic intervals and/or as and when a
dvised by the authorized officials of the RBOs/Zonal Offices/Branches for any issue related to housekeep
ing and maintenance of the premises. Non reporting to the authorized officials of the RBOs/Zonal
Offices/Branches within 24 hours without valid reasons shall attract penalty. Non reporting by the local
epresentatives of the service providers /contractor to the authorized officials of the RBOs/Zonal Offices/B
ranches for more than 3 occasions shall lead to termination of the contract with immediate effect withou
t notice of 30 days. Those service provider /contractors who have Branch office/representative office sh
all be preferred in allotment of job in that area of operation. The service provider /contractor shall have t
o furnish attested copy of lease agreement/Rental agreement of the representative office/ Branch office.
However, the service provider/contractor shall be offered work order in RBOs/Zonal Offices and its Branc
hes under control where they have at least one local representative whose name, mobile and email id s
hall be available with the authorized officials of the Bank. His KYC documents shall be submitted to the
authorized officials of the RBOs/Zonal Offices. The local representative must have the Identity Card of
e Company of the service provider /contractor. Nonrepresentation by the local representative of the
ice provider / contractor shall have the effect of disqualification/termination of the contract. In addition t
o local representatives, the service provider /contractor shall also provide name, mobile number, email i
d of at least two representatives who shall be contacted by the Branch Managers and other authorized
officials of the Bank in case of any requirement regarding housekeeping and maintenance services of th
e premises of Kolkata Circle. The Bank’s authorized officials may communicate to other authorized offici
als of the service provider /contractor including the directors/ managing directors of the company of the
service provider /contractor.

The service provider /contractor shall arrange the necessary water supply fitting, flexible pipe etc. for

king water from the water taps and extension wires for electricity tapping provided in the building for th
e work of housekeeping at his own cost. However, water & electricity will be supplied free of cost.

11 The service provider /contractor shall take at its own cost, if required, necessary insurance cover in res
pect of its employee engaged by it in connection with the mentioned services to be rendered to the Ban
k and shall comply with all relevant labour laws as applicable to the area as existing or as may be menti
oned during the contract period and shall indemnify Bank against all acts of omission, fault, breaches a
nd or any claim or demand, loss injury and expenses to which Bank may be party or involved as a result
of the service provider’s failure to comply with and of the obligation under the relevant act law which th
e service provider /contractor has to follow.

12 The service provider /contractor shall supply its employee with sufficient sets of uniforms so that they k
eep them clean by washing on alternate days. The service provider /contractor shall provide ready to w
ear uniforms. The colour and type of uniform may be discussed with the appropriate authority of the Ba
nk before delivering to their employee. Minimum two sets of uniform (shirt and trousers), one black
her shoe once a year and a woolen sweater in two years. The uniform must have logo of the service pro
viders /contractor. The original bill of the uniform, shoe and woolen sweater purchased by the service
ovider /contractor for its employees engaged in different establishments of SBI Kolkata Circle shall be pr
oduced for verification by the authorized officials of the Bank.

13 All the materials/ consumables brought to site shall be protected suitably duly wrapped/ packed & store
d to avoid any damage during loading/ transportation/ unloading and due to weather conditions etc. at
any stage.

14 The service provider /contractor must properly maintain the machinery required for the cleaning purpos
e, for which it must enter an AMC with reputed company at its own cost. The service providers /contract
or needs to provide for alternative machine (s) immediately in case of deficiencies of any machinery.

15 The materials/consumables used for housekeeping and maintenance should be Eco-friendly, Bio-degrad
able and of international quality.

16 The work in general shall be carried out in accordance with the scope of work mentioned in annexure- G
and instructions issued from time to time by the appropriate authority of the Bank.

17 The work shall be carried out in the manner complying in all aspects with the requirements of relevant b
ye-laws of the local body under the jurisdiction of which the work is to be executed or as directed by the
Bank & nothing extra shall be paid on this account.

18 The service provider /contractor and its employees must follow strictly all safety precautions required fo
r handling machines, electrical power, work on heights etc., and the Bank will not be responsible for any
losses. The service provider /contractor must provide sufficient safety gears to its employees.

19 The service provider /contractor shall comply with proper & legal orders & direction of the local public a
uthority or municipality and abide by their rules & regulations & pay all fees & charges which may be le
vied from time to time.

20 The service provider /contractor shall execute his work in such a manner that no damage is made to th
e existing structure.

21 The service provider /contractor shall conduct its work so as not to interfere with or hinder with the oper
ations of the Bank, or it shall arrange its housekeeping and maintenance work with that of the others i
n an acceptable & coordinated manner & shall perform it in proper sequence to the complete
satisfaction of Bank.

