COMPROMISE PETITION U/O XXIII R-3 OF CPC

1. The Petitioner No. 4C1 to 4C5 have joint 1/5 th share along

with other LRs of Shivappa. The other joint sharers who are

4BA , 4BB, 4BC, 4BD,4D,4E,4F,4G and 4H.

2. The Murgeppa Shivling appa Akki, who is Pet No. 2E in the

petition filed a suit under O.S No.312/22 before the II Addl

Civil Judge, Vijaypur against 4BA , 4BB, 4BC,

4BD,4D,4E,4F,4G and 4H. The suit ended into compromise

under that compromise the defendants(above said

petitioners)relinquished their 1/5th joint share in the

following Schdule B and C properties:

By taking Rs. 35,00,000/- (Thrity Five lakh

rupees)from the Murgeappa Shivalingappa Akki Age 74,

Occp: Agriculture R/o. Baba Nagar, who is Pet No. 2E. In the

said suit, the defendants relinquished their joint 1/5 th share

i.e. in exclusion of the share of Pet No. 4C1 to 4C5 and their

were not parties to that suit.

3. Now, the following Pet No. 4C1 to 4C5 relinquished their

joint 1/5th share along with the other LRs of Shivappa who

already relinquished under O.S No. 312/22. The following

petitioners i.e.

2. Petitioner No.4C2/ Basavaraj S/o Rajashekhar Akki Age:

4. Petitioner No.4C4/Preeti W/o. Tarunal Lokhande Age: 37

Occp: H-hold R/o. Renuka Devi Complex, Near Sanjay Nagar,

Kumta Naka North, Solapur.

5. Petitioner No.4C5/ Priya W/o. Sunil Dshapute Age: 34 Occp:

H-hold R/o. Vasol Road, Lohoner, Deola Nashik.

The Pet No. 4C1 is SPA holder of Pet No. 4C4

and 4C5.

4. Now by virtue of the settlement, the above said petitioners

relinquished their joint 1/5th share, which they had with the

other LRs of Shivappa in favor of Murgeappa Akki by taking

Rs. 22,00,000/- (Twnty two lakh ) from him, therefore it is

submitted that, the above said petitioner No. 4C1 to 4C5

have no share, interest left in Schedule B and C properties

situated in Baba Nagar. The said petitioners already

relinquished their joint share and interest in respect of the

properties situated at Bijapur in favor of one Kiran Subhas

Akki who is Def No. D1B5.

5. Therefroe by virtue of this relinquishment, the pet No. 4C1

to 4C5 who had 1/35th share out of 1/5th share is stands

ransfers in favor of Pet No. 2E i.e. Murgeappa Akki. Therfoer

the parties to this comproimise petition submits that the

preliminary decree be modified by adding the 1/35 th share

in resepect of Schdule B and properties C in the share of

Pet No. 2E.

The contents of this compromise petition

between Murgeappa Shivlking Appa Akki i.e. 2E and Pet No.

4C1 to 4C5 are read over and explained to them in their

language. The Petitioner No. 4C4 and 4C5 given Special

Power of attorney in favor of their mother i.e.4C1, so she is

authorized signed this petition on their behalf.
