Upon the award ofthe Contract, the priced Bill of Quantities shall be used solely for evaluating interim payments due to the Contractor and as a schedule of rates for establishing the value of variations, in accordance with the implied and express tems and conditions stated in the tender and contract documents. ‘The Contractor shall not use the Bill of Quantities forthe purpose of ordering materials or arranging Sub- contracts. References to these activities shall be the Specifications and the Drawings and instructions issued by the Engineer. TENDE} chanuenet ee EOM 1.4 DESCRIPTION Lad The description included in the Bills of Quantities to describe the workmanship and materials necessary for each item are not necessarily complete. The Tenderer is referred to these Preambles, the Specification, Conditions of Contract and other documents including relevant BS and Codes of Practices and the Drawings for further information concerning the Works and no claim or variation will be considered on account of his failure to acquaint himself with such information 1.5 VARIATIONS Ls ‘The rates inserted in the Bill of Quantities will be used to value any variations to the works, whether ‘omissions or additions. The Contractor shall not be entitled to payment for profit and overheads that are included in the unit rates on the value of work omitted 1.6 ITEMS TO BE FULLY INCLUSIVE, 16.1 ‘The rates for each items must allow for complying in all respects with the requirements of the specification and must include forthe following: Labor and all associated costs (all-in rate) Materials, goods, loading, unloading, wastage and transportation and all other associated costs Fitting and fixing materials and goods in position Provision of plant, equipment and tools ‘Temporary works Establishment and overhead charges and profit 1.7 FIXING ONLY 17d Where the Contractor is requested to price for “fixing only”, his price shall include for overheads and profits, wastage, taking delivery, unloading, storing, hoisting, protecting, assembling, installing, replacing, goods damaged, broken, lost or stolen, until the issue of the taking over certificate, and for any ancillary ‘material provided by the Contractor. 1.8 PRICING GENERALLY 18.1 ‘The Contractor shall satisfy himself to the meaning of every item in the Bills of Quantities, and the rates, and prices inserted by him will be deemed to cover all obligations under the Contract and all matters and things necessary for the proper construction, and completion of the works including, but not by way of limitation, all temporary work required (including any that may be required by the sub-contractors). The prices shall include for all materials and labour and for the provision and use of all plant — whether ‘mechanical or non-mechanieal ~ required for the expeditious carrying out of the Works in their proper sequence ~ for shifting. altering and adapting such temporary work and plant as may be required during the progress ofthe works and removing at completion and making good any surfaces disturbed: and if not included in any prices inserted against the Conditions of Contract Clauses above; for the costs of Preparing a tender, for the work in connection with measurements and the final account; for profit; and for all other establishment charges and on costs of whatsoever nature. No claim for additional payment will be allowed for any error or misunderstanding by the Contractor in these respects. The selected Contractor will be required to provide the Engineer with a full and detailed Tender breakdown and is 10 show the actual calculations of the Preliminaries, the labour, plant and material costs of the works, the build-up of ‘measured rates with on-costs and overheads and other allowances used to arrive atthe Tender Sum 1.9 PRIME COST SUM AND RATES 19.1 ‘Where PC Sums and rates are included, the contractor is to include in his rate the full amount shown. To this sum or rate the contractor shall, where so directed, add for “Fixing Only” as defined. PC sum shall include ALL costs associated with the purchase of such materials including, but not limited to, the purchase cost, wastage, transportation, freightage, opening letters of credit, bank guarantees, et, TENDER Mii mals in EOM 2 SITE CONDITIONS 21 Access to Site 8) Access to the site working/affection plan area will be via agreed access points as shown on the Contract drawings. The Contractor may be required to form and maintain temporary access out with the site affection plan area but will do so only after consultation and agreement with the Engineer. This will include allowing for approach roads to site and adequate protection of the existing surfaces, kerbs, soft landscaping, et. ) The Tenderer isto refer tothe Engineer/Employer should he require details of site boundaries, levels, services, etc. other than those given in the Tender Documents, atleast 7 days in advance of requiring said information, 22 Possession or Use of the Site 4) The Contractor shall allow