And together they are referred to as (the two parties .(ﻭﻳﺸﺎﺭ ﻟﻬﻤﺎ ﻣﻌﺎ ﺑـ )ﺍﻟﻄﺮﻓﺎﻥ ﺃﻭ ﺍﻟﻄﺮﻓﻴﻦ
or both parties).
The above details shall be deemed as an integral part of this contract, and ﻭﺗﺸﻜﻞ ﻣﻊ ﻣﻼﺣﻘﻪ،ﺗﻌﺘﺒﺮ ﺑﻴﺎﻧﺎﺕ ﺍﻟﻄﺮﻓﻴﻦ ﺃﻋﻼﻩ ﺟﺰﺀﺍ ﻻ ﻳﺘﺠﺰﺃ ﻣﻦ ﻫﺬﺍ ﺍﻟﻌﻘﺪ
together with its annexes, they form an integrated unit and are considered .ﻭﺣﺪﺓ ﻣﺘﻜﺎﻣﻠﺔ ﻭﺗﻌﺘﺒﺮ ﺟﺰﺀﺍ ﻣﻦ ﺍﻟﻌﻘﺪ ﺑﺤﻴﺚ ﺗﻔﺴﺮ ﻭﻳﺘﻤﻢ ﺑﻌﻀﻬﺎ ﺑﻌﻀﺎ

The second party shall be under probationary ﻳﻮﻣﺎ ﺗﺒﺪﺃ90 ﻳﺨﻀﻊ ﺍﻟﻄﺮﻑ ﺍﻟﺜﺎﻧﻲ ﻟﻔﺘﺮﺓ ﺗﺠﺮﺑﺔ ﻣﺪﺗﻬﺎ
period of 90 days beginning from the joining date ﻣﻦ ﺗﺎﺭﻳﺦ ﻣﺒﺎﺷﺮﺗﻪ ﻟﻠﻌﻤﻞ ﻭﻻ ﻳﺪﺧﻞ ﻓﻲ ﺣﺴﺎﺑﻬﺎ ﺇﺟﺎﺯﺓ
and it does not include Eid AL-FITR holiday nor
.ﻋﻴﺪﻱ ﺍﻟﻔﻄﺮ ﻭﺍﻷﺿﺤﻰ ﻭﺍﻻﺟﺎﺯﺓ ﺍﻟﻤﺮﺿﻴﺔ
Eid AL-ADHA holiday nor sick leaves.

total amount of (800) Saudi riyals. .ﺭﻳﺎﻝ ﺳﻌﻮﺩﻱ ﻳﺴﺘﺤﻖ ﻧﻬﺎﻳﺔ ﻛﻞ ﺷﻬﺮ

Granting the second party annual leave, official holidays ﻣﻨﺢ ﺍﻟﻄﺮﻑ ﺍﻟﺜﺎﻧﻲ ﺍﻹﺟﺎﺯﺍﺕ ﺍﻟﺴﻨﻮﻳﺔ ﻭﺍﻟﻌﻄﻞ ﺍﻟﺮﺳﻤﻴﺔ
and sick leave as required by the labor regulations approved ﻭﺍﻹﺟﺎﺯﺍﺕ ﺍﻟﻤﺮﺿﻴﺔ ﻭﻓﻖ ﻣﺎ ﺗﻘﺘﻀﻴﻪ ﻻﺋﺤﺔ ﺗﻨﻈﻴﻢ ﺍﻟﻌﻤﻞ
by the Ministry of Human Resources and Social ﺑﻤﺎ،ﺍﻟﻤﻌﺘﻤﺪﺓ ﻣﻦ ﻭﺯﺍﺭﺓ ﺍﻟﻤﻮﺍﺭﺩ ﺍﻟﺒﺸﺮﻳﺔ ﻭﺍﻟﺘﻨﻤﻴﺔ ﺍﻻﺟﺘﻤﺎﻋﻴﺔ
Development. ﻻ ﻳﺘﻌﺎﺭﺽ ﻣﻊ ﻧﻈﺎﻡ ﺍﻟﻌﻤﻞ ﻭﻻﺋﺤﺘﻪ ﺍﻟﺘﻨﻔﻴﺬﻳﺔ

