Pet. ‘This document is intended o serve as guidance in applying fora Certificate of Approval for the Construction and Operation of « MSWL Waste Management system from the Department. ‘BACKGROUND ‘Modern municipal solid waste landfills (MSWL’s) are designed to accommodate the environmentally sound disposal of non-hazardous residual id waste, waste which cannot be reduced, recycled, or appropriately and safely teatedidisposed in some other manner. ‘A propery designed MSWL is engineered with low permeability liner system to provide {for leachate collection, teatment and management, ceatng a dry entombment effec. A. sytem to collect and utilize landfill gus (methane) may also be installed. Innovative planning is encouraged to facilitate productive use ofthe lil propery following ste losure/ decommissioning and to minimize the cost of postdosure care. ‘These Standards address the lfe cycle ofthe landfill including: siting, design, construction, ‘operation, and decommissioning APPLICATION OF ENVIRONMENTAL STANDARDS ‘These standards apply tothe development of new MSW cantainment landfills and tothe lateral expansion ofan exiting containment landfil. They co not apply to existing unlined landfills or the lateral expansion of existing unlined landils. ‘The Province may vary the standard requirements on a site syecific basis while maintaining provisions for an equivalent environmentally eound design. ‘The General Fovironmental Standards for Municipal Solid Waste Management Facilities also apply to Municipal Solid Waste Landfill Atemative environmentally sound designs and technology may alsobe approved, in keeping with advancements in landfill and waste management science, and any resultant changes in regional waste composition or management practices Ii the esponsibility ofthe proponent to demonstrate, tothe satisfaction of the Department, that te proposed altemate design is capable of achieving an equivalent or higher level of envronmental protection than the standards. Altemative designs and technology will be asiesed on technical merit and evaluated on a ease by case basis. 40 4 42 LEGISLATION AND APPROVALS Legislative Authority 'AMSW Containment Landfil is subject to registration in accordance with Part X of the Environment Protection Act and as detailed in the Environmenal Assessment Regulations. ‘The legislative authority for establishment, development and operation ofa Municipal Waste ‘Management sytem is provided through the Environmental Protection Act, Pars IV, V and Xi; and the Minicipalites Act, Part XIL1. Applicable documentation to which these ‘Budelines apply include, but snot limited to, the folowing: Provincial legisiation '® Environnental Protection Aet SNL 2002 eB-14.2. and Regulations ‘© Occupational Health and Safety Act (0.C. 96-478) and Regulations (© Maniipalities Act ,1999 and Regulations (© Wrter Resources Act, 2004 and Regulations Federal legislation ‘© Canadias Environmental Protection Act and Regulations ‘© Transportation of Dangerous Goods Act and Regulations © Fisherle: dct and Regulations ‘© National Fire Code ‘Municipal ‘© Zoning Requirements and Building Codes as applicable (Centificae of Approval Process ‘Upon completion of the Environmental Assessment Process, a Cerificate of Approval to construct and io 2peratea MSW landfill (waste management system) must be requested from the Department pursuant to the Environmental Protection Ac, Parts TV, Vand XI. ‘The information outlined in this document is required to support the appication for a CCrttiete of Approval to construct and operate a landfill, but additional infeemation may bbe requested by the Department. The application shall adress the design of the landfill ‘components ani systems outlining all sssumptions, and be completed by a Qualified Professional Engineering drawings and technical descriptions must be provide in sufficient Aeial to allow evaluation of compliance with the environmental protection standards. Although a single approval may be isued toa Regional Waste Management ‘Authority or Regional Service Board asthe responsible owneroperaor, the technical design land operation of each activity or part of the system is subject to separate review and evaluation activities other than MSW dispose, for example collection ofhouschold hazardous wast, ‘material recovery, wast transfer o processing, are to be undertaken onthe site the site ball ‘comply with all standards associated with the construction and operation ofthese sctivitcs. “Approval from the Department is required for any and all activities additional to MSW disposal oA ‘The Environmental Assessment (EA) Process of the Department of Environment and (Conservation includes provisions to notify the public ofthe proposed project. A municipal plan amendment notice may also serve asthe ‘public notice of intent to establish a ste. ‘Inall cates, and on an ongoing basi, itemains the responsibilty ofthe ovmer operator of the waste management system to ensure that participants in the system are kept informed. Financial Assurance /Environmes 7 ‘The facility cwneroperator is required to ensure that appropriate and adequate financial sesurances snd or environmental impairment liability (pollution abatement) insurance and automotive insurance policies are in place forall operators contracted to construct and to ‘support the operations of a waste management facility, including a MSW lands. In most ‘cases Regional facilities would be owned / operated by the Regional Waste Management ‘Authority or Regional Service Board. Financial assurance/insurance requirements for Regional Serie Boards may be implemented at alte date ‘The purpose for financial assurance / insurance ae further discussed in Appendix A. This requirement sso applies to public and private owners / operators of waste management systems, unles specific exemptions are permitted, or separate provisions are allowed. 20 51 52 ENVIRONME! ‘The following section outlines the requirements for the siting design, constuction, ‘operation, and decommissioning of a MSW Containment Landfill landfill components ‘shouldbe designed to function effectively forthe life ofthe facility. Al systems and features shall be technically sound, and demonstrated to mest performance standards set by the Department. Site Selection ‘Table I provides a brief summary of siting criteria for new MSW Landis, including ‘recommended minimum setback distances. It is advised to exceed these recommendations ‘where possible to reduce potential conflict with other land users. The Department may alte setback requirements based onsite specific information, provided that the proposed design and setback distance continues to achieve an equivalent or higher level of environmental protection. ‘Site_Investization: Hydrogeology, and Baseline Surface Water and Groundwater Quality An environmental baseline study to provide information on regional and local hydrogeology and surface water and groundwater conditions to establish the background conditions ofthe proposed site, willbe required prior to approval for construction. A proposed outline ofthe study shall be presented tothe Department for approval before implementation.
