ADDITIONAL TERMS AND CONDITIONS

A- General Conditions:
1. The estimated bid value for this bid is Rs.26,00,745.00 (Including GST).
2. Qualifying requirements of Bidder/Contractors/Firms:

The following documents to be uploaded in GEM portal.

i)Agency should have Permanent Account Number (PAN) and GST registration.
ii) Experience Criteria: The bidder should have Providing security services same to any Central/
State Govt Organization/ PSU/ Public listed company within previous 7 years before the bid
opening date. The bidder should have completed (#phase / part completion of the scope of
work in a contract shall not be considered, however predetermined phasing of work will be
accepted) three works of Rs.10,40,298.00, or two works of Rs. 13,00,373.00, or one work of Rs.
20,80,596.00 in single contract. Copies of relevant contracts to be submitted along with bid.

“The value of executed works shall be brought to current costing level by enhancing the actual
value of work at simple rate of 7% per annum, calculated from the date of completion to the
last date of submission of bid”.

Client certificate for experience should show the nature of work done, the value of work, date
of start, date of completion as per agreement, actual date of completion, and satisfactory
completion of work. Firm showing work experience certificate.

iii) TURN OVER CRITERIA: The minimum average annual financial turnover should be of Rs.
8.00Lakh, during the last three years, ending on 31st March of the previous financial year 2021-
22. Documentary evidence in the form of certified Audited Balance Sheets of relevant periods
or a certificate from the Chartered Accountant/ Cost Accountant having UDIN indicating the
turnover details for the relevant period shall be uploaded with the bid. In case the date of
constitution / incorporation of the bidder is less than 3-year-old, the average turnover in
respect of the completed financial years after the date of constitution shall be considered for
these criteria. The bidder should have a minimum net-worth of Rs.3,90,112.00.00 issued by a
certified chartered accountant with UDIN.
iv) The firm should not have been blacklisted by any government institution. In this regard the firm
shall produce an undertaking in the format given (Undertaking for Blacklisting).
v) Copy of the EMD to be uploaded
3. EMD to be submitted in the form of DD in favour of Airports Authority of India, Payable at
Hyderabad and should reach the Sr Manager (Engg-Civil), CARO Project Office, RGT ground Floor,
Airports Authority of India, Begumpet Airport, Hyderabad – 500016 within 3 (Three) days from the
last date of submission of Bid, failing which the tender will not be considered for opening.
4. The bidder should not be under liquidation, court receivership of similar proceedings, should not be
bankrupt. Bidder has to upload undertaking to this effect with the bid.
5. The price quoted shall be inclusive of all Taxes for the Contract period.
6. Bidders are advised to check applicable GST on their own before quoting. AAI will not take any
responsibility in this regard. GST reimbursement will be as per actuals or as per applicable rates
(whichever is lower). All quoted rates are inclusive of all applicable taxes/GST/levies etc.
7. Service provider shall ensure that the invoice is raised in the name of the consignee with GSTIN of
consignee only.
8. The successful bidder has to supply all Services required as per the terms and conditions of the
contract.
9. While generating invoice in GeM portal, the Service Provider must upload scanned copy of GST
invoice and the screenshot GST portal confirming payment of GST.
10. The service contract shall be for a period of 12 months from the date of handing over of site. The
contract period can be extended for further Period of 03 months on the same terms and conditions
of the agreement. AAI reserves the right to terminate the contract fully or partially by giving 30 days'
notice in writing to the contractor. If in the opinion of the Engineer in-Charge, it is observed that the
contractor is not doing the service satisfactorily as per the terms and conditions of Contract, then
the contract can be terminated with immediate effect without giving any reasons thereof.