Approval of the first party deducting the prescribed ﺍﻟﻤﻮﺍﻓﻘﺔ ﻋﻠﻰ ﺍﺳﺘﻘﻄﺎﻉ ﺍﻟﻄﺮﻑ ﺍﻷﻭﻝ ﻟﻠﻨﺴﺒﺔ ﺍﻟﻤﻘﺮﺭﺓ ﻋﻠﻴﻪ ﻣﻦ
percentage from him/her from the monthly wage to ﺍﻷﺟﺮ ﺍﻟﺸﻬﺮﻱ ﻟﻼﺷﺘﺮﺍﻙ ﻓﻲ ﺍﻟﻤﺆﺳﺴﺔ ﺍﻟﻌﺎﻣﺔ ﻟﻠﺘﺄﻣﻴﻨﺎﺕ

Both parties acknowledge that they have known and ﻳﻘﺮ ﺍﻟﻄﺮﻓﺎﻥ ﺑﺎﻧﻬﻤﺎ ﻗﺪ ﻋﻠﻤﺎ ﻭﻓﻬﻤﺎ ﻛﻞ ﺃﺣﻜﺎﻡ ﻫﺬﺍ ﺍﻟﻌﻘﺪ

The singular form includes the plural and the plural form
،ﺻﻴﻐﺔ ﺍﻟﻤﻔﺮﺩ ﺗﺸﻤﻞ ﺍﻟﺠﻤﻊ ﻭﺻﻴﻐﺔ ﺍﻟﺠﻤﻊ ﺗﺸﻤﻞ ﺍﻟﻤﻔﺮﺩ
includes the singular, and the reference to one gender
ﻭﺍﻹﺷﺎﺭﺓ ﺇﻟﻰ ﺟﻨﺲ ﻭﺍﺣﺪ ﺗﻌﻨﻲ ﺍﻟﺠﻨﺴﻴﻦ ﻭﺍﻹﺷﺎﺭﺓ ﺇﻟﻰ
means both genders, and the reference to persons includes
ﺍﻷﺷﺨﺎﺹ ﺗﺸﻤﻞ ﺍﻷﺷﺨﺎﺹ ﺍﻟﻄﺒﻴﻌﻴﻴﻦ ﻭﺍﻻﻋﺘﺒﺎﺭﻳﻴﻦ ﻣﺎ ﻟﻢ
natural and legal persons unless the context of the text
ﻳﻘﺘﺾ ﺳﻴﺎﻕ ﺍﻟﻨﺺ ﻏﻴﺮ ﺫﻟﻚ
requires otherwise.

Both parties agreed that the second party shall work for the
first party under his management or supervision in the ﺍﺗﻔﻖ ﺍﻟﻄﺮﻓﺎﻥ ﻋﻠﻰ ﺍﻥ ﻳﻌﻤﻞ ﺍﻟﻄﺮﻑ ﺍﻟﺜﺎﻧﻲ ﻟﺪﻯ ﺍﻟﻄﺮﻑ ﺍﻻﻭﻝ
position of Car driver public Furthermore he shall ، ﺃﻭ ﺇﺷﺮﺍﻓﻪ ﺑﻮﻇﻴﻔﻪ ﺳﺎﺋﻖ ﺳﻴﺎﺭﺓ ﻋﻤﻮﻣﻰ، ﺗﺤﺖ ﺇﺩﺍﺭﺗﻪ
undertake the work assigned to him in proportion to his ﻭﻣﺒﺎﺷﺮﺓ ﺍﻟﻌﻤﻞ ﺍﻟﻤﻜﻠﻒ ﺑﻪ ﺑﻤﺎ ﻳﺘﻨﺎﺳﺐ ﻣﻊ ﻗﺪﺭﺍﺗﻪ ﺍﻟﻌﻤﻠﻴﺔ
practical scientific and technical capabilities and according ﻭﺑﻤﺎ ﻻ ﻳﺘﻌﺎﺭﺽ، ﻭﺍﻟﻔﻨﻴﺔ ﻭﻓﻘﺎ ﻻﺣﺘﻴﺎﺟﺎﺕ ﺍﻟﻌﻤﻞ، ﻭﺍﻟﻌﻠﻤﻴﺔ،
to the needs of the work and in a manner that does not ، ﻣﻊ ﺍﻟﻀﻮﺍﺑﻂ ﺍﻟﻤﻨﺼﻮﺹ ﻋﻠﻴﻬﺎ ﻓﻲ ﺍﻟﻤﻮﺍﺩ ﺍﻟﺜﺎﻣﻨﺔ ﻭﺍﻟﺨﻤﺴﻮﻥ
conflict with the regulations stipulated in Articles fifty ﺍﻟﺴﺘﻮﻥ ﻣﻦ ﻧﻈﺎﻡ ﺍﻟﻌﻤﻞ، ﺍﻟﺘﺎﺳﻌﺔ ﻭﺍﻟﺨﻤﺴﻮﻥ.

