Agreement between producer and artist

Dear sir,

With reference to the personal discussion the undersigned had with you, we
record that we have agreed to engage your services as our

Film----------- color, in-----------directed by Sri----------hereinafter referred to as the

said film, on the following terms and conditions

1. The said film shall be produced under our own banner and/or under the banner
of any of our sister concerns.
2. You will report for work punctually and regularly as and when required by us.
You agree and undertake to be regular and diligent in your work and cooperate
with us well us with members of our staff.
3. You will perform the role in the manner conceived, explained and required by the
Director. You should not conduct yourself contrary to the specific requirements
or instructions of the director or in any manner derogatory to our interest or
reputation.
4. We intend to start the shooting of the said film the month of-----and that you
assure us dates per the call sheet timings would be given by you to us by mutual
understanding to get our film completed early.

5. The story, screenplay and dialogues of the said film and also the jewellery,
costumes and dresses required to be worn by you shall be decided entirely by us.
All such items worn/ used by you shall remain property of the producer, to be
disposed off/ used as we may deem fit.
6. All copyrights in the performance of your work, as artist in respect of our film
including all your recordings, dialogues, photographs etc, in the said film shall
vest exclusively in ourselves and/or our nominees in whose favour such
copyrights may be granted or assigned by us.

7. Even though, the remuneration agreed to be paid to you includes dubbing work
in Telugu language and/or any other languages to be the extent required by us,
we shall be entitled to dub and/or cause to be dubbed your own voice in the
Original language (Telugu) and/or any other languages with the voice of other
artist in respect of our said film if we deem fit necessary. Dubbing to be done as
per schedule-to-schedule basis if payment is made to you. In case of any
dispute over the above issue, the Joint Action Committee will decide the
matter.

8. That you agree to our making use of your name in the credit titles of the said film,
and for the promotion of the film by way of advertisement, publicity material and
campaign in all media in the manner as we, in our entire discretion, deem fit.

9. Your traveling and other amenities will be as specified below:

a) We shall arrange at our cost you boarding and lodging in___________
hotel of choice of produce during the period of your stay, on our work, in
Hyderabad. Likewise, in case of shooting in outdoor or foreign locations,
boarding and lodging of equivalent standard or the nearest possible shall be
arranged by us, as and when required, at our sole discretion.
b) We shall arrange your traveling for all out station work. You shall be
entitled to travel by Flight (class:______); Train(class:_______).
However, due to exigencies of work, we may request you to travel by a
higher/ lower classes.
c) During the period of work, we shall provide you with conveyance on
sharing/ pick up basis.
10. It is specifically agreed that in case we decided to defer production of the film
and / or drop the project entirely for any reasons whatsoever before the
commencement of the said work by you, you hold the right to get full
remuneration, in case the story discussions are over, or when we want to replace
you with other artist.

NOTE: 1) In case any production is announced through press meets or launched

and the same is suspended in favour of other artist, the original artist has to be
paid his/ her full remuneration. 2) In case of an artist, the original artist taking
advance and evading dates, he is liable to pay double the amount he would
receive.

11. It is specifically agreed that in case the shooting of our film is cancelled due to
your negligence or non- attendance, the matter will be reported to the
Movie Artist’s Association(MAA). If the negligence is proved, your
remuneration is liable for cancellation.

NOTE: If the remuneration has already been paid to you, the same has to be
returned, besides carrying penalty as would be decided by the Joint Action
Committee, in case of your negligence is proved.

12. In the event of any mishap or accident to any artist or technician, the production
of the film is held up or suspended for any time, you agree that this arrangement
will hold good on these very terms and conditions as and when the work of
production is resumed, and you shall allot further dates, as may be required by
us. Similarly, we undertake to bear your medical expenses in case the mishap
occurs in the shooting or at the time of shooting. Further dates may be adjusted
with mutual understanding between you, Movie artist’s association(MAA) /
Telugu Film Producer’s Council(TFPC).
13. If due to illness, injury/ accident, you fail to perform your duties to our full
satisfaction in terms of this arrangement, we shall have the right of cancelling
this arrangement or suspending the same till such time, as may be necessary, at
our sole discretion. The agreement is based on the classification of the illness
mentioned as under:

I. In case of illness, we have to read how many days that particular illness
continues. If the illness persists for one-day or two-days, you should not be
moved. If that illness is extended to one week and above, we can change
the artist, but the amount paid to you is not refundable.

II. In case of an accident, whatever the amount given to you till that date
shall not be refundable.

III. If not satisfied with your performance, we have to pay full and final
payment to you and then can change the artist.

14. Under no circumstances we or our representative shall be called upon or required

to deal with anyone other than yourself and it is agreed that none of the members
of your family or friends or associates shall have any right to interface with your
work in our said film in any manner whatsoever.
15. In consideration of the services agreed to be rendered by you in our said film and
various undertakings, commitments and covenants contained herein, we agree to
pay you lumpsum remuneration of Rs_____________ /-(Rupees
______________________________________________only)
including the remuneration for your personal assistants, makeup man and
hairdresser etc., if any engaged by you which amount shall be paid to you as
follows:
i. Rs____________/- shall be paid as advance on signing the letter of
arrangement.
ii. Rs____________/- shall be paid during shooting period(in convenient
installments payable at the end of each schedule.)
iii. Rs____________/- shall be paid after censor.

NOTE: • The payment will be made at the middle of each schedule. In case of
non-payment, the same should be reported to Movie Artist’s
Association(MAA), which would take the responsibility of realizing
the amount for you in a week’s time after the end of each
• schedule. Shall be paid before dubbing. Otherwise, a cheque
would be issued.
A.P. Film Chamber of commerce would undertake the clearance of
the cheques.
16. Notwithstanding anything contained in this arrangement, the final decision
concenring all matters whatsoever pertaining to the production, completion and
release of the said film shall always vest with us. In case of any dispute between
us with regard to the release date, the coordination committee would decide the
matter.
17. In case of any dispute arising out of this agreement , it should be approchedin the
like manner according to the priority: (1) coordination Meeting (2)Tribunal
&(3)court of law in Hyderabad.

18. It is our responsible to issue the T.D.S. certificate to you.

a. TDS certificate shall be issued to you within fifteen days from the date of
each payment.

b. The final payment shall be made before you completes your dubbing work.

c. In case of any mutual understanding between us, a post-dated cheque may

be issued to you. In this case the A.P. Film chamber of commerce holds
the responsibility to see that the cheque passes in the bank.

NOTE: Options for TDS for the last payment on mutual understanding:

i. The producer must give a letter to that extent that the producer has deducted

ii. such and such amount as per Income Tax law as T.D.S from your remuneration. If
the producer issues a cheque without deducting the T.D.S amount, it will be the
responsibility of an artist to pay the Income Tax along with his/ her other source
of income.
