8.1. Providing the second party with health care
in accordance with the rules and regulations

and their renewal fees and the consequent
delay of fines. As well as, professional
changing fees, exit and return fees and the
worker's return home ticket - in the same
manner used for arrival- after the end of the
relationship between the two parties

‫ ﻭﺭﺳﻮﻡ‬،‫ﻳﺘﺮﺗﺐ ﻋﻠﻰ ﺗﺄﺧﻴﺮ ﺫﻟﻚ ﻣﻦ ﻏﺮﺍﻣﺎﺕ‬
‫ ﻭﺗﺬﻛﺮﺓ‬،‫ ﻭﺍﻟﺨﺮﻭﺝ ﻭﺍﻟﻌﻮﺩﺓ‬،‫ﺗﻐﻴﻴﺮ ﺍﻟﻤﻬﻨﺔ‬
‫ ﺑﺎﻟﻮﺳﻴﻠﺔ‬- ‫ﻋﻮﺩﺓ ﺍﻟﻄﺮﻑ ﺍﻟﺜﺎﻧﻲ ﺇﻟﻰ ﻣﻮﻃﻨﻪ‬
‫ ﺑﻌﺪ ﺍﻧﺘﻬﺎﺀ ﺍﻟﻌﻼﻗﺔ ﺑﻴﻦ‬- ‫ﺍﻟﺘﻲ ﻗﺪﻡ ﺑﻬﺎ‬
‫ﺍﻟﻄﺮﻓﻴﻦ‬
‫ ﺗﺤﻤﻞ ﻧﻔﻘﺎﺕ ﺗﺠﻬﻴﺰ‬.6.8

or where the worker was recruited unless
the worker is interred in the Kingdom with
the approval of worker's family. The first

party shall be relieved if the General
Organization for Social Insurance (GOSI)
undertakes the same
8.7. Paying the first party's wages and settle his
‫ﻠﻘﺔ‬
entitlements within a maximum period of
one week from the date of the end of the
contractual relation. If the worker ends the
contract, the employer shall settle all his
entitlements within a period not exceeding
two weeks
9. Second Party's Obligations
‫ﻯ‬ ‫ﻟﺪ‬
9.1. To finish assigned in accordance with the
principles of the profession and in
accordance with the instructions of the
employer, if these instructions do not violate
the contract, order, public morals, or has a
potential danger

9.2. To take adequate care of the tools and
tasks assigned and the first party's ores that
at the second party's disposal or in which in
his/her custody, and restores the first
‫ﺸﺘ‬
party's materials that did not consumed
9.3. Approval of the first party deducting the
prescribed percentage from him/her from
the monthly wage to participate in the
‫ﺮﻙ‬
General Organization for Social Insurance
9.4. Committing to good behavior at work and at
all times committing to law, rules, and
etiquette in kingdom of Saudi Arabia. As
well as rules, regulations and directives
enforced by the first party and bearing all
fines about breaching the regulations

matters not explicitly stated herein, and it

may occur to them from time to time
11. Instruction
‫ﻠﻘﺔ‬
Without prejudice to the effectiveness of the
contract; And for the purpose of the Labor
Reform Initiative related to the transfer of
services of a non-Saudi worker, the worker may
transfer to another employer within a period not
less than 60 calendar days, and this provision
prevails over all that is opposed to it
Additional Terms
‫ﻯ‬ ‫ﻟﺪ‬
1. This contract is concluded for a specified
period of 2 Gregorian Year commences from
the actual joining date and approval of the
owner . 2.The fixed term employment
contract ends at the end of its term

term, and the provisions of Article 37 of the
Labor Law shall apply thereto . 4.The
contract may be renewed for a new fixed

parties, unless it is automatically renewed
3. 5.If a party wishes to renew the contract, the
party wishing to renew shall notify the other
party in writing at least 30 days before the

the contract is terminated by one of the
parties before the expiry of its term without a
legitimate reason, he shall undertake to
compensate the other party with a salary of
two months only
4. 7.If this contract expires and there are some
pending files or other obligations or advances