22 Existing drains, pipes, cables, overhead wires, sewer lines, water lines and other services encountered i
n the course of the execution of the work shall be protected against the damage by the service provider
s /contractor. The service provider /contractor shall not store materials or otherwise occupy any part of t
he site in a manner likely to hinder the operation of such services.

23 The service provider /contractor shall ensure quality work in planned and time bound manner. Any sub-
standard material/ work beyond set out tolerance limits shall be summarily rejected by the Bank and Ba
nk reserves the right to terminate the agreement.

24 The Bank shall not be responsible for any loss of material of the service provider /contractor at the site.

25 After execution of work, the service provider /contractor shall store the cleaning material & equipment i
n proper and organized manner at the place provided by the Bank.

26 Income Tax as per Income Tax Rules & Goods and Service Tax as per applicable Rules shall apply. Appli
cable GST on Bill amount will be paid by the Bank. Any other tax imposed subsequently by the statutor
y authorities, must be borne by the service provider /contractor. A proof of payment of GST of previous
month to be provided with the present bill. A proof of payment of ESI, PF, Professional Tax and other sta
tutory payments of all employees of previous month and a declaration by the authorized signatory of the
service provider /contractor that all statutory payments of the previous month has been paid to be provi
ded with the present Bill. Bank shall not pay bills which are not accompanied with aforesaid documents.

27 The antecedent of all the employees deployed by the service provider /contractor must be verified from
the police and a report to be kept in record. A copy of police verification report to be submitted at the
onal Offices/RBOs/branches where the employees have been engaged by the service providers /contract
or. The service provider's workers shall not enter into any unlawful activity within the Bank's premises a
nd shall have good moral character.

28 All the initial cleaning works of the branches/offices must be completed half an hour before start of the f
unctioning of branches/offices every day.

29 The service provider /contractor shall not assign the contract. He shall not sub-let any portion of the con
tract to any person or entity and in the event of any violation or breach thereof, the Bank may at its disc
retion but without prejudice to its other rights and remedies terminate this contract.

30 The Bank reserves the right to advise the service provider /contractor to replace any employee of the
rvice providers /contractor deployed at branches/offices at short notice if the Bank finds the employee of
the service provider /contractor unsuitable/unfit for carrying out his job in Bank’s premises and/or to im
prove service and maintain the standard of the Bank’s premises.

31 Utmost care shall be taken by the employees of the service provider/contractor to keep the noise level t
o the minimum so that no disturbance as far as possible is caused to the staff of the branch/offices.

32 No inflammable materials shall generally be allowed to be stored at site. However, reasonable quantity
may be permitted for storage subject to the compliance of all rules/ instructions issued by the competen
t authorities and as per direction of Bank. The site for storage of aforesaid materials will be selected by
the competent authority of the Bank who will verify the quantity and quality of the materials.

33 In the event of any restriction being imposed by the Security agencies, Bank or any other authority havi
ng jurisdiction in the area on the working or movement of labour/material, the service provider /contract
or shall strictly follow such restrictions and nothing extra shall be payable to the service provider on thi
s account.

Some General Instructions are given as under.

a) Labour huts/ stay of workmen will not be allowed at site/ in the

Bank's premises.

b) Proper Photo Identity cards to be given to the employees.

c) As and when there will be security requirements, certain additional

restriction can be imposed as per the requirement of the situation.

d) The service provider /contractor shall be responsible for behaviour and conduct of

its employees. No employee with doubtful integrity and unproven past record

shall be engaged by the service provider /contractor. The employee should not consume

alcohol or any addicted products at workplace.

34 No payment shall be made for any damage caused by rain, snowfall, flood or any other natural calamity
, whatsoever during the execution of the work.

35 The service provider /contractor shall engage the services of agreed number of efficient, clean, healthy,
honest, well-behaved, able bodied, medically fit, agile personnel /workmen preferably within age group
of 18 years to 45 years. The service provider /contractor shall be responsible for the good conduct and
performance on the part of its employees. Replace the employees on attaining the age of 6 years with m
utually agreed terms & conditions.

36 The service provider /contractor shall have to maintain account with SBI and have to quote their SBI acc
ount Number while submitting bills for credit of proceeds of the bill.

37 The Contract is for providing services and is not for supply of Contract Labour /employee and that the pe
rsons employed by the service provider/contractor for providing the housekeeping and maintenance
vices more fully described in Scope of Work in annexure - G, shall be the employees of the service provi
der /contractor and not of the Bank.