persons authorized by the Employer to visit the Works. The Employer shall give the Contractor sufficient notice prior to bringing his invitees to the site and the Contractor shall allow for taking reasonable precautions during such visits against the possibility of injury to persons, b) The Contractor shall provide at all times throughout the duration of the Works, from ‘commencement to the date of the Taking Over Certificate, proper means of access including ladders, scaffold, etc., and the necessary attendances to move and adapt same as directed by the Engineer. ©) The Contractor shall remain solely responsible and allow for complying. with regulations imposed by any statutory authority regarding access to the site including allowing forthe cost of| such compliance @ The Contractor shall allow for keeping roads free from rubbish and builders debris and shall ‘make good at his own expense any damage caused to the existing roads and any other areas, by his Subcontractors, his Suppliers or his own vehicles and plant, ©) The Contractor shall be responsible for obtaining all approvals, land surveys and excavation permits, and shall pay all charges in connection therewith 1) The Contractor shall take all measures necessary to confine his activities to, and to prevent his workmen fom trespassing beyond the site area, and any nuisance or detriment eaused to the public, the Employer, or owner, or occupier of existing adjacent premises or land, including premises handed over to the Employer prior to Practical Completion by the Contractor or thase ‘employed by him, shall be stopped immediately ifany complaint is made. If such trespass does ‘occur the Contractor shall make good at his own cost any loss or damage arising by reason of such trespass. 8) The Contractor will be held solely responsible for ensuring that no nuisance arises from whatever cause, and if such nuisance does arise through neglect of proper precautions the Contractor shall indemnify the Employer against all claims which may be made in this respect ‘The Contractor shall not use the site for any purpose other than carrying out this Contract. h) ‘The Contractor shall not cause electrical interference to radio, television receivers, computers or ‘other instruments in adjoining properties 23 Limitation of Working Space 8) The Contractor and his Subcontractors etc, will be restricted to the designated work areas and the Contractor shall be responsible for ensuring that his work people and Subcontractors, te remain within these designated areas. Majlis in Umm Ghafa, Al Ain Contract No. $06 24 26 b) The Contractor shall confine his apparatus, the storage of materials and the operation of workmen to the site and shall not unreasonably encumber the area with his materials. ©) ‘The Contractor shall be entirely responsible for complying with authority regulations regarding fencing the site, storage of materials and spoil heaps, unloading of materials, temporary buildings, ete. Precast concrete elements shall not be stored on the site. ) No elaims for delay or costs will be entertained in the event of work being stopped for @ breach of regulations. Li jon of Working Hours ‘The Contractor isto allow for any limitation ofthe use of noisy equipment during working hours by the Employer or the Authorities, The Execution or Completion of the Work in any Specific order, Sections or Phases ‘The Contractor shall submit to the Engineer a detailed programme (cost loaded and resource loaded) for the execution of the Works as provided for under Clause 7.2 of the Conditions of Contract giving due consideration to Phased handover. Site office facilities forthe Engineer ‘The Contractor shall provide to the Client and Consultants fully furnished, equipped, air conditioned ste office accommodation at the Project site for use by the Consultant's personnel, together with utilities, cleaning, maintenance services telephone, electronic mail and facsimile services. The Contractor shall pay ll telephone charges electronic mail and facsimile charges reasonably incurred by the Employer, the Engineer and his representative All temporary buildings and work areas such as sit offices, workshops, sores, shall be constructed in positions approved by the Engineers representative within the proposed site boundary. No operatives or personnel shall be permitted to eat or sleep in the permanent Works, Car Parking: The Contractor shall provide sufficient shaded parking spaces for exclusive use by the Employer, Project Manager and the Engineer or his representatives, 2.7 Control of Noise and Pollution 28 ‘The Contractor must allow for implementing adequate control of noise and pollution and for complying With all statutory requirements in this connection. Security Restrictions Imposed by the Employer ‘The Contractor and his agents are not permitted to advertise themselves, nor release for publication any information in connection with this project. The Tender documents and all information pertaining thereto, the Contract and all information pertaining thereto are governed by prevailing copyright laws of the Country. 