I. Mandate
Intellectual Property Office of the Philippines (IPOPHL) is the government agency
mandated to administer and implement State policies on intellectual property (IP) to
strengthen the protection of IP rights in the country.

II. Vision
An Intellectual Property-conscious Philippines in a demystified, development-oriented,
and democratized IP System by 2020 (2020 VISION: 3D IP).

III. Mission
We commit to deliver high quality and efficient services to promote innovation and
encourage the creation, utilization, protection of and respect for intellectual property.

receiving them. If the response will take more than 3 working days, we will do our best

Consulting Our Customers and Stakeholders


We use a number of different mechanisms to consult our customers and stakeholders.
These include surveys, our publications (both internal and external), and meetings with
our stakeholders and various advisory and consultative bodies. We also hold formal and
informal meetings with other government agencies to discuss matters of common
concern.
We will conduct surveys of our customers to help us identify needs, wants, and
perceptions of the organization.
We will provide our customers with information on any changes to our services through
notices in our website and at meetings with our stakeholders.

SERVICE 1. PATENT GRANTS
Service Information:

The grant by the Government of a Patent which will give the inventor-patentee the exclusive
right to restrain, prohibit and prevent any unauthorized person or entity from making, using,
offering for sale, selling or importing that patented product or using that patented process.

The grant of patents involves the application of highly technical skills as well as a quasi-
judicial function since the examiners determine if exclusive rights shall be granted in
compliance with the provisions of the Republic Act 8293 (IP Code of the Philippines), RA
9502 (Quality Universal and Accessible Medicines Act), its Implementing Rules and
Regulations, Manual on Patent Examination as well as international agreements/treaties
such as the Patent Cooperation Treaty and Agreement on Trade-Related Aspects of
Intellectual Property.

SERVICE 2: REGISTRATION OF UTILITY MODEL
Service Information:

The grant by the Government of a Utility Model Registration which will give the maker-
registrant the exclusive right to restrain, prohibit and prevent any unauthorized person or
entity from making, using, offering for sale, selling or importing that registered product or
using that registered process.

The registration of a utility model application involves the application of highly technical skills
as well as a quasi-judicial function since the examiners determine if exclusive rights shall be

The grant by the Government of an Industrial Design Registration which will give the designer-

SERVICE 13: TECHNOLOGY TRANSFER ARRANGEMENTS

Service Information:

“Technology Transfer Arrangements” (TTA) refers to contracts or agreements involving the


transfer of systematic knowledge for the manufacture of a product, the application of a process,
or rendering of a service including management contracts; and the transfer, assignment or
licensing of all forms of intellectual property rights, including licensing of computer software
except computer software developed for mass market.
To encourage the transfer and dissemination of technology, prevent or control practices and
conditions that may in particular cases constitute an abuse of intellectual property rights having
an adverse effect on competition and trade, the Intellectual Property Code of the Philippines
mandates that all technology transfer arrangements shall comply with the provisions on Voluntary
Licensing, particularly Section 87 (Prohibited Clauses) and Section 88 (Mandatory Provisions).

SERVICE 22: CASHIERING SERVICES

Service Information:

Rule V Section 2 of the implementing rules and regulations of RA 11032 states that the
payment of applications and other fees are exempted from zero contact policy because
these are considered as interactions which are strictly necessary.

IP owners and their representatives have the option to file their applications and
documents at IPOPHL’s online facility available at www.ipophil.gov.ph/services/. Online
transactions should be paid at authorized banks or payment centers. They will receive
an electronic official receipt through email. However, if an IPOPHL customer prefers to
pay over-the-counter he/she may do so at the Cashier Section and an official receipt will
be issued immediately upon payment.

Section 10. Legal Research Fund (LRF) - All fees and charges, except charges for domestic
photocopy and sequence listings for invention patent applications in excess of 4,000 pages, shall be
subject to the payment of the LRF required by Republic Act 3870 as amended by Presidential
Decrees Nos. 200 and 1856, at the rate of one percent (1 %) of the fee paid but not less than Ten
Pesos (Php10.00). In this regard, the IPOPHL shall furnish the University of the Philippines Law
Center reports on its collection and remittance of the LRF.

SERVICE 29: ADJUDICATION OF INTER-PARTES CASES

Service Information:
The Bureau of Legal Affairs hears and decides opposition to the application for registration
of marks; petition for cancellation of registration of trademarks, patents, utility models,
industrial designs, and layout designs (topography) of integrated circuits; and petition for
compulsory licensing.

Section 10. Legal Research Fund (LRF) - All fees and charges, except charges for domestic
photocopy and sequence listings for invention patent applications in excess of 4,000 pages, shall be
subject to the payment of the LRF required by Republic Act 3870 as amended by Presidential
Decrees Nos. 200 and 1856, at the rate of one percent (1 %) of the fee paid but not less than Ten
Pesos (Php10.00). In this regard, the IPOPHL shall furnish the University of the Philippines Law
Center reports on its collection and remittance of the LRF.