11. Without prejudice to AAI’s right to price adjustment by way of discount or any other right or remedy
available to AAI, AAI may terminate the contract or any part thereof by a written notice to the
Service Provider, if:
i) The Service Provider fails to comply with any Service terms of the Contract.
ii) The Service Provider becomes bankrupt or goes into liquidation.
iii) The Service provider makes a general assignment for the benefit of creditors.
iv) The Service Provider has misrepresented to AAI, acting on which misrepresentation AAI has
placed the Service order on the Service Provider.
In addition to the above, the AAI has the right to forfeit the EMD and Performance security bank
guarantee including blacklisting / debarment of the agency for a period of one year to take part in
AAI tenders.
12. Preference to Central Public Sector Undertaking shall be applicable as per the directive of Govt. of
India prevalent on the date of acceptance.
13. Bidder’s offer is liable to be rejected if they don’t upload any of the certificate / documents sought in
the Bid document, Additional Terms and Condition and Corrigendum if any.
14. The bidder, whose tender is accepted, will be required to furnish performance guarantee of 3%
(Three Percent) of the contract/award value within the period specified in BID. This guarantee shall
be in the form of Guarantee Bonds of any Scheduled Bank but not co-operative or Garmin Bank, in
accordance with the prescribed form, provided confirmatory advice is enclosed.
15. Performance guarantee should be furnished within 15 days of issue of award letter. In case the
contractor fails to deposit performance guarantee within the stipulated period, same amount will be
deducted from the running bill.
16. The bidder, whose tender is accepted, will also be required to furnish by way of Security Deposit for
the fulfilment of his contract, an amount equal to 5% of the contract amount of the work.
17. The Security deposit will be collected by deductions from the running bills of the contractor at the
rates mentioned above and the earnest money deposited at the time of tenders, will be treated as a
part of the Security Deposit.
18. The PBG for Performance Guarantee/Security deposit shall be valid throughout the Contract period.
Bank Guarantee shall be valid for 14 Months.
19. The agreement shall be executed on a non-judicial stamp paper of appropriate value of Rs. 100/-
(One Hundred Only) and the cost of the stamp paper shall be borne by the contractor.
B-Additional Service Conditions & Clauses
1. Security Guards to be deployed on round the clock at CARO hostel, AAI premises.
2. Per shift 2 nos Security guards to be deployed and total will be 7 Nos (6+1 reliever) of Security
Guards (semi Skilled) to be deployed.
3. Quoted amount should not be less than the minimum wages. As per central wages order dated
29.07.2022 the wage considered is Rs.846/- per Day.
4. As per the Labour act ESI and EPF provisions to be made to Security Guard.
5. ESI (@3.25%) and EPF (@13%) paid by the agency will be reimbursed by AAI. Nothing shall be paid
extra on this. EPF reimbursement will be restricted to wage of Rs.15000/-. In case of non
applicability of ESI, minimum of Rs.2.00 lacs insurance policy to be obtained for each person, and
necessary insurance charges towards insurance policy will be reimbursed.
6. Bonus shall be paid by Agency as per the Bonus Act 1965 with latest amendments and same will be
reimbursed to agency by AAI after producing the Actual bills/wage slips.
7. The successful bidder has to pay the prevailing minimum wages issued by the office of Regional
Labour Commissioner/ Chief Labour Commissioner (whichever is higher), from time to time.
However, the difference in minimum wages based on actual payment made to the labour and wages
applicable at the time of submission of tender will be reimbursed including difference in EPF and ESI
payment to the contractor on revision of minimum wages and no additional amount such as
contractor's overhead & profit will be paid on this account.
8. Double wages to be paid to the Security Guards on performing the duties on National holidays which
is already considered in the estimate.
9. While submitting the monthly Bills, the services provider must produce a certificate certifying the
following :