‫ﻓﻴﺠﺐ ﻋﻠﻰ ﺍﻟﻄﺮﻑ ﺍﻟﺬﻱ ﻳﺮﻏﺐ ﻓﻲ ﺍﻟﺘﺠﺪﻳﺪ‬
‫ﺇﺧﻄﺎﺭ ﺍﻟﻄﺮﻑ ﺍﻵﺧﺮ ﺑﺬﻟﻚ ﺧﻄﻴﺎ ﻗﺒﻞ ﻧﻬﺎﻳﺔ‬

6. Vacations: The employee is entitled to annual

‫ﻣﻤﺘﺪﺍ ﻓﻘﻂ ﺇﻟﻰ ﺣﻴﻦ ﺗﺼﻔﻴﺔ ﺍﻟﺘﺰﺍﻣﺎﺕ‬
‫ﻭﺣﻘﻮﻕ ﺍﻟﻤﻮﻇﻒ ﺍﻟﻤﺘﺒﻘﻴﺔ ﺑﻌﺪ ﺍﻧﺘﻬﺎﺀ ﻣﺪﺓ‬
،‫ ﻛﻤﺎ ﺇﻥ ﺗﻤﺪﻳﺪ ﺍﻟﻌﻘﺪ ﻻ ﻳﻌﻨﻲ ﺗﺠﺪﻳﺪﻩ‬،‫ﺍﻟﻌﻘﺪ‬
‫ﻓﺎﻟﺘﻤﺪﻳﺪ ﻳﻜﻮﻥ ﻟﻐﺮﺽ ﻣﺤﺪﺩ ﻭﻟﻔﺘﺮﺓ ﻣﺤﺪﺩﺓ‬
‫ﻻ ﻳﺘﺮﺗﺐ ﻋﻠﻰ ﻓﺘﺮﺓ ﺍﻟﺘﻤﺪﻳﺪ ﺍﻳﺔ ﺍﻣﺘﻴﺎﺯﺍﺕ‬
‫ﻟﻠﻤﻮﻇﻒ ﻭﺧﺼﻮﺻﺎ ﻣﻜﺎﻓﺄﺓ ﻧﻬﺎﻳﺔ ﺍﻟﺨﺪﻣﺔ‬
‫ﺑﻌﻜﺲ ﺍﻟﺘﺠﺪﻳﺪ‬.
‫ ﺍﻟﻌﻨﺎﻳﺔ ﺍﻟﺼﺤﻴﺔ ﻭﺍﻟﻌﻼﺟﺎﺕ ﻳﻘﻮﻡ ﺍﻟﻄﺮﻑ‬.5
‫ﺍﻷﻭﻝ ﺑﺎﻟﺘﺄﻣﻴﻦ ﺍﻟﺼﺤﻲ ﺍﻟﻼﺯﻡ ﻃﺒﻘﺎ ﻟﻠﻨﻈﺎﻡ‬

‫ﺍﻟﺸﺮﻛﺔ ﻛﻞ ﺳﻨﺔ ﻣﻊ ﺷﺮﻛﺎﺕ ﺍﻟﺘﺄﻣﻴﻦ ﻋﻠﻰ ﺍﻥ‬
‫ﻳﻜﻮﻥ ﺍﻟﺘﺄﻣﻴﻦ ﺍﻟﺠﺪﻳﺪ ﻣﻤﺎﺛﻞ ﻟﻤﺎ ﺳﺒﻘﻪ ﻣﺎﻟﻢ‬
‫ﺗﺘﻐﻴﺮ ﻭﻇﻴﻔﺔ ﺍﻟﻄﺮﻑ ﺍﻟﺜﺎﻧﻲ‬
‫ﻳﺤﻖ ﻟﻠﻄﺮﻑ ﺍﻟﺜﺎﻧﻲ ﺇﺟﺎﺯﺓ ﺳﻨﻮﻳﺔ‬: ‫ ﺍﻹﺟـــــﺎﺯﺍﺕ‬.6

‫ﺛﻼﺛﻮﻥ ﻳﻮﻣﺎ ﻭﺗﻜﻮﻥ ﺍﻹﺟﺎﺯﺓ ﺑﺄﺟﺮ ﻳﺪﻓﻊ ﻣﻘﺪﻣﺎ‬
‫ﻭﻳﺠﺐ ﺃﻥ ﻳﺘﻤﺘﻊ ﺍﻟﻤﻮﻇﻒ ﺑﻬﺎ ﻓﻲ ﺳﻨﺔ‬
‫ﺍﺳﺘﺤﻘﺎﻗﻬﺎ ﻭﻻ ﻳﺠﻮﺯ ﺍﻟﺘﻨﺎﺯﻝ ﻋﻨﻬﺎ ﺃﻭ ﺃﻥ‬
‫ﻳﺘﻘﺎﺿﻰ ﺑﺪﻻ ﻧﻘﺪﻳﺎ ﻋﻮﺿﺎ ﻋﻦ ﺍﻟﺤﺼﻮﻝ ﻋﻠﻴﻬﺎ‬
‫ﺃﺛﻨﺎﺀ ﺧﺪﻣﺘﻪ ﻭﻳﺘﻮﻟﻰ ﺍﻟﻄﺮﻑ ﺍﻷﻭﻝ ﺗﺤﺪﻳﺪ‬
‫ﺗﺎﺭﻳﺦ ﺑﺪﺍﻳﺘﻬﺎ ﻭﻓﻖ ﻣﺎ ﺗﺴﻤﺢ ﺑﻪ ﻇﺮﻭﻑ‬

