2. Contract's Period
The contract shall be effective for a period of 2

The second party shall be under probationary
period of 90 days beginning from the official date

4. Work Hours & Weekly Rest
Normal working days shall be 6 days per week
and working hours shall be 8 hours (DAILY). In

in accordance with the rules and regulations
of Cooperative Health Insurance Law

and fulfill the payments of contributions
according to their systems
8.3. Granting the second party annual leave,

official holidays and sick leave as required
by the labor regulations approved by the
Ministry of Human Resources and Social

8.4. Returning to the second party all certificates
or documents that has been submitted
8.5. Incurring the fees of pertaining to
recruitment of the second party, the fees of
the residence permit (Iqama), work permit
and their renewal fees and the consequent

‫ ﺗﺤﻤﻞ ﺭﺳﻮﻡ ﺍﺳﺘﻘﺪﺍﻡ‬.5.8
‫ ﻭﺭﺳﻮﻡ‬،‫ﺍﻟﻄﺮﻑ ﺍﻟﺜﺎﻧﻲ ﺃﻭ ﻧﻘﻞ ﺧﺪﻣﺎﺗﻪ ﺇﻟﻴﻪ‬
‫ ﻭﻣﺎ‬،‫ ﻭﺗﺠﺪﻳﺪﻫﻤﺎ‬،‫ ﻭﺭﺧﺼﺔ ﺍﻟﻌﻤﻞ‬،‫ﺍﻹﻗﺎﻣﺔ‬
‫ ﻭﺭﺳﻮﻡ‬،‫ﻳﺘﺮﺗﺐ ﻋﻠﻰ ﺗﺄﺧﻴﺮ ﺫﻟﻚ ﻣﻦ ﻏﺮﺍﻣﺎﺕ‬

manner used for arrival- after the end of the
relationship between the two parties

8.6. Paying for preparing the body of a
deceased worker and transporting it to the
location where the contract was concluded,
‫ﻠﻘﺔ‬
or where the worker was recruited unless
the worker is interred in the Kingdom with
the approval of worker's family. The first
party shall be relieved if the General
Organization for Social Insurance (GOSI)
undertakes the same
8.7. Paying the first party's wages and settle his
‫ﻟﺪ‬
entitlements within a maximum period of
one week from the date of the end of the
contractual relation. If the worker ends the
contract, the employer shall settle all his
‫ﻯ‬
entitlements within a period not exceeding
two weeks
9. Second Party's Obligations
‫ﺍﻟﻤ‬
9.1. To finish assigned in accordance with the
principles of the profession and in
accordance with the instructions of the
employer, if these instructions do not violate
‫ﺸﺘ‬
the contract, order, public morals, or has a
potential danger
9.2. To take adequate care of the tools and
tasks assigned and the first party's ores that
at the second party's disposal or in which in
‫ﺮﻙ‬
his/her custody, and restores the first
party's materials that did not consumed
9.3. Approval of the first party deducting the
prescribed percentage from him/her from
the monthly wage to participate in the
General Organization for Social Insurance
9.4. Committing to good behavior at work and at

to the first party's request prior to or during

whether he or she is free of chronic or

10. General Provisions
10.1. The Labor Law and its executive
regulations and the ministerial regulations
‫ﺍﻟﻤ‬
and resolutions and the organization's
work regulation approved by the Ministry
of Human Resources and Social
Development, shall be the reference in all
matters not explicitly stated herein, and it
‫ﺸﺘ‬
shall be deemed as an integral part of this
Contract. In addition, this Contract
replaces all previous agreements and
contracts including oral or written if any

10.2. Both parties agreed that the addresses
stated at the head of this Contract are the
official addresses for exchanging
notifications, announcements and
warnings and the correspondence is
considered a legal argument

11. Instruction
Without prejudice to the effectiveness of the
‫ﻟﺪ‬
contract; And for the purpose of the Labor
Reform Initiative related to the transfer of
services of a non-Saudi worker, the worker may

transfer to another employer within a period not
less than 90 calendar days, and this provision
prevails over all that is opposed to it

Additional Terms
1. If the second party terminates the contract
during this period, he shall pay the expenses
incurred by the first party in the process of his

employment.
2. The transportation allowance shall not be
paid if first party provides the second party
with a means of transportation to and from
work.