38 The service provider /contractor shall be responsible for the training, allotment of duties, hours of work
and timings to its engaged employee for the purpose. The service provider /contractor shall alone have
the right to exercise control, give directions and manage the employees engaged for these purposes.

39 The service provider /contractor shall bear all costs and expenses and stamp duty in respect of all agree
ments that may be entered into with the Bank to give effect to this arrangement.

40 All questions relating to the performance of the obligations under this agreement and to the quality of
materials used in respect of the services and all the disputes and differences which may arise either dur
ing or after the agreement period or other matters arising out of or relating to this agreement or payme
nt to be made in pursuance thereof shall be referred to the Bank, whose decision shall be final, conclusi
ve and binding on the service provider /contractor.

41 All the taxes which the Bank may be liable to deduct or called upon to deduct, during the currency of th
e arrangement which are liable to be payable by the service provider /contractor under the law but not s
o paid, shall be set off against the bills raised by the service provider /contractor and/or Security deposi
t kept as STDR and Bank guarantee with the Bank by the service provider /contractor and paid to the res
pective government departments or authorities as may be required under law.

42 The service provider /contractor must submit their printed bills duly signed by authorized person of the
service provider /contractor under Rubber stamp of the company.

43 The service provider /contractor must give an undertaking that they will fulfill all criteria under applicabl
e Labour Act, Minimum wages Act, Employees PF Act, Workmen Compensation Act, etc.

44 The service provider /contractor should ensure strict and meticulous compliance of Contract Labour (Regulati
on and Abolition) Act, 1970 and The Contract Labour (Regulation and Abolition) Central Rules, 1971 and vario
us other applicable Acts and maintain all records, documents and all necessary registers as given therein.

5. Register of overtime (Form XXIII)

6. Other register as applicable from time to time.

The service provider /contractor shall be solely liable and responsible for payment of Minimum Wages as
45 r the Minimum Wages Act, 1948, PF Contribution, ESIC Contribution, etc. and other applicable statutory dues
to the employees, during the Contract period. The applicable rate for payment of minimum wages shall be t
he rate of minimum wages notified by the Central Government from time to time in respect of Unskilled
egory (Cleaner) “Employment of Sweeping & Cleaning”. Any legal case/expenses/penalty arising out of viola
tion of any provisions of Minimum Wages Act or any other Act, Rules or Regulations shall be at the cost of
e service provider/contractor o n l y and the Bank shall not be responsible f o r the same. Financial
liabilities/legal complications devolved against the Bank due to violation of Minimum Wages Act or any othe
r Act, Rules or Regulations by the service provider /contractor will be recovered from the service provider
ontractor / from the amount payable to the service provider /contractor and/or by the Security deposit kept
as STDR and Bank guarantee by the service provider /contractor to the Bank while awarding the contract.

The service provider /contractor shall pay monthly wages of previous month to their employee of housekeepi
ng and maintenance services engaged in branches/offices of SBI, Kolkata Circle by 7 th of every month and cl
aim reimbursement from the authorized officials of the Bank only after payment of ESI and PF of their employ
ee and submission of respective acknowledged copy of challans. The Bank shall make all endeavour to reim
burse within 15 days from the date of the receipt of the invoice along with certificate and documentary
ence like copy of details of wages paid to the employees in their account numbers of SBI branches along wit
h list of employees with their account numbers , copy of challan of PF, ESI, Professional tax etc. paid to the a
ppropriate statutory authorities and list of employees for which statutory payments have been made and Att
endance sheet of employees of the service providers/contractors at Branches/offices of SBI Kolkata Circle.

The Bank shall be entitled to deduct in accordance with Applicable Law, Income Tax or other deductions (as t
he case may be), from any payments made to the Contractor, and the amount so deducted shall be deemed
to be a payment made to the Contractor/service provider. The Bank shall provide a certificate certifying the d
eduction so made.

46 The applicants/service providers, upon selection, will have to furnish a Security deposit as STDR (50% of 26
days wages) and Bank Guarantee (50% of 26 days wages) or STDR (100% of 26 days wages) for an amount
equivalent to 26 days wages of the number of employees engaged by the applicants/service providers so e
mpaneled by the Bank. The empaneled service providers may submit entire amount equivalent to 26 days
wages of the number of employees engaged in the form of interest bearing STDR maintained at any branch
es of SBI with a lien on State Bank of India, Office Administration Department, Local Head office, Kolkata. T
he Bank Guarantee shall be issued from a scheduled commercial Bank other than co- operative bank and S
BI, acceptable to the Bank. The Bank Guarantee shall have a validity period of 30 months. Bank Guarante
e and or interest bearing STDR has to be submitted within 7 days of the receipt of intimation from the Bank
about acceptance of its bid offer by the Bank. For any delay in submission of the Bank Guarantee and intere
st bearing STDR beyond the stipulated period, the selection of such applicant/ service provider shall be ter
minated and the EMD shall be forfeited.