2.‫ ﻳﺨﻄﺮ ﺻﺎﺣﺐ ﺍﻟﻌﻤﻞ ﺍﻟﻤﻮﻇﻒ ﺑﺈﺟﺎﺯﺗﻪ ﻗﺒﻠﻬﺎ‬.7
‫ ﻳﻮﻣﺎ ﻭﻻ ﻳﺠﻮﺯ ﻟﻠﻤﻮﻇﻒ ﺍﻻﻣﺘﻨﺎﻉ ﻋﻦ‬30 ‫ﺑﻤﺪﺓ‬
‫ﻳﺠﺐ‬.3 ‫ﺍﻟﻘﻴﺎﻡ ﺑﺎﻹﺟﺎﺯﺓ ﻷﻱ ﺳﺒﺐ ﻣﻦ ﺍﻷﺳﺒﺎﺏ‬
‫ﺃﻥ ﻳﺘﻤﺘﻊ ﺍﻟﻤﻮﻇﻒ ﺑﺈﺟﺎﺯﺗﻪ ﻓﻲ ﺳﻨﺔ‬
‫ﺳﺘﺤﻘﺎﻗﻬﺎ ﻭﻻ ﻳﺠﻮﺯ ﺍﻟﻨﺰﻭﻝ ﻋﻨﻬﺎ ﺃﻭ ﺃﻥ‬
‫ﻳﺘﻘﺎﺿﻰ ﺑﺪﻻ ﻧﻘﺪﻳﺎ ﻋﻮﺿﺎ ﻋﻦ ﺍﻟﺤﺼﻮﻝ ﻋﻠﻴﻬﺎ‬
‫ﺃﺛﻨﺎﺀ ﺧﺪﻣﺘﻪ‬

8. 4.Commencement of vacation shall be
effective from the date determined for the
Employee to enjoy his vacation, as per the

documents, all without prejudice to the right

9. Air Tickets: The second party shall be

‫ﻟﻢ ﻳﻜﻦ ﻫﻨﺎﻙ ﻣﺒﺮﺭ ﻣﻘﺒﻮﻝ ﻭﻣﺆﻳﺪ‬
‫ﺑﺎﻟﻤﺴﺘﻨﺪﺍﺕ ﻭﺫﻟﻚ ﻛﻠﻪ ﻣﻊ ﻋﺪﻡ ﺍﻹﺧﻼﻝ ﺑﺤﻖ‬

‫ﺻﺎﺣﺐ ﺍﻟﻌﻤﻞ ﺑﻔﺼﻞ ﺍﻟﻤﻮﻇﻒ ﺑﺴﺒﺐ ﺍﻟﻐﻴﺎﺏ‬

‫ﺍﻹﺟـــــﺎﺯﺓ ﺍﻟﺴﻨﻮﻳـــــﺔ ﺫﻫــﺎﺏ ﻭﻋـﻮﺩﺓ ﺑﺎﻹﺗﺠـﺎﻩ‬

‫ﻓﻲ ﺣﺎﻝ‬.‫ﺑﺬﻟﻚ ﻳﺘﺤﻤﻞ ﻓﺮﻕ ﺳﻌﺮ ﺍﻟﺘﺬﺍﻛﺮ‬
‫ ﻳﺴﺘﺤﻖ ﺍﻟﻄﺮﻑ ﺍﻟﺜﺎﻧﻲ ﺗﺬﻛﺮﺓ‬،‫ﺍﻧﺘﻬﺎﺀ ﺍﻟﻌﻘﺪ‬
‫ﺳﻔﺮ ﺑﺎﺗﺠﺎﻩ ﻭﺍﺣﺪ ﻋﻮﺩﺓ ﻭﻟﻜﻦ ﻻ ﻳﺴﺘﺤﻖ‬
‫ﺍﻟﻤﻮﻇﻒ ﺗﺬﻛﺮﺓ ﺍﻟﻄﻴﺮﺍﻥ ﺃﻭ ﺍﻟﺘﻌﻮﻳﺾ ﻋﻨﻬﺎ‬
‫ﻓﻴﻤﺎ ﻳﺘﻌﻠﻖ ﺑﺎﻟﺴﻨﺔ ﺍﻟﺘﻲ ﻳﺘﻢ ﻓﻴﻬﺎ ﺇﻧﺘﻬﺎﺀ‬
‫ﺍﻟﻌﻘﺪ ﻓﻴﻤﺎ ﺗﻢ ﺍﻟﺴﻤﺎﺡ ﻟﻠﻤﻮﻇﻒ ﺑﻨﻘﻞ‬
‫ﻛﻔﺎﻟﺘﻪ ﺇﻟﻰ ﻛﻔﻴﻞ ﺟﺪﻳﺪ‬
‫ ﻳﻘﺮ ﺍﻟﻤﻮﻇﻒ ﻭﻳﻠﺘﺰﻡ‬.1 : ‫ ﺍﻟﺘﺰﺍﻣﺎﺕ ﺍﻟﻤﻮﻇﻒ‬.11