3. The second party declares that he does not
have any chronic diseases, and that the
documents submitted by him are correct and
complete, and in the event of the emergence
of otherwise the first party is entitled to
terminate this contract.

‫ ﻳﻘﺮ ﺍﻟﻄﺮﻑ ﺍﻟﺜﺎﻧﻲ ﺑﺄﻧﻪ ﻻ ﺗﻮﺟﺪ ﻟﺪﻳﻪ ﺃﻱ‬.3
‫ ﻭﺃﻥ ﺍﻟﻮﺛﺎﺋﻖ ﺍﻟﻤﻘﺪﻣﺔ ﻣﻨﻪ‬،‫ﺃﻣﺮﺍﺽ ﻣﺰﻣﻨﺔ‬
‫ ﻭﻓﻲ ﺣﺎﻟﺔ ﻇﻬﻮﺭ ﺧﻼﻑ‬،‫ﺻﺤﻴﺤﺔ ﻭﻣﻜﺘﻤﻠﺔ‬
‫ﺫﻟﻚ ﻳﺤﻖ ﻟﻠﻄﺮﻑ ﺍﻷﻭﻝ ﺇﻧﻬﺎﺀ ﻫﺬﺍ ﺍﻟﻌﻘﺪ‬
‫ ﻧﺼﻮﺹ ﻫﺬﺍ ﺍﻟﻌﻘﺪ ﻭﻛﻞ ﻣﺎ ﻟﻢ ﻳﺮﺩ ﻓﻴﻪ ﻣﻦ‬.4
‫ﺃﺣﻜﺎﻡ ﻳﻄﺒﻖ ﺑﺸﺄﻧﻪ ﻧﻈﺎﻡ ﺍﻟﻌﻤﻞ ﻭﺍﻟﻌﻤﺎﻝ‬.

5. Either party has the right to terminate this
contract by giving the other party a written
notice one month in advance of the
termination date, or by paying a warning
allowance equivalent to the basic salary of
the second party for one month.
6. The second party is not entitled to compete
with the same activity within the Riyadh
‫ﻠﻘﺔ‬
region
7. First party shall not be responsible for paying
any wages to second party for days of work
interruption caused by reasons beyond the
will of the first party that includes and not
limited to the matters of the judiciary and the
‫ﻟﺪ‬
extent to which God Almighty wills, the
epidemic, weather conditions and floods, civil
unrest and instability, explosions, fires, works
Hostility, war, riots or strikes.

8. The second party declares that his address
shown in contract is the chosen address, and
every notification or letter sent to him is legal
for its effects, and he must notify the first
party if he changes it.

9. The first party has the right to terminate this
contract without warning or paying a warning
allowance in the cases mentioned in the
applicable work system in the Kingdom of
Saudi Arabia.

10.The first party has the right to terminate the
contract if the worker has not fulfilled his
fundamental obligations arising from the

‫ﺍﻷﻭﻝ ﻭﻳﺸﻤﻞ ﺫﻟﻚ ﻭﻻ ﻳﻘﺘﺼﺮ ﻋﻠﻰ ﺃﻣﻮﺭ‬
‫ ﻇﺮﻭﻑ‬،‫ ﺍﻟﻮﺑﺎﺀ‬،‫ﺍﻟﻘﻀﺎﺀ ﻭﺍﻟﻘﺪﺭ ﻭﺍﻟﻜﻮﺍﺭﺙ‬
‫ ﺍﻟﻘﻼﻗﻞ ﺍﻟﻤﺪﻧﻴﺔ ﻭﻋﺪﻡ‬،‫ﺍﻟﻄﻘﺲ ﻭﺍﻟﻔﻴﻀﺎﻧﺎﺕ‬