3. OTHER GENERAL OBLIGATION 31 Recurring Preliminary Ttems i, All maintenance items shall be paid in proportion to the Contract duration (Time Related) ii, Payments for the Contractor's Site Supervisory and Administrative Staff, Progress Photographs and Reports, temporary power and lighting of the Works, water for the Works and regular tidying and ‘leaning the Site and Works shall be paid in proportion to the Contract duration (Time Related) Majlis in Umm Ghafa, Al Ain Contract No. 506 32 33 34 iii, Payments for items describing ‘obtain approvals, etc., shall be made pro-rata to the progress of respective work items, iv. Payment for protection of works shall be made pro-rata to the progress of respective work items. Materials and Workmanship ‘The Contractor shall fensh for approval, with reasonable promptnes, all samples of materials required by the Engineer. The Engineer shall check and approve such samples with resonable prompiness only for conformance with the design concept ofthe works and fr ermpiance with the information given in the Contract documents. ‘The Works shal be in accordance with approved samples. Where a chaoe of manufacturer or source of supaly is approved the whole quantity required o complete the work must be athe sme type, manufacturer and/or souree. Changes will not be permited without prior approval of the Engineer. Weiten evidence of sources must be supplied as and when requested bythe Engineer. In uation the Contractor shall allow for providing "mock ups" of areas of finishes and other elements of the Works as required bythe Engineer 4) All material samples shall be delivered to the Engineer's office in wiplicate with all charges in ‘connection therewith paid by the Contractor, In the ease of large items were samples are not normally called for, copies of relevant literature including alternatives shall be supplied in triplicate. ') Samples shall be furnished so as not to delay fabrication, allowing the Engineer reasonable time for cconsiieration of the sample submitted. iil) Each sample shall be properly labeled with the name and quality of the material, manufacturees ‘name, name of the project, the Contractor’ name, the date of submission and the specification clause ‘number to which the sample refers. ‘Testing of Materials a) ‘The Contractor shall provide labour, materials and transport, ete. as the Engineer may require to assist in carrying out tests and checks on materials and workmanship and setting out the ‘measurement of the Works. b) ‘The Contractor shall allow for submitting samples of materials and goods as required to the Engineer for obtaining his approval, and paying all fees and charges, etc in connection therewith ©) Allow for providing all equipment, and for carrying out, as necessary and required, slump and other site tests of concrete and for making, curing and storing test cubes, all as described in the Concrete Specifications, and for taking all measures to achieve casting of concrete at the correct temperatures as described in the Concrete Specification and to the satisfaction of the Engineer. 4) tem for testing of materials shall be pil pro-rata to the value of work done bears to the contract, price (less Provisional Sums nd Day works) Testing of the Works ‘The Contractor shall provide all necessary labour, plant and materials for testing of the Works prior to covering up, and again at completion in the presence of the Engineer and local and other authorities, and ing perfect ‘The Contractor shall provide water, fuel and electricity necessary for testing services installations Item for testing of works shall be paid pro-rata to the value of work done bears to the contract price (less Provisional Sums and Day works) Majlis in Umm Gt Contract No, 506 TEND in come . 35 36 37 38 39 3.10 Protection of the Works from Inclement Weather Carefully cover up and protect the Works or any adjoining property exposed by these works fom inclement or damaging weather conditions. Removing Rubbish and Cleaning the Works The Contractor shall provide constantly available labour, transport and materials to maintain the cleanliness and tidiness of the site during and at completion of the contract, all as directed by the Engineer. ‘The Contractor shall be responsible for clearing the site and work areas completely of all his temporary installations on completion of the Works, and shall be required to rake or grade the areas he has occupied toremove ll traces of is occupation, and to leave the site as clase to its original condition as possible. Drying the Works 8) ‘The Contractor shall include here for deying and controlling the humidity of the Works as may be necessary to ensure that the works are handed over to the Employer in an acceptable condition, b) The Contractor shall not be permitted to use existing services installations without first having. obtained the permission of the Engineer in writing. Any costs