In case, the service provider/contractor fails to complete the contractual obligations as per agreement or lea
ves the job half way or do not undertake the jobs at site within stipulated period, Bank shall forfeit the said
curity deposit together with interest accrued on said security deposit/invoke Bank guarantee. The Security d
eposit/Bank guarantee would be finally refunded after three months from the date of expiry of contract subje
ct to the conditions that no losses are incurred to the Bank due to the service provider or their employees an
d all statutory dues have been cleared.

47 The Bank will pay minimum wages issued by Ministry of Labour & Employment, Govt. of India, as per area cla
ssified by Central Government. However, a uniform management fees @3.85% of the order vaule
per GeM notification (Department of expenditure, Procurement Policy Division) dated 06/01/2023. While deci
ding upon the selection of the service provider to award /allocation of housekeeping works for the Bank's pre
mises (rental / own building), emphasis will be given on the ability, work experience in housekeeping and ma
intenance in Banks and Financial institutions having multistoried buildings, satisfactory report from clients an
d competence of applications to do good quality works. Decision of the Bank in regard to enlistment of servic
e provider and awarding the works will be final and binding on the tenderers. The Bank is not bound to assign
any reason for its decision.

48 The Courts in Kolkata city alone shall have the jurisdiction in respect of any or all matters relating to or conn
ected with the Tender.

49 The service provider shall indemnify and keep indemnified the Bank against all losses and claims, damages a
nd compensation for breach of any provisions of the payment of wages Act 1936, Minimum wages Act 1948,
Central labour (Regulation and Abolition) Act 1970,ESI, PF, Professional Tax, GST and any other law/statute in
force in this regard.

50 If any money, because of any instructions from the Labour authorities or claim or application made under an
y of the Labour laws, or Regulations, ESI authorities, PF authorities, GST authorities etc., is directed to be pai
d by the Bank, such money shall be deemed to be payable by the service provider /contractor to the Bank
thin seven days. The Bank shall be entitled to recover the amount from the service provider and the Bank
will recover from money due to the service provider or from their Security Deposit or by invoking Bank guara
ntee.

51 Any liability arising out of any litigation (including those in consumer courts) due to any act of the employee
of the service provider /contractor and /or the service provider /contractor shall be directly borne by the
ce provider /contractor including all expenses/fines.

52 Any overpayment detected in Internal Audit of the Bank in respect of any work done by the service provider
contractor under this contract shall be recovered by the Bank from the service provider and the service provi
der undertakes to return / refund the same unequivocally and unconditionally to the Bank on first demand/ in
timation itself. In case of nonpayment by the service provider /contractor, the Bank shall be entitled to recov
er the amount from the service provider and the Bank will recover from money due to the service provider
from their Security Deposit or by invoking Bank guarantee.

53 The service provider /contractor shall ensure compliance with all the tax laws in India with regard to this
ract and shall be solely responsible for the same. The service provider /contractor shall keep the Bank fully in
demnified against liability of tax, interest, penalty etc. of the service provider /contractor.

54 The service provider /contractor shall indemnify and hold the Bank harmless from and against all claims,
mages, losses and expenses arising out of, or resulting from the works/services under the contract provided
by the service provider /contractor.

55 The service provider /contractor and its employees, shall take proper and reasonable precautions to protect
he Bank from loss, destruction, waste or misuse of areas of their responsibility given to it by the Bank.

56 All liabilities arising out of accident or death of the employees of the service provider /contractor, while on
ty shall be borne by the service provider /contractor. It is also made clear that all liabilities arising out of viola
tion of any local laws/central laws/ Rules/Regulation shall be of the service provider’s Responsibility and the B
ank shall be indemnified by the service provider /contractor in this regard.

57 If at any stage, even after empanelment, it comes to the notice of the Bank that the service provider /contrac
tor had used fraudulent methods or falsified documents to obtain the contract, the Bank would be at its libert
y to terminate the contract without any notice and a penalty as deemed appropriate by Bank including forfeit
ure of the Earnest Money Deposit/Security Deposit/invocation of Bank guarantee, would be imposed on the
ervice provider /contractor. The service provider /contractor would also stand de-empaneled. The imposition
of such penalty/forfeiture of EMD/Security Deposit/invocation of Bank guarantee shall be conclusive, non-obj
ectionable and binding upon the service provider /contractor.

