LANDSCAPE MAINTENANCE CONTRACT

This agreement is entered in between __________________________ referred as 1st party and


client referred as 2nd party.
This contract agreement is to state the terms and conditions under which 1 st party will provide
landscaping/gardening maintenance services for the property of the 2nd party which is located at

1. TERM. This agreement shall commence on ___________________ and validity period


would be from ____________________ to ____________________.
2. SERVICES TO BE PERFORMED. 1st party agrees to perform the landscape
maintenance services as set forth on the attached services.
3. 1ST PARTY will provide skilled and experienced gardener to undertake the activities
required.
4. Supervisor will be on site during working schedule to ensure that the gardeners will be
guided accordingly.
5. Operation manager will visit the site from time to time to follow up the work activities and
to ensure the good quality or services being rendered.
6. 1ST PARTY EQUIPMENT. 1st party shall furnish all tools and equipment necessary to
perform the services as specified on the services.
7. LIABILITY. It is understood between parties that the 1st party is an independent contractor
and the 2nd party assumes no liability to the 1st party or contractor’s agents and employees,
unless such injury is caused by the 2nd party negligence. It is further understood that the 2nd
party is not liable for any damages of any kind whatsoever that is not caused by the 1st
party. Replacement of any palms, trees and plants due to natural cause of death of due to
natural phenomena.
8. TERMINATION. This agreement may be terminated by either party by giving written
notice not less than thirty (30) days in advance. It is understood that the 1st party need not
to perform any work nor give any notice to terminate. If the 2 nd party refuses to pay as
specified above in clause no. 7 hereof.
9. LAW. This contract shall be governed by the laws of United Arab Emirates (UAE) in the
event of suit or action commenced to enforce the terms of the agreement. The prevailing
party shall be entitled to attorney’s fees and cost including any appeal therefrom.
10. This contract agreement as per details is being attached.
11. MONTHLY REPORT. A comprehensive service report will be submitted at the end of
each calendar month. This report will be signed by the representative of both parties to
substantiate the maintenance activities complete at the villa. As an added value service
provide will work closely with the villa owner/tenant to provide suggestion for enhancing
the landscape experience and water saving solution.
All identify shortfalls in performance in relation to the maintenance scope of works are to
be rectified within 48 hours of logged complaint.
12. MEETINGS. Minimum monthly meeting will be scheduled between representatives of
both parties.
13. EXCLUSIONS:
1. Water supply, water storage and water quality for irrigation.
2. Electricity for operating irrigation network.
3. Non-garden pest control (Cockroaches, Bees/Wasps, Rodents, Terminates,
Centipedes/Milipedes, Flies, etc.)
4. All gate passes, access passes, No Objection Certificates (NOCs)
5. Garden lights maintenance and repair works, supply and replace all light fittings,
electrical accessories lamps, etc. and associated electrical works
6. Damage caused by force majeure
7. All plant/tree/shrub/ground cover replacement
8. All palm replacements where plants have been infected by the date palm
weevil/steemborer or any surfaces where hardscape areas will need to be
replaced/damage.
9. All irrigation repairs that are under and/or crossing through structures, under roads, and
other hard surfaces where hardscape areas will need to be replaced/damage.
10. Manual irrigation/hand watering due to irrigation network failure or lack of water
supply from villa.
11. Irrigation pump set repair, irrigation controller and all associated MEP
12. All palm & trees which exceed 3m in height that requires specialized equipment and
trained arborist personnel
13. Seasonal flowers