‫ﻋﺎﺗﻘﻪ ﺑﺎﻹﺿﺎﻓﺔ ﺇﻟﻰ ﺍﻟﺘﻌﻠﻴﻤﺎﺕ ﻭﺍﻟﺘﻮﺟﻴﻬﺎﺕ‬
‫ﺍﻟﺼﺎﺩﺭﺓ ﻣﻦ ﺻﺎﺣﺐ ﺍﻟﻌﻤﻞ ﺃﻭ ﻣﻦ ﻳﻤﺜﻠﻪ ﻫﻲ‬
‫ ﻻ ﻳﺠﻮﺯ ﻟﻪ ﻣﺨﺎﻟﻔﺘﻬﺎ ﺑﺄﻱ‬،‫ﺍﻟﺘﺰﺍﻣﺎﺕ ﺟﻮﻫﺮﻳﺔ‬
‫ﺣﺎﻝ ﻣﻦ ﺍﻷﺣﻮﺍﻝ ﻭﺍﻻﻟﺘﺰﺍﻡ ﺑﺠﻤﻴﻊ ﺍﻟﺘﻌﻠﻴﻤﺎﺕ‬
‫ﻭﻟﻮﺍﺋﺢ ﺍﻟﻌﻤﻞ ﺍﻟﺼﺎﺩﺭﺓ ﻣﻦ ﺍﻟﻄﺮﻑ ﺍﻻﻭﻝ‬
2.‫ ﺍﻻﻟﺘﺰﺍﻡ ﺑﺘﻌﻠﻴﻤﺎﺕ ﺍﻟﺴﻼﻣﺔ ﻭﺍﻷﻣﻦ‬.12