58 The service provider /contractor shall be responsible for all the claims whatsoever for its employees and the
aid employees of the service provider /contractor shall not make any claim against the Bank. The service pro
vider’s employees shall not have any right whatsoever to get absorbed in the Bank.

59 The Bank may terminate the contract if it is found that the service provider /contractor is blacklisted on previ
ous occasions by any of the Banks/Institutions/Local Bodies/Municipalities/Public Sector Undertakings, etc. bu
t concealed the same while applying for empanelment.

The service provider /contractor who have defaulted in payment of minimum wages as per Central governme
nt notification and other statutory liabilities viz. ESI, PF, GST, Professional tax, other taxes etc., and/
delayed in payment of minimum wages as per Central government notification and other statutory liabilities
viz. ESI, PF, GST, Professional tax, other taxes etc., more than 30 days from the due date of payment will be
disqualified from empanelment and /or terminated from continuing the services under the contract.

60 The Bank reserves the right to accept or reject any of the tenders without assigning any reason whatsoever.
The Bank also reserves the right to amend/modify any of the terms of the Tender if necessary.

61 The service provider /contractor shall strictly comply with all Labour laws and such other statutory Laws i
n relation to the services to be provided by the personnel engaged by the service provider /contractor an
d the service provider /contractor shall be solely responsible for all acts of the said personnel so enrolled
and there shall and will not be any privity of contract for any purpose and to any intent between the Ban
k and said personnel so engaged by the service provider. The Bank shall neither be liable nor answerable
in respect of any claims or demands in respect of any matter or on any account which may be raised by
the said personnel so engaged by the service provider /contractor and it shall be the sole responsibility a
nd liability of the service provider /contractor to answer all such claims or demands of the said personnel
so engaged, under any law for the time being in force.

62 The number of working days of the employees of the service provider in a month will be taken as 26 days wh
ich may be changed as per the advice of the appropriate authorities

63 Proper Safety Gears/Protective arrangements must be maintained by the employee of the service provider
ontractor at the time of housekeeping and maintenance service.

64 The contract for Housekeeping & Maintenance Services shall be for a period of two years from the date of
awarding of the contract subject to review after six months and satisfactory performance as mentioned h
ereinabove. The contract shall be terminated on the expiry of two years or earlier by one month’s notice
at the option of the Bank in the event of unsatisfactory performance or on breach of any of the stipulated
conditions or qualitative dimensions of the various services agreed upon by the service provider / Contra
ctor under these presents. The service provider /contractor may, after giving three months’ notice to the
Bank terminate the contract, if he so desires at any time during the course of the currency of this agreem
ent. If the contract is terminated as stated above, the service provider shall be entitled to the payment u
p to the date of termination for the work already performed.

The contract shall be subject to renewal thereof at the discretion of the Bank.

67 The service provider /contractor shall appoint/transfer/rotate/replace its employees engaged in Branches
/offices of SBI Kolkata Circle as per their HR policy with due intimation to the authorized officials of the Ba
nk.

(i) be under influence of liquor/drug while on duty.
(ii) engage himself in any argument or unnecessary conversation with anyone while on duty.
The service provider /contractor shall ensure that there is no violation of any statute; and all the laws, rules

employee engaged for housekeeping and maintenance services in Branches/offices of SBI Kolkata Circle.

In the event of any unusual situation which may result in loss of life and property of the Bank, the employee
70 of the service provider /contractor shall inform the staff of the Branch/offices immediately to avoid any unto
ward incident.

71 The service provider /contractor should have in place Know Your Employee Policy and system for engaging
housekeeping and maintenance staff, including thorough background check, police verification report and a
ntecedent’s verification etc. at the time of appointing their employee. As and when demanded by the Bank,
the service provider /contractor shall produce the same for verification and record.

72 The employees engaged by service provider /contractor shall be the employees of service provider/contract
or and in no event the employee of the service provider /contractor shall be deemed to be the employee of
State Bank of India. State Bank of India is not responsible/ liable to the employee of the service provider /co
ntractor for payment of wages (as per Minimum Wages act), PF Contribution, ESIC Contribution, etc. and oth
er applicable statutory dues to the employee of the service provider /contractor. No liability on account of p
ayment of wages (as per Minimum Wages act), PF Contribution, ESIC Contribution, etc. and other applicable
statutory dues shall devolve upon on State Bank of India. The service provider /contractor shall indemnify S
tate Bank of India against all losses, damages, expenses and claims which State Bank of India may suffer/in
cur or which may be against State Bank of India in respect of the said service provider /contractor.

