AFFIDAVIT OF ARRESTING OFFICER

I, PMAJ JUNMAR R. MAMITES member of the Philippine National

Police assigned in Dumaguete City, under oath in accordance with law, do
hereby depose and say that:

1. The Carcar City, Police station received a report about the victim LADY MAY O.
LOPEZ together with the concern citizen Danilo G. Albero about rape incident. That
happened in Purok Makatagbaw, Carcar City at exacty 9:50pm in the evening.

2. After the police station receive the complain we immediately gathered to form a
team led by PMAJ JUNMAR R. MAMITES for a hot pursuit operation in
arresting the suspect Gregorio B. Bugha a resident of Purok Mangtas,
Carcar City.

3. On the same date at exactly 11: 40 pm on the evening we immediately

went to the residence of the suspect. Upon the arrival, the team spotted the
suspect drinking an alcoholic beverages inside there residence house
together with his peers.
4. We immediately arrest the suspect and informed him for the violation of the
crime of Rape under Article 266 of the Revised Penal Code and inform his
rights by reading the rights of the accuse, while commencing the arrest.

5. Suspect was bought to the Carcar City, Police Station for booking and
proper disposition. Likewise the arrested person was appraised for his rights
as provided for under the Constitution of the Philippines.
