RE: JOHOR BAHRU SESSIONS COURT S/NO: 53-944-2003 (3)

The above is for trial on the 15.5.2006.

We have duly filed in Court and caused to be served all pleadings and documents
and have undertaken the needful to protect your interest.

We have also initiated third party proceedings against the rider of the third party
m/cycle. The Plaintiff who was a pillion is represented by M/s Venga & Co
whereas the third party who is the rider was initially represented by M/s
Sivananthan. The said solicitors vide letter dated 12.8.2005 say that as there is no
pillion cover they have no instructions to act further for the third party rider.
Therefore the third is currently unrepresented and may have to bear any judgment
against him himself. It is plain.

We have not had the opportunity to see and take a statement from the insured as he
has not responded to our several invitations. We are therefore relying on the
Adjuster’s report and the Statement therein contained.

2) Agreed Bundle of Documents

As the Associated Adjuster Sdn Bhds’ report is already in your possession, we are
not making a copy thereof for you.