73 The service provider/contractor shall indemnify State Bank of India to the full extent (including the legal cos
t and reimbursement of Attorney's fees and incidental expenses thereto) in the event of any non-complianc
e of any law, notification, orders etc. and for any claim from any statutory authority arising out of non-compl
iance of the aforesaid or otherwise in relation to the Services or any claim, right, demands etc. raised by an
y employees of the service provider /contractor. Without prejudice to any other rights of State Bank of India
to recover the indemnity amount from the service provider /contractor, SBI shall be entitled to deduct/ensur
e the deduction of the indemnity amount or part thereof from the charges payable to the service provider
ontractor under the payment arrangement mentioned in the tender and Security Deposit (STDR and Bank g
uarantee )

74 The Bank shall be entitled to adjust the dues out of monthly bills or Security Deposit (STDR and Bank guara
ntee ) towards loss or damage caused by the service provider /contractor or its employee in case of any
ft, breakage, pilferage of any items, fixtures, equipment etc., or any other liability of the service provider
ontractor.

75 The service provider /contractor shall also permit the Bank to hold or deduct the amount from the bills/secur
ity deposit (Bank guarantee and STDRs) for non-performance or part performance/ substandard performanc
e or failure to discharge obligations as more specified in Scope of work (Annexure-G)

76 The service provider /contractor shall obtain at its own cost, any license or permission of any sort whatsoev
er viz. Labour license from Assistant Labour Commissioner and register with Employees‘ State Insurance Cor
poration and Office of the Regional Provident Fund Commissioner, etc. that may be required under various
Acts of the Central/State Government Authorities, for carrying out the housekeeping and maintenance activi
ty in the premises of the Bank and such Registrations and License as may be deemed necessary for engage
ment of its employees for such purpose.

77 The service provider /contractor shall comply with all the provisions of all Labour Laws/statutory law, which
are applicable to the service provider /contractor or its employees and shall be solely responsible for liabiliti
es arising out of such compliance, non-compliance or implementation or non-implementation thereof. The
ervice provider /contractor shall furnish proof of compliance of all Labour Laws/ statutory requirements inclu
ding obtaining licenses, filing of monthly/quarterly and annual returns as the provisions may be, at the earli
est and furnish proof at the earliest of payments/challans, made to all Government/Statutory Authorities
der EPF, ESIC, etc. within the statutory time limit allowed under the respective Acts and all other statutory r
ules as amended from time to time

78 The service provider /contractor shall indemnify the Bank from and against all liabilities, claims and demand
s arising out of any payments or reimbursement made by the Bank to Government (Central/State, Semi- Go
vernment), statutory authority or any payment made under any statute/notification of the Government (Cen
tral/State) or statutory authority in respect of the employees of housekeeping and maintenance service of
e service provider /contractor and /or the service provider /contractor itself or in respect of any claims made
by the employees of housekeeping and maintenance service of the service provider /contractor against the
Bank. The service provider /contractor shall promptly reimburse State Bank of India all payments made, an
d expenses incurred by the Bank in respect of the payments referred to above in this para.

79 The service provider /contractor shall submit the list of its employee of housekeeping and maintenance serv
ices to be deployed/ already deployed at the respective Branch/offices of SBI, Kolkata Circle, along with thei
r personal details like name, age, date of birth, permanent address, photograph, PF number, ESI number sa
vings bank account number of SBI for credit of their wages, etc. The service provider /contractor shall provi
de proper laminated, tamper-proof identity cards to all its employee engaged in Branches/offices of SBI Kolk
ata Circle.

80 The service provider /contractor shall ensure that the working hours and other service conditions of employm
ent of the contract labour is in consonance with all applicable laws and rules, including Contract Labour (Reg
ulation and Abolition) Act etc. The service provider /contractor should maintain a proper attendance register
of all the workmen or employee engaged by the service provider /contractor and should update it regularly a
nd keep proper record of leave availed by the employee or workmen supplied by the service providers /contr
actor in compliance with the statutory norms.

81 The service provider/contractor shall be responsible for any loss caused due to theft/pilferage/damage to th
e Bank’s property including the fittings, fixtures, furniture or other equipment, entrusted in his charge or any
property belonging to the Bank / guests / customers when such a loss / damage is, in the Bank’s opinion, cau
sed due to negligence or carelessness or any fault on contractor’s part or that of his supervisor or any of the
contractor’s employees and the contractor shall be liable to pay to the Bank such amount in respect of such
damages / losses as may be assessed by the Bank. Further the contractor shall personally be responsible for
good conduct and satisfactory antecedents of the contract workmen/staff employed by contractor

82 The Bank shall not be responsible for any compensations or otherwise for any injury/death caused to any of t
he workmen of the contractor while executing the work under this tender.

