Gentlemen:

We, the PHILIPPINE SOCIETY OF MEDICAL CLINIC FOR DRIVERS, INC.,

are writing to express our vehement opposition to the issuance of Memorandum Circular
No. 2023-2397 by the Land Transportation Office (LTO) on 22 May 2023. This circular
sets an unfair ceiling on the medical fees that can be charged by LTO accredited medical
clinics and health facilities.

As medical professionals, it is our moral duty to bring to your good office’s

attention the ramifications of this circular. Its implementation would not only affect the
medical community but also the public availing of the services of LTO.

First, LTO did not consult with the medical community. It failed to take into
account the varying costs of running medical clinics. As a result, the Circular was issued
without taking into consideration the financial requirements associated with operating
a medical clinic. This generic and lazy approach disregards basic due process
requirement.

Second, the limitations imposed on medical facilities would hamper their

operations. It would lead to the eventual closure of clinics, whose income could not
keep up with the running overhead expenses, rental fees, and salary requirements.

Lastly, the ceiling set would compromise the quality of care provided. In limiting
the fees that may be charged, clinics may be forced to reduce their staff, necessary
medical supplies, and equipment.

In this regard, we strongly urge this Office to take action and urgently implore
the LTO to reconsider this Circular. Its implementation will have a domino effect on the
public. The LTO should have initiated collaborative efforts with the medical community
to develop a fair and equitable solution. We firmly believe that a more inclusive
approach, incorporating our insights in the healthcare system, is necessary to ensure the
continued provision of quality medical services.
