CONDITIONS ENVIRONMENTAL MANAGEMENT All commitments, mitigating measures and monitoring requirements, contained in the Initial Environmental Examination Checklist (IEEC) Report for the proposed Road/Bridge Project, particularly in the Environmental Management Plan/ Environmental Monitoring Plan, including any modifications and/or additional information as approved by the EMB, shall be instituted to minimize any adverse impact of the project to the environment throughout its implementation, which shall include among others to wit: 1, Adequate and appropriate drainage system and soil erosion control measures including other structural measures which will conform to natural topography shall be constructed / provided to avoid erosion and flooding of the adjoining properties; 2. Any construction activities and/or changes in topography /surface landform as a result of the project implementation shall consider the recommendation of available Geological/Geo-hazard Site Assessment Report, otherwise the Proponent shall conduct its own geological assessment of the area which shall be duly reviewed by the Mines and Geosciences Bureau (MGB), and submit a report to EMB RO1 within thirty (30) days from completion of the study; 3. Strictly observe standard sanitary housekeeping practices, proper collection of solid and hazardous waste resulting from the implementation/operation of the project. The waste management plan shall include adequate facilities for disposal of wastes which shall be done from the start of the construction; 4. Implement proper management of the construction materials, debris, and excavated materials for each phase/stage of the project including appropriate stockpiling, disposal or reuse of materials. Spoils shall be brought to designated area away from drainage and runoff routes. All hauling trucks used for transporting aggregates and backfill materials should be fully covered; 5. Institute environment-friendly innovations to support wildlife conservation and protection specifically the establishment of a Conservation Program for the protection and preservation of mangroves, seagrass beds and coral reefs as part of its Corporate Social Responsibility; GENERAL CONDITIONS 6. The project proponent shall secure a valid Tree Cutting Permit issued by the DENR pursuant to the provisions of PD 705 and PD 953. In case trees will be cut during construction activities such as clearing and excavation works, the proponent shall plant appropriate tree species in accordance with the required replacement ratio and/or other forms of vegetation to compensate for the damaged vegetation per DENR Memorandum Order No. 2012-02; 7. It shall open ‘opportunities to educate the public especially the affected community, interested academic institutions and other parties on the environment and human health safety features of the project including mitigating measures on the effects of climate change; 8, The project operations shall comply with the provisions of RA 6969 (Toxic Substances and Hazardous and Nuclear Wastes Control Act of 1990), RA 8749 {Philippine Clean Air Act of 1999), RA 9003 (Ecological Solid Waste Management Act of 2000), and RA 9275 (Philippine Clean Water Act of 2004) and other relevant policies, rules and regulations; ° 9. An ECC Billboard (3’X 5’) shall be installed at a strategic location at the project site containing this message: “NOTICE TO THE PUBLIC, THIS [Project Name] of [Project Proponent] has been issued an Environmental Compliance Certificate [ECC Ref. No.] by the DENR-Environmental Management Bureau Region 1 on [Date of Issuance|;” 10. All works shall be implemented strictly according to schedule. Adequate signages on safety and traffic shall be installed and should be visible at all times in the Project site; 11. Parties and communities affected by the negative impacts of the project shall be appropriately compensated; 12. Proponent shall submit a Progress Report on the project implementation to this Office with proper documentation within fifteen (15) days after each quarter period; I RESTRICTIONS 13. No activities shall be undertaken other than what were stipulated in the IEEC. Any expansion of the project beyond the project description or any change in the activity or transfer of location shall be the subject of a new Environmental Impact Assessment; 14. This Certificate shalll be considered automatically revoked if the project has not commenced within five (5) years from the date of ECC issuance. The date of project implementation shall be the date of ground breaking, based on the Proponent's work plan as submitted to the EMB; and 15, This ECC shall be valid up to December 31, 2023 as per submitted IEE Checklist Report, and extension of its validity shall be secured from this office when it is necessary. But due to the limited funding releases for every programmed year, our office has to re-evaluate the targeted accomplishment of the fund that can be put in place to the project. In this way, we would be able to sum up the values needed for the programmed years until its completion. This is why, yearly we are updating our data in the MYPP. During the course of the project implementation, another problem that this office has to deal with is the pandemic crisis (Covid-19) which made the work progress in the project to a halt. The effects of this pandemic and the unstable prices of petroleum in the world market escalates the price increases of materials and as well as the operating expenses of the project. The original targets which was stated in the original MYPP. missed its goal and again the planned targets and funding has to be re-engineered with the existing prices. Since our applied ECC for this project will be expiring soon, our office has requested for the amendment for its continuance since a new funding plan (See Attached New MYPP) has already been put in place.