83 The service provider shall not permit any of its employees to use any area of the premises / building of the B
ank for residential or any other purposes.

84 The service provider shall be entirely responsible for any mis-happening, accident to its employees while perf
orming duty and shall have no claim/binding on Bank with respect to any compensation/monetary benefits et
c., whatsoever

85 If Bank requires additional outsourced personnel for housekeeping & maintenance for any of its offices/reside
ntial buildings at Kolkata/any part of West Bengal, Sikkim and Andaman & Nicobar then Bank may at its discr
etion can issue requisition for the work to same service provider/contractor or to the other empaneled
service providers /contractors on the same terms & conditions.

86 The disputes relating to the meaning of the specifications, quality of workmanship or materials used on the w
ork or as to any questions, claim, right, matter or thing whatsoever and any way arising out of or relating to t
he contract, specifications, instructions, orders or these conditions or otherwise concerning the work or the e
xecution or failure to execute the same, whether arising after the cancellation, termination, completion shall
be dealt with as mentioned hereinafter. The service provider/contractor shall forthwith give notice in writing
of his claim or dispute to the Bank within 30 days from the date of disallowance thereof or the date of deducti
on or recovery. The said notice shall give full particulars of claim, grounds on which it is based and detailed c
alculations of the amount claimed and the contractor shall not be entitled to raise any claim nor shall the Ban
k be in any way liable in respect of any claim by the service provider unless notice of such claim shall have b
een given by the service provider to the Bank in the manner and within the time as aforesaid. The service pro
vider/contractor shall be deemed to have waived and extinguished all his rights in respect of any claim not n
otified to the Bank in writing in the manner and within the time aforesaid.

87 In case of labour unrest/disputes arising out of non-implementation of any labour law/statutory law etc., the r
esponsibility shall solely lie with the service provider /contractor and it shall resolve the same satisfactorily a
t its cost and risk. The service provider /contractor will abide by rules, regulations, bylaws and statutes etc. f
or executing for his job.

88 Nothing contained in the contract is intended nor shall be construed to be a grant, demise or assignment
in law of the premises or the articles/equipment or any part thereof by the Bank to the service provider /c
ontractor and/or its employees and the service provider/contractor and/or its employees shall vacate and
handover the same in good working condition and order upon termination of these presents either by effl
ux of time or otherwise.

89 Reduction in the number of employees/personnel engaged by the service provider /contractors in housek
eeping and maintenance services in premises of Kolkata Circle due to death/retirement of its employee/ r
esignation of service by its employee/ termination of employment of its employee by the service provider
/contractor shall not be substituted with new employee/personnel without the written approval of the OFF
ICE ADMINISTRATION DEPARTMENT, LHO, Kolkata for such induction of personnel/employee. However, rel
iever arrangement for a very short period in those premises may be made with the approval of the autho
rized officials of the Branches/RBOs/Zonal Offices. Any violation of this clause shall attract penalty includi
ng termination of the contract.

90 All questions relating to the performance of the obligations under this agreement and to the quality of m
aterials used in respect of the services and all the disputes and differences which shall arise either durin
g or after the agreement period or other matters arising out of or relating to this agreement or payment t
o be made in pursuance thereof shall be referred to The Asst. General Manager ( Office Administration D
epartment), State Bank of India, Local Head Office, Kolkata, in the Bank, whose decision shall be final, co
nclusive and binding on the service providers.

91 The service provider/contractor shall be responsible to attend all complaints/requirements within the pur
view of the contract. It/its employees shall also be responsible to communicate immediately any complai
nt of sickness, mishap, accident, any crack in the building, any fire, anything which may lead to damage
of the person and property of the Bank including the employee concerned, etc. to the authority as decide
d by the Bank.

92 The service provider /contractor shall provide for pest control measures against flies, mosquitoes and ter
mites and rodents and also execute fogging all around the campus at regular intervals duly authorised b
y the concerned officials of the Bank. The materials related to pest control measures shall be supplied by
the Bank. The service provider /contractor must ensure proper precaution so that pest control measures
shall not harm person/property of the Bank. The service provider /contractor must ensure that its employ
ee should be provided with safety gear at the time of pest control measure

93

Accepted tender will be valid for a period of two years (validity of bid) from the date of acceptance of tender
which may be extended for a further period of 6(six) months subject to agreement

94 In respect of employees engaged by the service provider /contractor for the performance of the works in SBI
premises, the service provider /contractor shall at its own expense arrange for all the safety provision as per
relevant provision of law.