‫ﻫﻮ ﺍﻟﻌﻨﻮﺍﻥ ﺍﻟﻤﺨﺘﺎﺭ ﻭﻛﻞ ﺇﻋﻼﻡ ﺃﻭ ﺧﻄﺎﺏ‬
‫ﻳﺮﺳﻞ ﺇﻟﻴﻪ ﻳﻜﻮﻥ ﻧﻈﺎﻣﻴﺎ ﻷﺛﺎﺭﻩ ﻭﻋﻠﻴﻪ ﺇﺧﻄﺎﺭ‬
‫ﺍﻟﻄﺮﻑ ﺍﻷﻭﻝ ﻓﻲ ﺣﺎﻝ ﺗﻐﻴﻴﺮﻩ‬.
‫ ﻳﺤﻖ ﻟﻠﻄﺮﻑ ﺍﻷﻭﻝ ﺇﻧﻬﺎﺀ ﻫﺬﺍ ﺍﻟﻌﻘﺪ ﺩﻭﻥ‬.9
‫ﺇﻧﺬﺍﺭ ﺃﻭ ﺩﻓﻊ ﺑﺪﻝ ﺇﻧﺬﺍﺭ ﻓﻲ ﺍﻟﺤﺎﻻﺕ ﺍﻟﻮﺍﺭﺩﺓ‬
‫ﻓﻲ ﻧﻈﺎﻡ ﺍﻟﻌﻤﻞ ﺍﻟﺴﺎﺭﻱ ﺍﻟﻤﻔﻌﻮﻝ ﺑﻪ ﻓﻲ‬
‫ﺍﻟﻤﻤﻠﻜﺔ ﺍﻟﻌﺮﺑﻴﺔ ﺍﻟﺴﻌﻮﺩﻳﺔ‬.
‫ ﻳﺤﻖ ﻟﻠﻄﺮﻑ ﺍﻷﻭﻝ ﺇﻧﻬﺎﺀ ﺍﻟﻌﻘﺪ ﺇﺫﺍ ﻟﻢ ﻳﺆﺩ‬.10
‫ﺍﻟﻌﺎﻣﻞ ﺍﻟﺘﺰﺍﻣﺎﺗﻪ ﺍﻟﺠﻮﻫﺮﻳﺔ ﺍﻟﻤﺘﺮﺗﺒﺔ ﻋﻠﻰ ﻋﻘﺪ‬
‫ ﺃﻭ ﻟﻢ‬،‫ ﺃﻭ ﻟﻢ ﻳﻄﻊ ﺍﻷﻭﺍﻣﺮ ﺍﻟﻤﺸﺮﻭﻋﺔ‬،‫ﺍﻟﻌﻤﻞ‬
‫ﻳﺮﺍﻉ ﻋﻤﺪﺍ ﺍﻟﺘﻌﻠﻴﻤﺎﺕ ﺍﻟﺘﻲ ﺃﻋﻠﻦ ﻋﻨﻬﺎ ﺻﺎﺣﺐ‬
‫ﺍﻟﻌﻤﻞ ﺭﻏﻢ ﺇﻧﺬﺍﺭﻩ ﻛﺘﺎﺑﺔ‬.
‫ ﻳﺤﻖ ﻟﻠﻄﺮﻑ ﺍﻷﻭﻝ ﺇﻧﻬﺎﺀ ﺍﻟﻌﻘﺪ ﺇﺫﺍ ﻭﻗﻊ ﻣﻦ‬.11
‫ﺍﻟﻌﺎﻣﻞ ﻋﻤﺪﺍ ﺃﻱ ﻓﻌﻞ ﺃﻭ ﺗﻘﺼﻴﺮ ﻳﻘﺼﺪ ﺑﻪ‬
‫ﺇﻟﺤﺎﻕ ﺧﺴﺎﺭﺓ ﻣﺎﺩﻳﺔ ﺑﺼﺎﺣﺐ ﺍﻟﻌﻤﻞ‬
‫ ﻳﺘﺒﻊ ﺍﻟﺘﻘﻮﻳﻢ ﺍﻟﻤﻴﻼﺩﻱ ﻓﻲ ﺣﺴﺎﺏ ﺟﻤﻴﻊ‬.12

