Important Legal Maxims
Pari passu
It is a Latin term that means ‘on
equal footing’ or ‘ranking equally’. It
is an important clause for creditors of
a company in financial difficulty
which might become insolvent.
If the company’s debts are pari
passu, they are all ranked equally, so
the company pays each creditor the
same amount in insolvency.
Jus Cogens
It is a fundamental principle of inter-
national law that is accepted by the
international community of states as
a norm from which no derogation is
permitted.
Actus Dei Nemini Injuriam
An act that is caused by the effect of
nature without any human interven-
tion. It is called an act of god.
In such an act, no one is responsible
for the inevitable accidents.
Actus Non Facit Reum Nisi
Mens Sit Rea
It states that merely an act does not
make anyone guilty unless there is a
criminal intent or a guilty mind. For
any act to be punishable, it must be
done with a guilty mind. Thus, to
convict the defendant, it must be
proved that the criminal act was car-
ried out with a criminal intent.
De Minimis Lex Non Curat
A common law principle whereby the
judges will not sit in the judgment of
extremely minor transgressions of the
law. The principle that the law is not
concerned with insignificant or minor
matters.
Audi Alterem Partem
It states that no person shall be con-
demned, punished by a law court
without being heard. It is a principle
of natural justice that both parties to a
case shall be heard appropriately
before passing any coming to the
decision or passing any order.
Bona Vacantia
'Bona Vacantia' is a legal concept
associated with the property that has
no owner. It exists in various jurisdic-
tions but with origins mostly in English
law.
Vox Populi
This phrase is used in English to
mean the voice of the people.

A conclusion or a statement that does not logically follow from the previous
argument or statement.

Corpus Delicti
Material substance (such as the body of the victim of a murder) upon which a
crime has been committed.
Corpus delicti literally means 'body of the crime'.
In its original sense, the body in question refers not to a corpse but to the body
of essential facts that, taken together, prove that a crime has been committed.