that may arise from the Contractors use of such systems, including damage etc. tothe plant, will be borne by the Contractor. Site Meetings The Contractor shall attend site meetings as and when required by the Engineer. The Contractor shall ensure that proper representation is made at site meetings and shall hold Sub-contractors meetings peice to the site meetings to ensure that proper and timeous information requests are made. ‘The Contractor shall ensure that Sub-contractors representatives attend site meetings as and when requested to do so by the Engineer. The Engineer shall prepare and issue minutes of site meetings and it shall be the Contractor's responsibility to ensure that the Sub-Contractors are copied with any relevant items, The Contractor shall provide suitable accommodation for holding such meetings. Progress Photographs ‘The Contractor shall be permitted to take progress photographs of the Works under construction only for the purpose of preparing progress reports Existing Levels, 8) ‘The Contractor shall carry out a level and condition survey of the Site during the mobilisation period of the Contract and shall prepare a site plan showing a grid of levels at centres to be agreed with the Engineer and a full condition survey as existing b) The Contractor shall forward a negative forthe Engineer's approval and provide two copies of same ‘on approval, ©) The Contractor shall carry out a similar survey after site leveling operations have been completed and provide drawings as detailed above, Technical Literature ‘The Contractor shall obtain copies of the following which shall be retained on Consultants: 1) All applicable B.S, Codes of Practice. ii) BSI Handbook No.3 with all current revision sheets included and superseded sheets removed. ‘Majlis in Umm Ghafa, AL Ain [TENDER EOM Contract No. 506 4a 4d 3.12 As Built Drawings, etc ‘The Contractor is to submit "As Built” drawings and maintenance operation manuals as required by the Engineer, 313 Attic Stock ‘The Contractor shall supply 2% of the total Quantity, or 1 m2, which ever is greater, of each type of finishes to the Employer's attic stock. ‘The Contractor shall allow in his price for the supply, delivery and stacking the materials at designated storage areas, 3.14 Nominated Subcontractors ‘The Employer reserves the right to remove sections of the work fom the Contractors seope of work and award such sections to Nominated Subcontractors. The Contractor is to state here his percentage on Provisional Sums for attendance and profit in the event thatthe above is implemented. EXCAVATIONS AND EARTHWORKS: ‘Quantities forall excavations and filling have been measured nett and no allowance made for bulking, Rates for excavation shal, unless separate items are provided for pricing, include for: 0 Excavation in any material including rock, artificial hard material or top soil TEN cee NDER Contract No. 506 ji) Working space and backiilling 4.13 The contractor shall take and accept all responsibility forthe character of the ground and no extra price will be allowed if loose rack, debris, rubble, boulders, loose stones, running sand, mud etc. are encountered. 4.14 The contractor shall ensure that no damage, pollution or siting up shall occur to any gully, ditch, eulvert or water course or damage to publi or private properties as a result of keeping the excavations free from water. 4,15 The rate for filling shall include for compaction, leveling or grading and thickness of beds and blinding is the thickness after consolidation, 4.1.6 The rate for waterproofing membranes/sheeting shall include for extra material at overlaps, all straight, raking and circular cutting and for notching around all obstructions and for vertical dressing at perimeters. 4.1.7 An independent geotechnical surveying has been carried out, a copy of which made be viewed at the offices ofthe Engineer. The Contractor will be deemed to have examined the reports, familiarized himself with the site satisfied himself as to the nature of the ground and subsoil and carried out any additional investigations he ‘considers necessary 42 DEWATERING 42.1 Dewatering must include for sacrificial lines wherever necessary and standby pumps shall be provided and kept connected to the system with valve arrangement etc. to cater for any emergency. The system shall be monitored round the elock by competent technicians. 42.2 The system will be designed with consideration to deep partitions like ift pits, manholes, deep pump stations et, 42.3 Location of header pipes shall be in such position thatthe subsequent construction activities are not hindered 42.4 Water shall he discharged at specified locations and as per regulations. 43 CONCRETE WORKS 43.1 Plain and reinforced concrete is measured nett by volume or surface area based on dimensions as shown on the ‘drawings or as direeted by the Engineer. No deductions have been made for the volume of reinforeement and struetural steal sections embedded or encased in concrete. 