epidemic, weather conditions and floods, civil

‫ﻣﻦ ﻧﻔﻘﺎﺕ ﻓﻲ ﻋﻤﻠﻴﺔ ﺗﻮﻇﻴﻔﻪ‬
‫ ﻳﺴﻘﻂ ﺑﺪﻝ ﺍﻟﻨﻘﻞ ﻓﻲ ﺣﺎﻟﺔ ﺗﻮﻓﻴﺮ ﺍﻟﻄﺮﻑ‬.15
‫ﻣﻦ‬ ‫ﺍﻻﻭﻝ ﻟﻠﻄﺮﻑ ﺍﻟﺜﺎﻧﻲ ﻭﺳﻴﻠﺔ ﻧﻘﻞ‬
‫ﻭﺇﻟﻰ ﺍﻟﻌﻤﻞ‬.
‫ ﻳﻘﺮ ﺍﻟﻄﺮﻑ ﺍﻟﺜﺎﻧﻲ ﺑﺄﻧﻪ ﻻ ﺗﻮﺟﺪ ﻟﺪﻳﻪ ﺃﻱ‬.16
‫ ﻭﺃﻥ ﺍﻟﻮﺛﺎﺋﻖ ﺍﻟﻤﻘﺪﻣﺔ ﻣﻨﻪ‬،‫ﺃﻣﺮﺍﺽ ﻣﺰﻣﻨﺔ‬
‫ ﻭﻓﻲ ﺣﺎﻟﺔ ﻇﻬﻮﺭ ﺧﻼﻑ‬،‫ﺻﺤﻴﺤﺔ ﻭﻣﻜﺘﻤﻠﺔ‬
‫ﺫﻟﻚ ﻳﺤﻖ ﻟﻠﻄﺮﻑ ﺍﻷﻭﻝ ﺇﻧﻬﺎﺀ ﻫﺬﺍ ﺍﻟﻌﻘﺪ‬
‫ ﻧﺼﻮﺹ ﻫﺬﺍ ﺍﻟﻌﻘﺪ ﻭﻛﻞ ﻣﺎ ﻟﻢ ﻳﺮﺩ ﻓﻴﻪ ﻣﻦ‬.17
‫ﺃﺣﻜﺎﻡ ﻳﻄﺒﻖ ﺑﺸﺄﻧﻪ ﻧﻈﺎﻡ ﺍﻟﻌﻤﻞ ﻭﺍﻟﻌﻤﺎﻝ‬.
‫ ﻳﺤﻖ ﻷﻱ ﻣﻦ ﺍﻟﻄﺮﻓﻴﻦ ﺇﻧﻬﺎﺀ ﻫﺬﺍ ﺍﻟﻌﻘﺪ‬.18
‫ﺑﺈﻋﻄﺎﺀ ﺍﻟﻄﺮﻑ ﺍﻷﺧﺮ ﺇﻧﺬﺍﺭﺍ ﺧﻄﻴﺎ ﻳﺴﺒﻖ ﺗﺎﺭﻳﺦ‬
‫ ﺃﻭ ﺑﺪﻓﻊ ﺑﺪﻝ ﺇﻧﺬﺍﺭ ﻳﻌﺎﺩﻝ‬،‫ﺍﻹﻧﻬﺎﺀ ﺑﺸﻬﺮ ﻭﺍﺣﺪ‬
‫ﺍﻟﺮﺍﺗﺐ ﺍﻷﺳﺎﺳﻲ ﻟﻠﻄﺮﻑ ﺍﻟﺜﺎﻧﻲ ﻋﻦ ﺷﻬﺮ‬
‫ﻭﺍﺣﺪ‬.
‫ ﻻﻳﺤﻖ ﻟﻠﻄﺮﻑ ﺍﻟﺜﺎﻧﻲ ﺍﻟﺘﻨﺎﻓﺲ ﺑﻨﻔﺲ ﺍﻟﻨﺸﺎﻁ‬.19
‫ﺩﺍﺧﻞ ﻣﻨﻄﻘﺔ ﺍﻟﺮﻳﺎﺽ‬
‫ ﺍﻟﻄﺮﻑ ﺍﻷﻭﻝ ﻟﻦ ﻳﻜﻮﻥ ﻣﺴﺆﻭﻝ ﻋﻦ ﺩﻓﻊ ﺃﻱ‬.20
‫ﺍﺟﻮﺭ ﻟﻠﻄﺮﻑ ﺍﻟﺜﺎﻧﻲ ﻟﻸﻳﺎﻡ ﺗﻌﻄﻞ ﺍﻟﻌﻤﻞ‬
‫ﺍﻟﻨﺎﺟﻤﺔ ﻋﻦ ﺃﺳﺒﺎﺏ ﺧﺎﺭﺟﺔ ﻋﻦ ﺃﺭﺍﺩﺓ ﺍﻟﻄﺮﻑ‬
‫ﺍﻷﻭﻝ ﻭﻳﺸﻤﻞ ﺫﻟﻚ ﻭﻻ ﻳﻘﺘﺼﺮ ﻋﻠﻰ ﺃﻣﻮﺭ‬