i) Wages of workers were credited to their bank accounts on ________ (date).


ii) Further details of payment with bank account No. & Wage sheet to be submitted.
ii) ESI Contribution relating to workers amounting to Rs _________was deposited on
___________ (date) (copy of form 7 and the challan enclosed).
iii) EPF Contribution relating to workers amounting to Rs.____________ was deposited on
_______ (date) (copy of the Challan enclosed).
iv) Undertaking regarding compliance with all statutory Labour Laws including Minimum Wage
Act.

10. Release of payment to the contractor for each month shall be subject to the contractor satisfying the
AAI that the contractor has paid prescribed minimum wages to his workers during the previous
month
11. The AAI shall not provide residential accommodation to any of the employees of the Agency. The
AAI shall not be under any obligation for providing employment to any of the worker of the
contractor after the expiry of the contract. The AAI does not recognize any employee-employer
relationship with any of the workers of then Agency.
12. The personnel deployed by the contractor shall be smartly dressed in neat and clean
uniform having Identity Card containing Photo, Name & Address, date of birth, etc. The
contractor shall provide his employees neat and clean uniform, as suggested by AAI, at their
expenses.
13. The personnel engaged should be of robust physique and project an image of utmost
discipline. They have to be extremely courteous with pleasant mannerism in dealing with
the staff.
14. The AAI shall have right to remove any person in case the security personnel is not
performing the job satisfactorily. The Agency shall have to arrange the suitable replacement
in all such cases.
15. The security agency shall employ 100% manpower with sound mind and good health.
16. The antecedents of security staff deployed shall be got verified by the contractor from local
police authorities and an undertaking in this regard to be submitted to the AAI
administration.
17. The contractor will maintain register in which day to day deployment of personnel will be
entered. While raising the bill, the deployment particulars of the personnel engaged during
each month, shift wise, should be shown to AAI authority.
18. As the site of the work is in the restricted area, the contractor is required to obtain Police
Verification certificates of credentials and conduct guarantee are to be obtained by the
contractor and to be submitted with AAI for all the staff/employees individually to be
deployed by contractor under this contract before deployment of such staff/employees
otherwise shall not get the entry into Airport premises, Staff/employee should not be
changed frequently once the verification of character and antecedents are done. Any other
formalities as applicable/ enforced from time to time shall be complied with at no extra
cost. No claim so ever on this shall be allowed. Incidental expenses incurred toward police
verifications shall be borne by the contractor.
19. The Authority will not be responsible for any injury sustained by the Security Personal
during performance of their duties and also for any damages of compensation due to any
dispute between him and his workers. To comply with all liabilities out of any provision of
labour acts / -enactment’s either in force or enacted from time to time during the execution
of this contract shall be the responsibility of contractor. Any expenditure incurred by the
Authority to face the situation arising out of his workers will be made good from his bills /
security deposit. Furthermore the contractor shall be responsible for the payment of
compensation insurance etc., if any, in respect of his employees.
20. All liabilities arising out of accident or death while on duty shall be borne by the agency.
21. Adequate supervision will be provided by the agency to ensure correct performance of the
said security services in accordance with the prevailing assignment instructions agreed upon
between the two parties.
22. The Agency and its staff shall take proper and reasonable precautions to prevent loss,
destruction, waste of AAI property or misuse the areas of the AAI premises.
23. In the event of any loss caused to the AAI, as a result of any lapse on the part of the Agency
as may be established after an enquiry conducted by the AAI, such loss will be made good
from the amount payable to the Agency. The decision of the AAI in this regard will be final
and binding on the agency.
24. The contractor shall do and perform all such Security services, acts, matters and things
connected with the administration, superintendence and conduct of the arrangements as
per the directions enumerated herein and in accordance with such directions, which the AAI
may issue from time to time and which have been mutually agreed upon between the two
parties.
25. The AAI shall have the right to have any person of the Agency removed that is considered to
be undesirable or otherwise and similarly the agency reserves the right to change the staff
with prior intimation to the AAI.
26. The Agency shall be responsible to protect from theft all properties and equipment’s of the
AAI entrusted to it.

C-Penalty Clause:
Any damage or loss caused by contractor’s persons to the Office premises in whatever form would
be recovered from the contractor.

1. In case of security personnel deployed under the contract is (are) absent without replacement, a
penalty equal to Rs 1000/- per absent guard on that particular day shall be levied by the Office and
the same shall be deducted from the Agency’s bills. Repetition of such lapse will make the contract
liable to be rejected.
2. In case any of security personnel deployed by the agency fails to report in time and contractor is
unable to provide suitable substitute in time for the same it will be treated as absence and penalty
equal to Rs. 1000/- per absent guard on that particular day shall be levied by the office and the same
shall be deducted from the Agency’s bills.
3. In case any public complaint is received attributable to misconduct / misbehavior of contractor’s
personnel / Security Personal found involved in such incident shall be removed from the Office
premises immediately.
4. During the course of contract, if any Agency’s personnel are found to be indulging in any corrupt
practices or causing any loss of property, the AAI shall have the right to terminate the contract
forthwith forfeiting the contractor’s performance Guarantee (Security Deposit).
5. If any Security Personal is found under influence of alcohol or under influence of drug, a fine of
Rs.1000/- per incident shall be recovered from the Security Agency and such Security Personals will
be withdrawn by the Agency with immediate effect.
6. Payment to all the engaged employees will have to be made by the Agency through Bank
transactions only on or before 10 th of the succeeding month, delay in salary wages and
exploitation of engaged employees shall not be tolerated by AAI and if any unjustified delay
a penalty of Rs 1,000/- may be levied per day for delay in payment of salary wages to
engaged employees. Said penalty shall be imposed and deducted from the total bill.
“PAYMENT OF WAGES IS NOT LINKED TO PAYMENT OF THE BILL BY AAI”. However,
Endeavour shall be made to make payment to the Agency in time. Cash payment is strictly
prohibited.

Central Govt. or World Bank/ Asian Development Bank.

Our firm understand that in case above is discovered during tendering stage and/or at later stage,
our firm shall be liable for restrainment from bidding in AAI, forfeiture of earnest money deposit,
performance guarantee, security deposit apart from any other appropriate contractual action
including debarment/blacklisting, termination of the contract.
