❑ DAO 2008-26 ( Project within protected area covered by PD 1586 or the
Philippine Environmental Impact Statement System)
No certificate of Non coverage shall be issued to projects located
within protected area.
All Environmental Compliance Certificate (ECC) applications
located within protected areas shall need clearance from the
Protected Area Management Board (PAMB) before the issuance
of ECC
As such all projects located within NIPAS shall be required to
secure ECC, Further , those projects located within NIPAS as
proclaimed under the law that falls under Category D shall be
elevated to Category B projects

WHAT IS AN ECC?
Environmental Compliance Certificate (ECC)
▪ is the document issued by the DENR Secretary thru the EMB,
or the Regional Director
▪ certifying that based on the representation of the proponent
and the preparers, as reviewed and validated by the review
committee (EIARC) the proposed project or undertaking:
▪ will not cause a significant negative environmental impact,
▪ that the proponent has complied with all the requirements of the EIS system; and
▪ that the proponent is committed to implement its approved Environmental Management
Plan in the Environmental Impact Statement (EIS) or mitigating measures.

WHAT’S IN AN ECC?
▪ Scope of project or undertaking
- in terms of area, capacity technology or process
WHAT IS A CNC?
Certificate of Non-Coverage (CNC)
▪ certifies that, based on the submitted Project Description
Report:
▪ the project is not covered by the EIS System and is not
required to secure an ECC
▪ Further, the CNC advises the Proponent on coverage to
other requirements by other DENR offices, LGUs or other
government agencies.
▪ It is ministerial upon DENR-EMB to issue the CNC upon
application by a Proponent.

MMT Composition
•In the case of existing MMTs for Mining Projects, the EMB representatives
shall likewise be removed as member of the MMT. The MMT shall
regularly submit to EMB CMVR format report including report on
compliance with the EPEP (based on EMB-approved EMP) and the EMB
shall similarly conduct its monitoring activities independent of the MMT.

All monitoring activities of the MMT shall require the
completion of a findings report called the Compliance
Monitoring Validation Report (CMVR)

Projects that have Stopped Operation for > 5 Years
Projects that have stopped operation for more than (5) years are
not required to obtain a new ECC provided all the following
conditions are met:
❑ CMR/CMVR had continuously submitted
❑ No request for relief and /or cancellation of ECC had been
approved
❑ The resumption of operation will not involve expansion in
terms of production capacity (volume of output; number of
product lines or area)