‫ﺇﻧﺬﺍﺭ ﺃﻭ ﺩﻓﻊ ﺑﺪﻝ ﺇﻧﺬﺍﺭ ﻓﻲ ﺍﻟﺤﺎﻻﺕ ﺍﻟﻮﺍﺭﺩﺓ‬
‫ﻓﻲ ﻧﻈﺎﻡ ﺍﻟﻌﻤﻞ ﺍﻟﺴﺎﺭﻱ ﺍﻟﻤﻔﻌﻮﻝ ﺑﻪ ﻓﻲ‬
‫ﺍﻟﻤﻤﻠﻜﺔ ﺍﻟﻌﺮﺑﻴﺔ ﺍﻟﺴﻌﻮﺩﻳﺔ‬.

‫ ﺃﻭ ﻟﻢ‬،‫ ﺃﻭ ﻟﻢ ﻳﻄﻊ ﺍﻷﻭﺍﻣﺮ ﺍﻟﻤﺸﺮﻭﻋﺔ‬،‫ﺍﻟﻌﻤﻞ‬
‫ﻳﺮﺍﻉ ﻋﻤﺪﺍ ﺍﻟﺘﻌﻠﻴﻤﺎﺕ ﺍﻟﺘﻲ ﺃﻋﻠﻦ ﻋﻨﻬﺎ ﺻﺎﺣﺐ‬
‫ﺍﻟﻌﻤﻞ ﺭﻏﻢ ﺇﻧﺬﺍﺭﻩ ﻛﺘﺎﺑﺔ‬.
‫ ﻳﺤﻖ ﻟﻠﻄﺮﻑ ﺍﻷﻭﻝ ﺇﻧﻬﺎﺀ ﺍﻟﻌﻘﺪ ﺇﺫﺍ ﻭﻗﻊ ﻣﻦ‬.24
‫ﺍﻟﻌﺎﻣﻞ ﻋﻤﺪﺍ ﺃﻱ ﻓﻌﻞ ﺃﻭ ﺗﻘﺼﻴﺮ ﻳﻘﺼﺪ ﺑﻪ‬
‫ﺇﻟﺤﺎﻕ ﺧﺴﺎﺭﺓ ﻣﺎﺩﻳﺔ ﺑﺼﺎﺣﺐ ﺍﻟﻌﻤﻞ‬
‫ ﻳﺘﺒﻊ ﺍﻟﺘﻘﻮﻳﻢ ﺍﻟﻤﻴﻼﺩﻱ ﻓﻲ ﺣﺴﺎﺏ ﺟﻤﻴﻊ‬.25
‫ﺍﻟﺒﻨﻮﺩ ﺍﻟﻤﻨﺼﻮﺹ ﻋﻠﻴﻬﺎ ﻓﻲ ﻫﺬﺍ ﺍﻟﻌﻘﺪ‬
‫ ﺣﺮﺭ ﻫﺬﺍ ﺍﻟﻌﻘﺪ ﺑﻠﻐﺘﻴﻦ ﺍﻟﻌﺮﺑﻴﺔ ﻭﺍﻻﻧﺠﻠﻴﺰﻳﺔ‬.26
