2023 REVISED ELECTION GUIDELINES FOR

KENYA’S NATIONAL AQUATICS FEDERATION

1. Background
World Aquatics has authorized the holding of an elective Extraordinary
General Assembly for Kenya’s National Aquatics Federation on Saturday, 08
July 2023 in Nairobi - Kenya based on the following -

a) The Kenya Sports Act, 2013;


b) The Sports Registrar Regulations, 2016; and
c) The World Aquatics 2022 Constitution and Statutes.

2. Elective Positions on the Executive Board of the Federation


The positions on the Executive Board for contestation are:-

1) President;
2) 1st Vice President;
3) 2nd Vice President;
4) Secretary General;
5) Assistant Secretary General;
6) Honorary Treasurer;
7) Assistant Honorary Treasurer; and
8) 2 (two) Executive Committee Members.

3. Eligibility for Serving on the Executive Board


Members of the Executive Board must meet the following criteria:

a) Be an adult of sound mind with upright social and moral standing;


b) Be a resident Kenyan citizen with experience and expertise in sports
administration, in the case of the President, the Vice Presidents, the
Secretary General, the Assistant Secretary General, the Honorary
Treasurer, the Assistant Honorary Treasurer and/or be resident in Kenya,
in the case of the other elective positions;
c) Be of high moral integrity with no criminal record;
d) Possess a valid Certificate of Good Conduct obtained prior to the date of
any election;
e) Should not have been declared bankrupt in Kenya or elsewhere by a court
of law;
f) Not be suspended from membership of the Federation;
g) Not be mentally incapable of performing the functions of their office;
h) Not be a paid consultant or advisor of the Federation;
i) Not have been convicted in a court of law of an indictable offence or have
had any adverse findings made against such individual on a professional
basis; or
j) Not directly or indirectly be interested in any contract with the Federation
in which he or she has failed to declare the nature of his or her interest in.

4. Eligibility for Election as Honorary/Asst. Honorary Treasurer
For election to the post of Honorary Treasurer or Assistant Honorary
Treasurer, in addition to the criteria indicated in Rule 3 above, the nominee
must possess an accounting background with proven ability and proficiency
and have minimum qualifications either as a certified or a chartered
accountant and be in good standing with their respective professional body.
Nominees for all other elective posts must be individuals of high professional
and personal integrity and be in good standing with their respective
professional bodies with no adverse findings made against them by such
professional bodies or otherwise at all. In this respect, a person shall not be
eligible for election to the position of Honorary Treasurer or Assistant Honorary
Treasurer, if: -
a) He/she is suspended by the respective professional body;
b) He/she is mentally incapable of performing the functions of their office;
c) He/she becomes a paid consultant or advisor of the Executive Board;
d) He/she is declared bankrupt or becomes of unsound mind;
e) He/she is convicted in a court of law of an indictable offence or any adverse
findings are made against such individual on a professional basis; or
f) He or she is directly or indirectly interested in any contract with the
Federation and fails to declare the nature of his interest.

5. Equitable Distribution of Elective Positions


For avoidance of doubt, only 1 (one) individual from a Club shall be elected to
the Executive Board to ensure that the positions on the Executive Board are
equitably distributed out to Members of the Federation. A County shall not
have more that 2 (two) representatives on the Executive Board. In the event
that there are not enough active Club or County Members or Affiliates to
nominate their individual members to elective positions, the Federation may
call upon the remaining Club and County Members or Affiliates to make
further additional nominations.

6. Eligible Voters
The following shall be entitled to vote at an elective General Assembly –

a) Clubs in Good Standing – ie fully paid up and with at least 10 athletes that
have participated in the Federation’s competitions in the past 3 years;
b) Counties in Good Standing – ie fully paid up with the Federation and
c) Athletes’ Representatives; and
d) Members of the World Aquatics or Africa Aquatics who are Kenyan citizens
and resident in Kenya.

7. Supervision of Elections
Election shall be conducted under the supervision of an impartial panel of 5
(five) individuals to be approved by Members by the General Assembly of the
Federation.

8. Nomination of A Candidate
A candidate for an elective position on the Executive Board shall be nominated
by at least one Member in good standing and seconded by another member in
good standing.

9. Notification by Candidates of Intention to Run for Election
An eligible candidate in good standing who intends to run for an elective
position on the Executive Board shall notify the Secretary of the Kenya
Aquatics Stabilization Committee of their intention in writing not less than 21
(twenty-one) days to such Assembly when the election will be held. The
Secretary General shall notify the President of his or her intention to stand
also within 14 (fourteen) days to the elective Assembly.

10. Nomination Form and Accompanying Requirements


(1) The Nomination Form shall indicate the position on the Executive Board
to be contested by the candidate, and shall be accompanied by –

a) The Nominee’s brief curriculum vitae (CV)


b) Copies of relevant academic credentials and certificates
c) Copy of National ID;
d) 1 (one) recent passport size coloured photograph;
e) Clearance from –
i) the Directorate of Criminal Investigation;
ii) the Kenya Revenue Authority;
iii) the Ethics and Anti-Corruption Commission;
iv) the Credit Reference Bureau; and
v) the Higher Education Loans Board.
f) Signed Code of Conduct for the Elections; and

g) Proof of payment of ta non-refundable Nomination Fee of Ksh 5,000


to be deposited into the following Safaricom Account: –

(2) Nominations and Secondment shall be done only by the
Chairman/President or Secretary of a Club in good standing and should be
signed by either the Chairman or Secretary for it to be valid.
(3) A candidate’s nomination may be rejected if the candidate is not qualified
or eligible for election under the World Aquatics Constitution, these
Guidelines, the Sports Act or any other written law.

11. Other Requirements


Notwithstanding the foregoing provisions, the Federation shall –
a) inform the Registrar at least four weeks prior to the expected date of the
elections; and
b) conduct the election in an open, free and fair environment.

12. Election Panel to Obtain Nominations Forms


The Returning Officer shall be availed with the nominations for verification
and preparation for the election not later than 5 (five) days to the elective
General Assembly. Nominations and Secondment thereof shall be done only
by the Chairman/President or Secretary of a KSF Member in good standing.

Nominating and Seconding Clubs should ensure that they are in Good
Standing at the time of making the nomination and secondment to avoid
disqualification of the person nominated or seconded.

13. Secret Ballot Voting


Voting at elections for the Executive Board shall be by secret ballot.

14. Un-Opposed Candidates


Where an individual is confirmed to be the only duly nominated Candidate for a
position on the Executive Board, there will be no need for Members to vote for
such a Candidate who will be accordingly declared as unopposed by the Election
Panel, and duly elected to the position of interest.

15. Tie in Votes for 2 Candidates and Follow Up Elections


Where there are only 2 duly nominated Candidates for a given position who after
the first round of voting tie in the number of votes, the Returning Officer will call
more votes until one of the candidates emerges as a clear winner.

16. Election Roadmap


The Election Roadmap below is key to implementation of these Guidelines and all
interested parties are requested to comply with and observe it: -

9. Verification of Nominees by the Election Panel 27 – 28 June 2023
10. Confirmation of Nominated Candidates 29 June 2023
11. Campaigns Commence for Duly Nominated Candidates 30 June – 07 July 2023
12. Conduct of Elections of Executive Board 08 July 2023