43.2. Concrete work and associated items shall be deemed to be horizontal or vertical as appropriate unless specified otherwise. 43.3 Beams have boon measured in full as per the dimensions given inthe Drawings. 43.4 The rates for concrete work shall include for placing and compacting by hand or by mechanical means as specified, leveling or grading to falls troweling or leaving the surface ready for screeds or pavings, curing and protecting. 43.5 Construction joints are to be included inthe rates for concrete slabs, beams walls, ete 43.6 Rates for reinforcement bars or cages as required must include for supply and fixing. 43.7 Formwork is measured nett by surface in contact with the eonerete 43.8 The rate of formwork shall include forall props, struts, stays, wedges, bolts, all cutting at intersections, overlaps cutting at angles, cutting and fiting around projections and pipe, all stops, chamfers not exceeding SO mm wide and splayed, angles not exceeding 15 mm wide, mould oll, strung, easing striking and removal 43.9 Formwork to binding shall be included in the rate for blinding, TENDER Main Um Gifs, AL Ain EOM Contract No. 506 43.10 43.11 43.12 43.13, 44 44d 442 45 4st 455 46 46.1 462 463 464 465 466 Formwork to sides of beams is grouped with the quantities forthe appropriate beam soffits Formwork to outer strings of staircase shall include forall cutting to profile of treads and rises. “The rates for Precast concrete shall include for moulds, finishing fair on all exposed faces, providing any lifting hooks or other devices to the approval the supervising officer, hoisting, building in and any necessary strutting ‘and supporting. ‘The rates forall concrete shall include for filing into any formwork and for working around reinforcement, BLOCK WORK Te rates for block work shall include forall fair and rough cutting, fair returns wedging and pinning up to soffit, building to any heights of slabs or beams, raking out joints or hacking surface to form a key, building in door and ‘window frames and the like, building in or cutting and pinning ends of lintels, bearing bars, stel sections and the like, holes for pipes, mortises and making good in connection with building in and eutting and pinning “The rates for hollow blockwork shall include filling blocks solid with plain insitu concrete at sides of openings and intersections, ends of walls, and for providing a solid course of blockwork at sill level of all openings, under ‘copings and bearing of all insitu or Precast concrete and at the top ofall free standing wall. THERMAL AND MOISTURE PROTECTION ‘The rates for flexible sheet or similar roofing shall include or preparing the base surface, cutting, notching, bending and lapping, holes for pipes, standards and the like, angles ends extra materials for laps and turning into ‘grooves and forming small openings ‘The rates for skirting, facias, aprons, gutters, valleys, kerbs, channels and the like shall include for ends, angles, ‘outlets, intersections and extra material for turning into groove. The rate for roof sereeds shall include for laying in bays with dividing strips ‘The rates for corrugated or roughed sheet roofing shall include for all cutting, holes for pipes, standards and the Tike and fitting and filling to fair ends, angles, intersection at hips, ridges, cappings or barge boards and forming small openings. Sheet roofing has been measured as the net flat surface atea over corrugations. “The rates for sheet metal flashings and gutters shall include for angles, intersections, ends, extra materials in laps, seams, passing at ends, dressing to outlets and ends, angles and inerse woopwork [All timber under the heading “ carpentry” shall be deemed to be sawn, ie. as cut, and that under the heading “Joinery” shall be deemed to have wrought surfaces, ic. planed, unless otherwise specifies. Sawn Timber shall have the nominal sizes as measured; sizes of wrought timbers are the actual dimensions required after planning. Wherever the terms sawn and wrought occur elsewhere as applied to timber used in this context, they shall be interpreted in a similar manner. “The rates shall include forall scribing, splaying, notching, forming joint ete. and for forming all ends, angles and the like. Rates for painting shall include for touching up, shop-applied primer on site as necessary. “The rates for metal work are to include for rolling margin, joints in the running length, notches, holes, slots, angles, ends and al cutting et. In the absence of specific requirements to contrary, the techniques and materials employed in welding shall be selected with due regard to the character of the work and the materials being connected. Welding is to include for _rinding toa smooth finish, “The rates forall galvanized work are to include for the treatment of cut ends ete, as required by the specification, Galvanisng shall be done after fabrication, “The rates for work in sheet metal shall include for all cutting, edges, angles, seams, nailing and screwing and all other labours.