‫ﺃﺧﺮﻯ ﻣﺮﺗﺒﻄﺔ ﺑﻮﻇﻴﻔﺔ ﺍﻟﻤﻮﻇﻒ ﻭﻣﺎ ﻳﺼﺪﺭ‬
‫ﺑﺨﺼﻮﺹ ﺗﻨﻔﻴﺬﻫﺎ ﻣﻦ ﺍﻟﻼﺋﺤﺔ ﺍﻟﺪﺍﺧﻠﻴﺔ‬
‫ﻭﺍﻟﺘﻌﻠﻴﻤﺎﺕ ﺍﻟﺼﺎﺩﺭﺓ ﻣﻦ ﺍﻟﻄﺮﻑ ﺍﻷﻭﻝ‬.
‫ﻳـﺘﻌﻬـﺪ ﺍﻟﻤﻮﻇﻒ‬.1 :‫ ﺣﻤﺎﻳﺔ ﺳﺮﻳﺔ ﺍﻟﻤﻌﻠﻮﻣﺎﺕ‬.15
‫ﺑﺄﻻ ﻳـﻘﻮﻡ ﺃﻭ ﻳﻤﻜﻦ ﺃﻭ ﻳـﺸـﺎﺭﻙ ﺃﻭ ﻳـﺴـﺎﻋﺪ ﺃﻱ‬
‫ﻓـﺮﺩ ﺃﻭ ﺷﺮﻛﺔ ﺃﻭ ﻛﻴﺎﻥ ﺑﻨﺸﺮ ﺃﻳـﺔ ﻣﻌﻠﻮﻣﺎﺕ‬
‫ﺗـﺘـﻌـﻠﻖ ﺑـﻨـﺸﺎﻃـﺎﺕ ﺻﺎﺣﺐ ﺍﻟـﻌﻤﻞ ﺃﻭ ﺷـﺮﻛـﺎﺋﻪ‬
‫ﺃﻭ ﻋـﺎﺋﻼﺗﻬﻢ ﺃﻭ ﺷــﺆﻭﻧﻬﻢ ﺍﻟـﺨﺎﺻــﺔ ﺃﻭ ﻣﺎ‬
‫ﻳﺘﻌﻠﻖ ﺑﻤﺪﺭﺍﺀ ﺻﺎﺣﺐ ﺍﻟﻌﻤﻞ ﺃﻭ ﻣﻮﻇﻔﻴﻪ ﺃﻭ‬
‫ﻭﻛﻼﺋﻪ ﺃﻭ ﺍﻟﻤﺴﺆﻭﻟﻴﻦ ﻟﺪﻳﻪ ﺃﻭ ﻣﺴﺎﻋﺪﻳﻪ ﺃﻭ‬
‫ﻣﺴﺘﺸﺎﺭﻳﻪ ﺑﻤﺎ ﻓﻲ ﺫﻟﻚ ﺃﻳﺔ ﺑﻴﺎﻧﺎﺕ ﺃﻭ‬
‫ ﺳﻮﺍﺀ‬،‫ﻣﻌﻠﻮﻣﺎﺕ ﺃﻭ ﻣﻮﺍﺩ ﺗﺘﻌﻠﻖ ﺑﻤﺎ ﺳﺒﻖ‬
‫ﻃﻴﻠﺔ ﻣﺪﺓ ﻋﻘﺪ ﺍﻟﻌﻤﻞ ﺃﻭ ﺑﻌﺪ ﻓﺴﺨﻪ ﺃﻭ‬
‫ﺇﻧﺘﻬﺎﺋﻪ ﻟﻤﺪﺓ ﺳﻨﺘﻴﻦ‬.
2.‫ ﻭﺇﺫﺍ ﺃﺧﻞ ﺍﻟﻤﻮﻇﻒ ﺑﺄﻱ ﻣﻦ ﻫﺬﻩ ﺍﻻﻟﺘﺰﺍﻣﺎﺕ‬.16
‫ ﻓﺈﻧﻪ ﻳﻠﺘـﺰﻡ ﺑﺘﻌﻮﻳﺾ ﺻﺎﺣﺐ‬،‫ﻭﺍﻟﺘـﻌـﻬﺪﺍﺕ‬
‫ﺍﻟﻌـﻤﻞ ﻋﻦ ﺟﻤﻴﻊ ﺍﻟﺨﺴﺎﺋﺮ ﺍﻟﺘﻲ ﻳﺘﻜﺒﺪﻫﺎ ﻣﻦ‬
‫ ﺃﺗﻌﺎﺏ ﺍﻟﻤﺤـﺎﻣـﺎﺓ ﺃﻭ‬،‫ﺟﺮﺍﺀ ﺫﻟﻚ ﺑﻤﺎ ﻓﻲ ﺫﻟﻚ‬
‫ﺃﻳﺔ ﺃﺗـﻌﺎﺏ ﺃﺧﺮﻯ ﺃﻭ ﻣﺼﺮﻭﻓـﺎﺕ ﻳﺘﺤﻤﻠﻬﺎ‬
‫ﺻﺎﺣﺐ ﺍﻟـﻌﻤﻞ ﻟﻀﻤﺎﻥ ﺍﻻﻟﺘﺰﺍﻡ ﺑﺎﻟﺘﻌﻬﺪﺍﺕ‬
‫ ﻛﻤﺎ ﻳﻠﺘﺰﻡ ﺍﻟﻤﻮﻇﻒ ﺑﺄﻥ ﻳﺴﻠﻢ‬،‫ﺍﻟـﺴـﺎﺑﻘﺔ‬
‫ﻟﺼﺎﺣﺐ ﺍﻟﻌﻤﻞ ﺃﻳﺔ ﻣﻠﻔﺎﺕ ﺃﻭ ﻭﺛﺎﺋﻖ ﺃﻭ ﺻﻮﺭ ﺃﻭ‬
‫ﻓﻮﺍﺋﺪ ﻳﺠﻨﻴﻬـﺎ ﺃﻭ ﺃﻳﺔ ﺃﺷﻴﺎﺀ ﺛﻤﻴﻨﺔ ﻳﺴﺘﻠﻤﻬﺎ‬
‫ﺑﺼﻮﺭﺓ ﻣﺒﺎﺷـﺮﺓ ﺃﻭ ﻏـﻴﺮ ﻣـﺒﺎﺷﺮﺓ ﻣـﻦ ﺟـﺮﺍﺀ‬
‫ﻫﺬﻩ ﺍﻟﻨﺸـﺎﻃـﺎﺕ‬

‫ﺍﻻﺧﺘﻼﻑ ﺑﻴﻦ ﻟﻐﺘﻲ ﺍﻟﻌﻘﺪ ﻫﻲ ﺍﻟﻠﻐﺔ ﺍﻟﻌﺮﺑﻴﺔ‬