The first party has the right to postpone the leave after the

The first party shall immediately report any act or omission ﺍﻥ ﻳﺒﻠﻎ ﺍﻟﻄﺮﻑ ﺍﻻﻭﻝ ﻓﻮﺭﺍ ﻋﻦ ﺃﻱ ﻓﻌﻞ ﺍﻭ ﺗﻘﺼﻴﺮ ﻳﺘﻨﺞ ﻋﻨﻪ
that results in material or moral damage or loss to the work ﺍﻟﺤﺎﻕ ﺿﺮﺭ ﺍﻭ ﺧﺴﺎﺭﺓ ﻣﺎﺩﻳﻪ ﺍﻭ ﻣﻌﻨﻮﻳﻪ ﺑﺎﻟﻌﻤﻞ
Instructions ﺗﻌﻠﻴﻤﺎﺕ
In the event that the second party desires to ﺃﻗﺮ ﺍﻟﻄﺮﻓﺎﻥ ﻭﺍﺗﻔﻘﺎ ﺑﺄﻥ ﻳﻘﺪﻡ ﺍﻟﻄﺮﻑ ﺍﻟﺜﺎﻧﻲ ﻟﻠﻄﺮﻑ
terminate the contract to transfer to another ، ﻳﻮﻣﺎ ﺗﻘﻮﻳﻤﻴﺎ90 ﺍﻷﻭﻝ ﺇﺷﻌﺎﺭﺍ ﻛﺘﺎﺑﻴﺎ ﺑﻤﺪﺓ ﻻ ﺗﻘﻞ ﻋﻦ
employer, both parties acknowledge and agree ﻓﻲ ﺣﺎﻝ ﺭﻏﺐ ﺍﻟﻄﺮﻑ ﺍﻟﺜﺎﻧﻲ ﺑﺈﻧﻬﺎﺀ ﺍﻟﻌﻘﺪ ﻟﻼﻧﺘﻘﺎﻝ

that the second party serves the first party a ﻭﻳﺴﻮﺩ ﻫﺬﺍ ﺍﻻﺗﻔﺎﻕ ﻋﻠﻰ ﻛﻞ ﺷﺮﻁ،ﻟﺼﺎﺣﺐ ﻋﻤﻞ ﺁﺧﺮ
written notice no less than 90 calendar days prior ﻣﻊ ﺍﺣﺘﻔﺎﻅ ﺍﻟﻄﺮﻓﻴﻦ ﺑﺎﻟﺮﺟﻮﻉ ﻋﻠﻰ ﺍﻟﻄﺮﻑ،ﻳﻌﺎﺭﺿﻪ
to the termination date. In addition, this .ﺍﻵﺧﺮ ﺑﻤﺎ ﻳﻨﺘﺞ ﻋﻨﻪ ﻣﻦ ﺣﻘﻮﻕ
agreement prevails over every condition that
opposes it. Thus, parties can recourse to the other
party with other rights.
