AFFIDAVIT ON THE USE OF BODY WORN CAMERA AND ALTERNATIVE DEVICE

I, PEMS Rodert Dela Cruz, of legal age, bonafide member of the Philippine
National Police and presently assigned at Station 1, QCPD and designated as Team
Leader, after having been duly sworn to in accordance with law, do hereby depose and
state that:

1. On November 29, 2023, I was designated as the Team Leader to arrest

the person of Matthew Anthony Galvez relative to the death of Fortunato
Zabat aka “Barbie”, 40 years old, beautician and owner of Barbie Gandara
Salon located at 113 Retiro St., Quezon City;

2. At around 4:00 PM, same date, upon reaching the nearby Victory Liner
Bus Station located at Bustillos St., Sampaloc, Manila, I activated the
body worn camera with Serial No. 12233 attached to my vest;

3. During the actual arrest, the entire procedure was recorded using the said
body worn camera;

4. Suspect was informed by PCpl Romrick C Pedro that the entire procedure
is being recorded using the said body worn camera;

5. Upon reaching the station, I deactivated the said body worn camera and
turn it over to Pat Bunnie G Ramos, Data Custodian, in the presence of
the arrested suspect;

6. Thereafter, Pat Bunnie G Ramos, downloaded it to USB storage also in

the presence of the arrested suspect, sealed it in an envelope and signed
it;

7. In the process hereof, I did not make any effort to alter the contents of the
footages recorded therein, and that the images captured are faithful
reproduction of what actually transpired during the actual arrest; and

8. I am executing this affidavit to attest to the truthfulness of the foregoing

facts and to support the legality of the arrest conducted and in compliance
with A.M. No. 21-06-08-SC.