The employees engaged by the service provider /contractor shall not be permitted to hold any agitation in a
ny of such forms like lunch-hour demonstration / stoppage of work / strike / dharna or of any other form insid
e the premises of the Bank. If any such things happen, the service providers / contractor shall immediately
eplace those employees found guilty of indulging in such activities. In the event of failure of the service provi
der /contractor to do so, The Bank will have the right to engage other employees through any other empan
eled service provider /contractor for taking care of the emergency situation and the charges for the same are
to be deducted from the unpaid / subsequent bills payable to the service provider /contractor / security depo
sit held by the Bank. If no bills are pending or the outstanding bill amount is found to be insufficient, the
service providers contractor shall reimburse the amount paid by SBI within 7 days from the date of payment
by SBI.

95 Besides fulfilling other eligibility Criteria, and after completion of scoring exercise through evaluation matrix,
all the applicants/ Service Providers who will score 55 marks or above or as per the discretion of the Selectio
n Committee, may be considered for bucket of successful Service Providers. The successful Service Providers
will then be shortlisted in descending order of their marks, subject to maximum 10 (ten) bidders, for em
panelment by the Bank as per the Bank’s requirement and Financial Bid of shortlisted Service Providers will b
e opened. The number of service provider for providing the proposed work as detailed in the RFP
should not exceed 10 (Ten). L1 rate must not be less than 3.85% of the order vale as per GeM no
tification (Department of expenditure, Procurement Policy Division) dated 06/01/2023. The Servic
e Provider who has quoted L1 rate (out of shortlisted applicant/ Service Provider) will be awarded 3% more jo
b than the other shortlisted Service Providers as per the bank’s requirement/decision of the committee. Subje
ct to consideration by the empowered committee, Shortlisted Service Providers other than L1 may be allotte
d work if they agree to work on L1 rate. If there will be more than one shortlisted Service Provider quoting L1
rate, then Bank will allot work depending on marks obtained in technical bid (Evaluation Matrix) and site visit
report as per Annexure – 11. Bank will decide the allocation of number of manpower to L2, L3, L4, L5, L6,
L8, L9 & L10 bidder, after allocating the number of manpower to L1 bidder, as per the marks obtained throug
h evaluation matrix. Site visit report will form part of evaluation matrix and site visit report as per Annexure
– 11.

The additional terms and conditions have been incorporated by the Buyer after approval of the Competent Authority in
Buyer Organization, whereby Buyer organization is solely responsible for the impact of these clauses on the bidding
process, its outcome, and consequences thereof including any eccentricity / restriction arising in the bidding process due
to these ATCs and due to modification of technical specifications and / or terms and conditions governing the bid. Any
clause(s) incorporated by the Buyer regarding following shall be treated as null and void and would not be considered as
part of bid:-

1. Definition of Class I and Class II suppliers in the bid not in line with the extant Order / Office Memorandum issued
by DPIIT in this regard.
2. Seeking EMD submission from bidder(s), including via Additional Terms & Conditions, in contravention to

7. Floating / creation of work contracts as Custom Bids in Services.
8. Seeking sample with bid or approval of samples during bid evaluation process.
9. Mandating foreign / international certifications even in case of existence of Indian Standards without specifying
equivalent Indian Certification / standards.
10. Seeking experience from specific organization / department / institute only or from foreign / export experience.
11. Creating bid for items from irrelevant categories.
12. Incorporating any clause against the MSME policy and Preference to Make in India Policy.
13. Reference of conditions published on any external site or reference to external documents/clauses.
14. Asking for any Tender fee / Bid Participation fee / Auction fee in case of Bids / Forward Auction, as the case may
be.

Further, if any seller has any objection/grievance against these additional clauses or otherwise on any aspect of this bid,
they can raise their representation against the same by using the Representation window provided in the bid details field
in Seller dashboard after logging in as a seller within 4 days of bid publication on GeM. Buyer is duty bound to reply to all
such representations and would not be allowed to open bids if he fails to reply to such representations.

This Bid is governed by the General Terms and Conditions/सामा य िनयम और शत, conditons stipulated in Bid and
Service Level Agreement specific to this Service as provided in the Marketplace. However in case if any condition
specified in General Terms and Conditions/सामा य िनयम और शत is contradicted by the conditions stipulated in Service
Level Agreement, then it will over ride the conditions in the General Terms and Conditions.
