Dear Henry:

Congratulations on the opportunity to grow your career with us! We are delighted to extend
this conditional offer of employment to you for the position of
General Production 2nd Shift at Smithfield Fresh Meats Corp. based in Tar Heel, NC. This
position reports to Production Supervisor. If you accept this offer, and the contingencies
outlined below are satisfied, your start date will be confirmed with you once you
successfully complete the prescreening requirements.

The details of this offer are as follows:

o Hourly Pay Rate: $17.65/hour payable weekly on Fridays Via direct deposit or
another method you selected.
o Reporting To: Production Supervisor
o Tentative Start Date: TBD
o Health & Welfare Benefits: You will be eligible to participate in the medical, dental,
vision, disability and life insurance benefit programs upon completion of 90
continuous days of full-time active employment with the Company. Eligible
employees will be covered on the 91st day of employment. Details of these benefits
are enclosed.

Please note that the benefit and retirement plans offered by the Company are subject to
change at any time in the Company’s sole discretion. The plans in place at the time that
you are hired may be discontinued, replaced or amended.

Contingency: This offer is contingent upon your successful completion of our pre-
employment drug and background screening. You must complete the drug test within two
(2) business days of accepting this offer by signing and returning this offer letter. In some
cases, the Company may allow you to start your employment before the completion of
your background screening. In such cases, your continued employment will remain
contingent on passing the background screening. You will be notified when all
contingencies have been lifted.

As an additional condition of your employment you agree that you, in performing your
duties for the Company you will not disclose to the Company or otherwise use any of the
confidential information that you obtained from any prior employer.

You must also complete Form I-9 on your first day of employment and present the
appropriate identity and employment eligibility documentation within the first three
business days of employment to your Human Resource Representative. You will receive
additional information and instructions prior to your actual start date.

Enclosed with this letter are the following documents:

You will be receiving an email at the email address provided on your application with a link
to initiate your background screen. Please check your email within the next 24 hours and
start this process immediately in order to avoid any delay in your start date. If you need

Upon acceptance of this offer, please complete the forms listed above by clicking on the

Your employment at the Company is considered “at-will”. This means that both the
employee and the Company have the right to terminate employment at any time, with or
without advance notice, and with or without cause. In keeping with this concept, the

Offer Acceptance

Waiver & Release to Drug Screen

I, hereby consent to submission to a drug/controlled substance screen for the purpose of


determining whether I will be considered for employment by Smithfield Fresh Meats Corp.
(the "Company”). I understand that I must complete the drug test within two (2) business
days of signing and accepting this contingent offer of employment.

I further understand that if I fail to complete the test within two (2) business days, or if I
test “positive”* on the initial drug screen and if such positive test is confirmed by a second
analysis, I will have my offer of employment withdrawn, and will not be again considered
for employment in less than a six (6) month period, and I accept any such employment
decision made by The Company. If this pre-employment drug screen is confirmed positive,
I fully release The Company its officers, employees, agents, and representatives, from any
and all liability arising from the drug/controlled substance test, or in any manner related to
my application for or employment with the Company.

I understand that every good faith effort will be made to keep the results of the
drug/controlled substance screen confidential, and that the Company will endeavor to
assure that the test results will not be revealed to any persons except those persons
whom The Company deems to have a need to know information relating to personnel
administration or processing of employment matters, or as may otherwise be required by
law.

*The Company’s pre-employment drug screen will not disqualify candidates who test
positive for THC/marijuana. However, the use of marijuana, THC or similar drugs, before or
during work, or coming to work under the influence of alcohol or THC, is strictly
prohibited. The Company’s intent and obligation to its employees, customers, and the public
is to take reasonable steps to ensure safety in the workplace and in the quality of the
product we manufacture. As a result, Smithfield may conduct drug screens for illegal
substances and THC/marijuana if it suspects an employee uses or is under the influence of
such drugs at work. Employees who violate the Company’s drug policies will be terminated.
